The Board of Adjustment of Spokane County having held a public hearing on July 6, 1981, and having fully considered all testimony presented thereat, and having rendered a decision on the 6th day of .1uly 1981, approving said proposal, does hereby make the fallowing: FINDINGS OF FACT 1. That the proposal is generally located at the southwest corner of McDanald Road and 12th Avenue, Spokane County, LVashington. 2. That the proposal consists of a request lor a conditional use for a 96-unit residence for senior citizens and variance on the number of parking spaces. 3. That the Generalized Comprehensive F'lan for Spokane County indicates Urban Designation for the area encompasseci by this proposal. 4. That the provisions of RCW Chapter 43.21C, (State Environ- mental Policy Act) have been complied with and the Board of Adjustment concurs with the Zoning Adjustor's issuance of a declaration of non-significance for this proposal. 5. That the Spokane County Zvning Adjustor held a public hearing on May 27, 1981, concerning the proposal, and that on June 10, 1981, the Spokane County Zoning Adjustor, by Conclusions of Law and Findings of Fact did render a decision to approve the proposal. 1 . , ~ • FINDINGS AND ORDER CUE-10-81 &VE-83-81 - 2 , • . , , , 6. That on June 19, 1981, an appeal from the decision of the Zoning Adjustor of Spokane County was filed by Mr. Stephen D. Ferrell, an objector. 7. That the existing land uses in the area of proposal include single family residences, church facilities, elementary Sr_I'100I and undeveloped land. 8. That the proposal is compatible witl) existing uses in the area. 9. That the proposal is not detrimental or° otherwise harmful to the public health, safety and welfare. 10. That the pr-oposal is not totally inconsistent with the surrounding land use classifications and does not grant a special pr•ivilege or rights to the applicant different than those enjoyed by adjacent property owners. 11. That the proposal is situated within the recorded fire service area of Fire District #1. 12. That the proper legal requirements for• advertising of the hearing before the Spokane County Board of Adjustmerit have been met. From the foregoing Findings, a review of the Planning Department Staff Report related to File CUE-10-81, and the staff presentation of the files, the Board of Adjustment of Spokane County hereby approves the proposed conditional use subject to the following conditions: 1. Adopt the Conditions of the Spokane County Zoning Adjustor Conclusions of Law and Findings of Fact of lui)e 10, 1981. 2. Subsequent to the issuance of the occupancy permit, the Zoning Adjustor may hold a public hearing to deter-rYiine the necessity of improving 12th Avenue to mitigate traffic problems associated with this project. However if adequate provisions are not made for on-site parking the resultant vehicle overflow will park on adjacent public streets. VS-67-81 The County Engineer has no conditions relative to this appli- cation. You should be advised that the proposal is located with a Flood Hazard Area. CUS-13-81 That sidewalks are required along Shasta Drive and a drainage plan submitted for review and appraval by the County Engineer. These requirements must be in conformance with the provisions of the Board of County Commissioners Resolution 80-1592 as ammended. YW-64-81 The County Engineer has no conditions concerning this applica- tion. VE-50-81 Neither Hill Road or Dalke Avenue are established and maintained county roads. Applicants property does not front on Dalke Avenue which is the proposed access route. Therefore it is questionable that reasonable assurance can be provided that Dalke will ever be established or maintained. Access via Hill Road poses a similar situation. It is the County Engineer's recommendation that this application be denied unless the applicant can provide reasonable assurance that Dalke Avenue could be established and maintained at some time in the future. This would include: Persons owning property on Dalke Avenue through which the access easement passes (Tract 5 of McDowell's Tract must acknowledge & agree to the following: 1. She was 87 and had becn tota2ly blind. Anna was able to care for herself except for preparing her major meal. Because Liiac Plaza had a meal program, Anna was able to live at the Plaza instead of in a nursing home. Another Plaza program which was necessary to keep Anna out of a nursing ho.1c ,s the visiting nurse program. The nurse gave Ann3 neeuec shots twice a month; .:-.;d.:r ;1er docto:'s orders. Anna's legs, very vulnerable for a 'iiir.d person, were chec:cea wCaiciy and treated iohen necessary. The doctor was kept informet." by LiE aurse. Th:.s service, alone, saved hundreda of dollars, which would have been paid by :iedicare or ::edicaid. Anna was one of the lowest income residents. :ieeping Anna out of a nursing home saved at least $500 a month in the difference in subsidieg at the Plaza ver3us a r.ursing home. This was a savings of about $6.000 a year, or aimost $36,000 for the six yeara Anna ltved at the Plaza. There are at least 40 other residents at the Plaza who can talce care of themselves, but need the meal and the nursing care available. Aside from the money saved, the zuct that Anna could participate iil Li1e xany accivicies, get her groceries in the co-op grocery and have ner hair shampooed, al:: at tile Plazn, hopefully added to Anna's "quality of life" and helped to make 'her last ycars more meaningful. This is a poignant and true fact which has proven tnat our oid,~r citize:11s who arc d~one or choose to live alone can have a full and meaningful life with friends around them. There were other prograws which were a help to keep Anna out or ci nursing home. These suggestione could serve as a guide for what could be dor.e in retirement homes tnroughouc the country. The goal at Lilac Plaza is "to meet eveYy need ot every resident". The following prol;rar;,s., activities and facilities are available to meet every need. 1. A meaZ program. The meal is served at the table, not served careteria style. There is provision for special diets and tray service is available. 2. A nursing service, with emphasis on prevention and early detection. This program should be e muet in every retirement home. Zledicare is bacicwards! Care is available only after the fact. A r pieher} ~ve heel:h araRr~ ahould emphasize prevention and early detec[ion. The 385 Army leserve unit ran phyaical assessments for our residents, including chest x-rays, electrocardiograms, blood and urine checks, tests for eye, ear and breathing functions. The nurse monitors blood pressures twice weekly, gives shots under doctor's orders, p,ives foot care and checlcs up on medications. She visits the sick in their apartments and reports to the doctor. 3. The Administrator is a notary public. This is a free service. 4. A copy machine is available, at cost. 5. There is a small change drawer for making change for busses, iaundryY etc. 6. Volunteers in the oFfice make out me;-tl tickets for residents' guests, take care of [heir dry cleaning and prescriptions delivered from the pharmacy and he2p residents witti any prablems they may have. 7. 'Z;I-S'.,*T{? }7QR'tC'. ~ . . . ~ TESTIMONY PRESENTED AT HEARING ON MAY 27, 1981 - I am John Haugan. I live at 9711 N. Cedar Road, Spokane, WA. I have been the administrator for 9~ years of Lilac Plaza Retirement Home, which is sponsored by the Spokane Baptist Association. I have had considerable experience in the field of aging, having served for almost two years as a senior citizens' center director in Missoula, Montana. I have been the coordinator for the White House Conference on Aging for Montana. In addition, I have sezved as the preaident of the Spokane Council on Aging and have served on the Area Agency on Aging Board. I have also represented the elderly on the Esetern Washington Health Systems Agency. I served as the pastor of the Spokane Valley Baptist Church, which is located to the east of the property under discussion. The Spokane Valley Baptist Church has desired to serve the community in many ways. It has opened its doors for a meeting place for the Girl Scouts, Boy Scouta, Jobs Daughters and the local and area clubs of Overeaters' Anonymous. The Day Care Association, community exercise classes and a voting precinct is housed in the church. It is also the meeting place for the Noah's Ark Day Care Center. The church has provided fin- ancial assistance for children of refugee families and others so that the children could attend the center. Single parent families bring their children to the day care center, enabling the parent to work, instead of being on welfare. If the parent could not work and had to be on welfare, the cost would be $325.00 per month. The church has heen collecting money and food for the food bank. Last fall, members of the church went to Lind, Washington to pick up potatoes and brought back three pick-up loads for the food bank. The men of the church have aponsored basketball teams in the Church Basketball League. The League provides a poaitive, wholeaome outlet for youth who do not make the school teams. Youth who get into trouble when there are no positive alternativea cost taxpayers many thousands of dollars. The coat for the care of one boy is $22,000 to $40,000 a year. The church has been concerned about the elderly in the community. A group of inen have helped widowa or elderly couplea with chorea to keep them in their homes as long as posaible. As a Christian church, we are to, as .Tesus said, "Feed the hungry, clothe the naked, take in the stranger and care for the sick". Some of our elderly are finding it increasingly difficult to stay in their own homes because of age, failing eyesight or infirmities of various kinds. These people are not ready for a nursing home at $1,000 a month. They can take care of themselves if a meal is provided and a nurse can look in on them occasionally. We have been doing this at Lilac Plaza for 9-41 years and know it works. At least 40 people at the Plaza would be in nursing homes if they did not have an alternative to the nursing home, such as the Plaza offers. The savings to the individual, the family or the tax payer is about $700 a month, which represents a savings for the people in our build- ing of $28,000 a month, or $336,000 a year. Many people who have to go to a nursing home use up all their assets in a very short time and then become wards of the state. The bill for taking care of elderly in nursing homes is now $280,000,000 a biennium and rising. When one realizes the enormous problem to society the nursing home bill is becoming, it is imperative that we provide alternatives to those who do not need the full service of a nursing home. , • . • • , A few years ago, in planning to meet the needs of the people, the church members made a survey of a two-mile area around the church. We asked the people who an-- swered our questions about how we could best meet the needs for young people, for families and for the elderly. We had in mind a multi-purpose room and housing for the elderly. My wife and I surveyed the homes from 13th to 15th Avenue, east of the church. Other families took other areas. Questions were asked and the answers are on record at the Valley Baptist Church. When my wife and I made the survey, some of the falk thought we were missionaries of another group and refused to talk to us. So, perhaps the questionnaire and method of securing the survey was not the best, but considering that it wae amatuers doing it, we did our best. Clarence Hart and I also visited the various agencies in the city and county concerning our proposal to get reactions from the various government agencies. It was on the basie of this favorable information that we obtained an option on the land to build a retirement home for the elderly. This home would enable many of our people to stay in their own neighborhood. The fellowship hall is being built to supply a social meeting place for not only the residents of the retirement hoem, but also the retirees in the immediate area. While serving as the planning coordinator for the state of Montana, I read a survey conducted by Carroll College in Helena of why the elderly left their communities to move to placea like Sun City, Leisure World, etc, The state was concerned about the elderly leaving the state, because when they moved, they took their in- comes and their seaets and the state was poorer for it. The survey ahowed that the elderly left when there were no activities or programs for the elderly. A home in the Valley would provide needed activities. In addition, retirees are happier living in their own communities with their friende. It is our desire that the retirement home be a real asset to the community. Using the Plaza as an example, we can anticipate besutiful grounda and gardena. A traffic survey in Seattle showed that aingle family resident areas average 10 trip-ends a day. Going to the store and back would be two trip-ends. A 15-day survey taken at the Criata Home in Seattle ahowed that they averaged .1258 trip-ends per resident per day. The Crista Home used a van to take ten or more people at a time to the grocery store. The Valley Baptist Church, as part of its long range miniatry, ie planning to use its church van for transportation for the residents in the home. The residents in the Plaza have used their abilities to contribute to the community with such things as making lap robes for nursing hamea, making quilts for burned out families, providing materials for such things as the Union Gospel Mission and Ogden Hall. This matte►° was hear-d in its entirety on May 27, 1981 after beinq continued from the May 13, 1981 hearing date (see Continuation Order dated Ma.y 13, 1981). After conclusion of testimony the Zoninq Adjustor set June 10, 1981 at 1:15 p.m. as the time to announce his decision. After re- viewinq the environmental checklist, the Planning Department made a proposed threshold determination that approval of this application will not have a siqni- ficant adverse impact uoon the quality of the environment and that an environ- mental impact statement is not required. That having visited the subject property, having evaluated the natural, ph,ysical and social systems, and having considered public testimony related to this application the Zoninq Ad,justor concurrs with the Planninq Department's finding that this proposal will not have a significant adverse impact on the quality of the environmemt. THEREBY A FINAL DECLARATION OF NON-SIGNIFICANCE HAS QEEN ISSUED QY THE ZONINr, ADJUSTOR ON JUNE 10, 1981. FINDINGS OF FACT 1. The apqlicant is proposinq a two story senior citizen resident facility containinq 96 single and two bedroom units on a parcel of land 5.5 acres in size. Also, the applicant is proposinq 60 parking spaces whereas the require- ment for this project is 144 parking spaces. II. The Spokane County Zoning Ordinance in this instance provides that such use may be considered in accordance with conditional standards as prescribed in Section 4.24.010 and 4.24.040. Conditional Standards are as follows: l. Minimum Lot Area: 3 acres The applicant's property contains 5.5 acres. 2. Minimum lJidth at Buildin9 Line: 125 feet There is 290 feet of width at the buildina line. 3. Minimum continuous frontage along a public str•eet: 100 feet There is 590 feet of frontape alonq 12th Avenue. 4. Minimum Lot Depth: 125 feet The sub,ject property has 670 feet of depth. 5. Maximum Lot Coveraqe: 35% The proposal covers 21.2°0. 6. Minimum Setback distance: Front yard (12th Ave.) - 35 feet Applicant is providing 50 feet setback. Rear vard - 25 feet Project has 120 feet setback. Side yard - 25 feet Prollect has 30 feet setback. 7. One unliqhted sign not to exceed six square feet in area. The applicant shall comply with this requirement. Further examination of the zoning ordinance indicated that there are no other requirements for retirement homes. However, under Section 4.24.010, the Zoninq Adjustor has the responsibility to determine that such use will not be detriitiental to the qeneral comprehensive plan and surrounding properties, and that the Zoninq Ad,justor has the right to stipulate restriction and conditions to uphold the spirit and intent of the zoning ordinance and to mitiqate an.y adverse effect unon neighborhood properties. The maxiinum height proposed at the building core is 28 feet 6 inches high. The residential building wings are 24 feet hiqh and are considered to be two- stories. The Spokane County Zoninq Ordinance, Section 4.03.020 (49) defines "Story" as "....A sinqle story shall not exceed sixteen feet in heiqht from the top of the foundation to the roof ridge line...." IV. The Zoning Adjustor finds that the Planning Department report (Exhibit "A") accuratel.y sets forth the issues, qeneral findings of fact, apnlicable policies and provisions includinq departmental recommendations in this matter. This re- port is incorporated by reference as part of these Findings of Fact contained herein. v. The staff report (Exhibit "A") contained public aqencies recommended con- ditions of approval. Those agencies responding are County Planninq Departnient, County Enginee ring Department, Count.y Utilities Department, County Health Dist- rict Departnent, Sookane County Valley Fire District, State Departinent of Social and Health Services and the State Departnent of Ecology. After reviewing these recommendations, the Zoning Adjustor finds that these conditions with the ex- ception of recommendation by the Valley Fire Department reqarding sprinkler system noted in the staff report f, 3 page 5 are merited in this instance and thereby are beinq imposed hereinafter as conditions of approval. VI. . In reference to the Valley Fire District recoi7miendation reqardinq sprinkler system, the applicant testified that a sprinkler system was not beinq installed. However, other buildinq safety features were beinq incoraorated into the desiqn to assure safety of the residents. The Zoninq Adjustor finds that compliance ajith the Uniform BuildinQ Code and Uniform Fire Codes are absolute. That it is the duty and responsibility of permit issuinq agencies to seek compliance with all codes. If sprinkler systenis are required by code, then compliance by the applicant will be necessary. Should alternative safety desiqn features acceptable to the permit issuinq agencies be incorpated in lieu of a sprinkler s.ystein, the condition requiring such system will be dismissed. VII. The property was zoned Agricultural-Suburban in 1955. Chapter 4.05 of the zoning ordinance identifies both residential and non-residential uses as permitt- ed uses. Non-residential uses which are permitted outriqht include churches, libraries, non-profit community halls and lodqes, schools, hospitals and sani- tarium (reference 4.05.060 and 4.05.065). Animal keepinq is permitted within the Agricultural-Suburban zone in accordance with the provisions specified in Section 4.05.080. Section 4.05.130 identifies those uses which may be permitt- ed in accordance with the provisions of Chapter 4.24 (Conditional Uses). In addition to retirement homes and nursing homes, community swimminq pools, narks, playgrounds, public utility facilities, public office buildinqs and qroup homes ai°e listed as conditional uses. VIII. The Zoninq Adjustor received testimony from the applicant's representative describinq the proposal in detail includinq the type and need for such care facilities. The objective of the applicant's proposal is to provide retire- ment homes as an alternative to the more costly nursing hones. The facility will be desiqned to provide separate apartn-ent type livinq quarters while makinq available to the residents the followinq: One meal ner day will be served; provide nursinq service (with emphasis on prevention and early detect- ion); recreational activities including gardenina; and many other programs de- siqned to qive its residents a sense of fulfillment. • ~ ' PAr,E 4 . • CUE-10-81 and VE-83-81 Ik. The 1981 Comprehensive Plan has desiqnated this area as Ur-ban. The pur- pose of the Urban Cateqory is to provide the opportunity for development ofa "city-like" environment which includes various land uses, intensive residential development and public facilities and services. The residential net densities should have an approximate density of 1 unit per acre to 17 units per acre. Multi-family structures will usually be a transitional use located between single famiiy residential and the iro re intensive areas. (See Section 1.00 Spokane County Comprehensive Plan). The proposal has a net density of 18 units per acre. However, because of the special characteristics associated with a retirement home, compliance with the Comprehensive Plan can be supoorted. Supportinq decision guidelines are Section 1.1.2 - bonus densities, Section l.l.b - direct or near direct access to a major arterial, Section l.l.c - desiqn consideration to insure protection of sinqle family area, Section 1.4.a - buffer- ing from adjacent land uses, and Section 1.6.1.a - conforiiiance to plans, policies and regulations. X. From on-site review, the following conditions are found: 1) The adjacent properties located to the West of the pro,ject site contain sinqle family residences. 2) A church and a multi purpose facility (under construction) is located to the East. 3) Area to the South contains school grounds with a sc{iool located at the Northwest corner of McDonald Road and 16th Avenue. 4) Area to the North across 12th Avenue contains single fan-jily residences and undeveloped lots. 5) The residences to the West of the project site are facinq Woodlawn Street and are oriented toward the fron t yard setback line of the lot. It is estimated that the distance between these homes and the proposed structure would be at least 100 feet. 6) With the required improvements for 12th Avenue, ingress and egre5s via 12th Avenue and McDonald Road, in the opinion of the Zoning Ad,justor would be adequate to accommodate the existing and anticipated traffic. XI. The applicant in his presentation cited Lilac Plaza Retirement Honie as an example of a retirement home in a residential area. Lilac Plaza is located at N. 7007 Wiscomb Street in North Spokane. The Zoning Adjustor reviewed the area and noted the following: 1) Lilac Plaza is a 13 storied retirement building. 2} The site is well landscaped and maintained. 3) Adjacent land uses consist of single family, duplexes, and multiple family dwelling units. These residential units are modern and well maintainetl. 4) This neiqhborhood gives the appearance of a stable residential neiqh- borhood. 5) Access to Lilac Plaza is by residential collector streets. XII. The applicant is also requesting relaxation of parkinq requirements. Section 4.17.060 (a) requires a total of 144 parking spaces based on 1 1/2 spaces per unit for multiple family residential development. The zoning ordin- ance does not specify parking requirements for retirement homes. However, Sec- tion 4.17.060 (,j) requires that nursing homes, etc., have one (1) space for each 1000 square feet of gross floor area. Because of the nature of the pro- posal, the applicant is requesting a variance to allow for 60 parking spaces. The apolicant indicated that such facilities need approxi►nately 1 space for each two or three apartment units. The aoplicant's proposal has 1 space for each 1.6 units. PAGE 5 • . ' , CUE-10-81 and VE-83-81 XIII. From review of the plot plan (Exhibit "B") it is noted however, that 70 parking spaces are shown. The Zoning Adjustor finds that the application and leqal notices requested variance relief for 60 spaces. With a ratio of 1 space for each 1.6 units, the Zoning Adjustor finds that this request is reason- able for retirement homes providing a degree of individual care to its residents. In addition, additional parking is available on the adjacent property occupied by Spokane Valley Baptist Church. XIV. The Zoning Adjustor received public testimony from citizens in support of the applicant's proposal. Testimony of support was received from Clarence Hart, Reverend Frank Brougher, William Sparkes, E. Bogue and Bob McLean. In addition several other persons were in attendance in support of the proposal and are so recorded in the public record. The testimony attested to the need for providinq low cost housinq and care to the elderly while providing a residential environ- ment. Further, testimony was given by a resident who resides near Lilac Plaza describing compatibility with the adjacent properties and notinq the quality of landscaping. Other conunents supported compatibility of the proposal with neighboring residents. XV . Testimony was received in opposition to the proposal. In addition, a petition and a letter of opposition was read into the record. Those testifyinq in opposition are Jim Hose, Steven Nelson, J. 0'Reilly, R.D. Sheppard and Everett Wenke. Concerns cited are: (1) incompatibility with neiqhborhood; (2) potential traffic conqestion; (3) parkina; (4) supervision of elderly; (5) noise; (6) sewage; (7) density; (8) landscaping; and (9) property devaluation. In response to these concerns, the Zoning Adjustor issues the following: (1) IncompatibilitY - It is the Zoning Adjustor's opinion that the pro- posal as submitted does afford campatibility for the followinq reasons: 1) the heiqht being limited to two stories and not exceeding 24 feet for the buildinq wings; (2) the nature of proposal (type of residential living offered); (3) greater setback distances than minimum required; (4) landscapinq (to be a condition of approval); (5) traffic orienta- tion; and, (6) as well as providinq a transitional use between the single family residence5 and the existing church complex. (2) Traffic Conqestion - From on-site review, the Zoninq Adjustor finds that the proposed access to 12th Avenue and connecting to McDonald Road does not pose a threat to the public safety. The applicant testified that average dail.y trips for this kind of facility would be approximately .12 "trip-ends" per resident per day. With the required road improvements including sidewalks and curbs as recommended by the Engineer's Office, adequate assurances have been provided to protect the public health, safety and general welfare. (3) Parkinq - The Zoninq Adjustor is satisfied that adequate oarking with supplemental parkinq available on the church property is being provid- ed. DUe to the design of the interior circulation, on-street parking effecting 6Joodlawn Street and 12th Avenue should not be a problem. (4) Supervision of the Elderly - The applicant described the leval of super- vision beinq provided on a 24 hour basis. Fl concern that residents may wander throughout the neighborhood should not be a problem. (5) Noise - Concern regarding potential noise are mitigated in the follow- ing rnanner: (1) that site developnent will eliminate noise qenerated from use of vacant property; (2) that traffic qenerated is directed away from residential neighborhoods; and (3) that the nature of the use as a retirement complex will create less noise and nuisance than those associated with single family uses if the property were to be developed residentially. (6) Sewaqe - The Zoning Adjustor finds that the permit issuinq agencies for sewage disposal submitted no adverse comments reqardinq this pro- posal. That in review of those coimnents, these agencies have the authority and responsibility to regulate sewage disposal in a manner , . PncE 6 . . ' CUE-10-31 and UE-83-81 that the public health is being protected. The applicant will be required to submit specific plan details for approval prior to the issuance of any buildin4 permits. (7) DensitY - As noted in Findinq IX, compliance with density standards specified by the Comprehensive Plan have been met. The nature of the proposal is such that the units will be occupied by one or two individ- uals at the most. (8) Landscapin - The degree of landscapinq being proposed by the applicant and the en~orcement authority of this action,sufficient landscapinq and screening can be assured. As a condition of approval, a landscapinq plan and required bonding will be imposed. The Planninq Deoartment will be charged with the responsibility for plan review and implementa- tion that is in keepinq with the intent of this action to afford a buffer between the retirement hon-e and adjacent properties. The Zoning Adjustor will direct the Planning Department personnel to require suffi- cient landscaping including berming to effectively screen the adjacent properties. (9) Pr9perty Devaluation - The Zoning Adjustor recognizes that it is difficuft to determine marketability of a qiven piece of property. What may be positive points to one individual may be different to that of another individual. It is the Zoning Adjustor's opinion that with conditions being imposed with this action, adjacent properties will not be injured. As noted in Finding VII regardinq permittecl uses within the Aaricultural Suburban Zone, the Zoning Adjustor further finds that the v)roposal should not depreciate the value of neighboring properties. A conditional use permit, in the opinion of the Zoning Adjustor cannot be denied unless the effect of the proposal is qreater than that of uses permitted in the same zone without a conditional use permit. Under the Aqricultural- Suburban zone classification such uses as churches, schools, community halls and lodqes,and animal keeping are permitted uses having a probable greater im- pact on surrounding properties than the applicant's proposal (refer to Sections 4.05.030, 4.05.060 and 4.05.080). XU I . Any Finding of Fact stated hereinabove which is deemed a Conclusion of Law stated hereinafter is hereby adopted as the same. CONCLUSIONS OF LAW 1. That the Zoning Adjustor for Saokane County has jurisdiction over the issuance of a building permit for the project to the applicant pursuant to the provisions of Chapter 36.70.010 RCW and Section 4.25.030 of the Spokane County Zoning Ordinance. II. The applicant submitted an application to the Planning Department request- ing a public hearing before the Zoning Adjustor, and that pursuant to Chapter 36.70.840 and Section 4.24.040 of the zoninq ordinance, notice of a public hear- ing was given through the United States mail to all property owners within a radius of 300 feet from the subject prooerty. III. That all citizens notified and agencies having ,iurisdiction were afforded the opportunity to testify or submit written comments on the proposed project. IV. As reported in Findinq No. II, the proposa]! more than meets the minimum standards required by the zoning ordinance and thereby, affordinq a qreater degree of protection to neighborinq properties. ~ PAr,E 7 ' _ . CUE-10-81 and VE-83-81 V. The Zoning Adjustor has concluded from Finding III that the heiqht of the structure is concert with the greater setback proposed will not obstruct or alter the skyline. That such height is compatible with other residences found in the immediate neighborhood which are single story, split entry design, and two-storied. That further, light, air, and solar access riqhts are not being prohibited with this action. VI. As noted in Finding VIII, the Zoning Adjustor finds merit in the applicant's attempt to provide alternative housing for the elderly that is reasoanble in cast as well as providing needed care and programs. The Zoninq Adjustor views this proposal as a community service to meet the special rieeds of the elderly. VII. It is further concluded that the applicant did make r-easonable efforts to hold community meetings to explain their proposal. The grantina of a continuation to allow such meetings was granted by the Zoning Adjustor on May 13, 1981. The anplicant testified that as a result of these meetings, the proposal was modified in order to mitigate some of the concerns exnressed by area residents. The Zoninn Adjustor is satisfied that the pror)osal as presented in Exhibits a and C adequately mitigates soine of the concerns. VIII. It is the Zoning Adjustor's conclusion that a conditional use permit for which the applicant is requesting is in keeping with the character of the neigh- borhood and of the Agricultural Suburban zone. The nature of the conditional use permit process and the authority conferred allows for flexibility and the imposition of special guidelines considered essential and desirable to mitigate any adverse effect upon the neiqhborhood properties ti•rhile upholdin4 the spirit and intent of the zoniii(i oi-dinance. IX. It is further concluded that since the zoning ordinance authoi°izes such uses upon the finding that it will not be detrimental to the adopted comprehen- sive plan and surrounding properties and where the applicant can meet all the prescribed conditions, this permit cannot be denied. Furthermore, there were no sound reasons found for denying the request. That all concerns can be effectively mitiqated thr°ough the attachment and enforcement of conditions. CONDITIONS OF APPROVAL A) COUNTY PLANNING DEPARTMENT l. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permi ts. 2. A specific landscape plan, planting schedule and provisions for main- tenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant shall develop subject property in accordance within the concept presented to the Zoning Adjustor. Minoi° variations when approv- ed by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and qeneral allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 4. Direct light from any exterior area lightinq fixture shall not extend over the property boundary. . , . . . PAGE 8 ' . CUE-10-81 and VE-83-81 5) All current standards of the /lgricultural-Suburban zone and Section 4.24.040, as amended shall be complJed with in the development of the site. 6) Landscaping shall be provided for this site, in conformance with Stand- ards as identified in Section 4.07A.120 Landscaping. 7) A 6-foot sight-obscuring barrier shall be provided along the west pro- perty line of this proposal to provide a buffer for the existing single family use located immediately west of this site. Such barrier shall consist of live plantings and berming. 8) Applicant shall comply with '208' recommendations concerning storniwater runoff and provide necessary landscaping for runoff. 9) Applicant shall comply with all agency's regulations as amended prior to the issuance of building permits. 10) That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43. 21C.080 RCW and the Board of Spokane County Commissioners Resolution '77-1392 be initiated by the project applicant within thirty (30) days of fina'l disposition of this application, and prior to any on-site improvements. 11) Structures shall be constructed of materials similar to residential structures in the immediate vicinity. B) COUNTY ENGINEERING DEPARTMENT 1) Applicant shall dedicate 5 feet along 12th Avenue for right of way pur- poses alonq with a 20 foot radius at the corner of 12th Avenue and McDonald Road. 2) Applicant shall construct cenient concrete curb, sidewalk and pave to existing pavement along 12th Avenue from the west property line to McDonald Road. 3) Applicant shall vacate Mor-row Road and 14th Avenue or improve tivith cement concrete curb, sidewalk and paving. 4) Applicant shall submit for approval by the Spokane County Enqineering the road, drainage and access plans prior to the issuance of a buildinq permit on the property. C) COUNTY UTILITIES DEPARTMENT 1} Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulation5 of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2) The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to RCW, Chapter 36.94, as amended. The owner, his heirs and successors shall further aqree not to oppose or protest any legal assessments for any utility local improvement dist- rict (ULID) established pursuant to RCW Chapter 36.94, as arnended. 3) Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County. 4) The project shall be double plumbed for connection to future area-wide collection systems. , . That the proposed site plan iTidicates that setbacks, parking, height of the structure(s) will conform to the Spokane Cou►ity Zoning Ordinance. 10.
