After conducti n~ a publ i c hearinQ to recei ve al 1 publ i c testimonv and after reviev~- ing~ the public record, examininq available information, and visitinq the oro~ert,y and s~arrounding area, the Zoning Adjustor in accordance with Chapter 36.70.810 Revised Code of G~ashinqton, and Section ~.25.~30 of the county zoninq ordinance hereby makes the followinq Findings of Fact and Conclusions of Law herei nbel oU~ stated. ~ The apnlicant, Albert i~aahs, filed an ara~lication on March 9, 1981 re- questina a variance ap~roval fo~^ rel~xation of frontaqe rec~uirement in order to construct a sinqle fami~y residence on a parcel of land 3.89 acres in si ze. The sub ject property i s 1 ocated on Broa~dway Aven ue i n Secti on 14, Townshin 25, Ran~e 44. ' . . Thi s matter was heard before the Zon~n~ Ad~ustor on Ar~r~ 1 8, 1981. After receivinq public testimony and acceptinq the file from the Clerk to the Zonina Adjustor, the Zoninc~ Adjustor placed this matter under advise- ment for review and decision. FINDINrS OF FACT I. Each d~velling unit shall be double plumbed for connection to future area-wide collections systems. Pursuant to the Board of County Commissioners ~es. #~0-0418, the use of on-site sewer disposal systems is authorized. The owner, his heirs and successors shall ,join and parti ci ~ate in any peti tion or resol uti on 4vhi ch purpose i s the fo~~- mati on of a uti 1 it~ improvement di stri~ct. The owner, hi s hei rs and successors shall further aqree not to r~rotes.t or op~ose any lec~al assessments for any utility imnrovement district esta~lished.. DEPARTMENT OF BUILDIN~ ANO SAFETY: It is noted that all future buildinqs and structures require permits as per Section 301 U.B.C. It i s noted that the fi 1 e contains a Certi fi cate of <~Ja~Cer Suppl y Uti 1 i ty Servi ce dated March 9, 1981 from the Uti 1 i ti es Denartment approvi ng the method of water suppl~. III. The site is zoned Aqricultural which permits one sinqle family residence on a parcel of ~and 12,500 square feet in size and havinq at least 100 feet of pub1ic road frontaae. The aaplicant's lot has 75 feet of roa d frontaqe on Broadway A°venue. IV. The opportunity was afforded at the hearing to any interested person to testi fy or submi t wri tten cor~~ments regardi nc~ thi s appl i cati on. ~~!o one appear- ~ ed nor any written comments were received in oprosition. U. ~ From review of the file the Zoning Adjustor found that the applicant's proaert,y size indicated on the ap~lication form was 3.89 acres in size. The ~ parcel bei nq seareqated for bui 1 di nq purposes contai ns 11,1 ~38 square feet which is not in compliance with the minimum lot requirement of 12,500 square feet for the aqricultural zone. UI. It is found that neither the subject property nor the vicinity is being used for agricultural activities. Development has been basically urb~n resident- ial on lots less than 1/2 acre in size: ' UII.  Any Conclusion of Law stated hereinbelow which is deemed a Finding of Fact i s hereby adopted as the same. From these Fi ndi ngs of Fact, the Zoni nq Adjustor enters these : CONCLUSIONS OF LAW I . That the Zoning Adtiustor of Spokane County has jurisdiction over the i ssuance of the bui 1 di nq permi t for the project to the appl i cant pursuant to Chapter 36.70.810 RCW and Secti on 4. 25.030 of the Spokane County Zoni ng Ordi n- ance. That the applicant submitted an apnlication to the Planning Department requesting a publ ic hearing before the Zoninq Adjustor, and that pursuant to Chapter 36.70.840 and Section 4.25.040 of the Zoning Ordinance, notice for a ~ aubl i c hearing ~~as gi ven throuqh the Uni ted States i~~ai 1 to al 1 prooerty owners wi thin a radi us of 300 feet from the sub,ject property. l~ I I . That all citizens notified Und agencies havin~ jurisdiction were afford- ed the opportunity to testify or submit written comments on the pro~osed ~ ro,j e c t . ' . IU. That in review of the assessor's maps for this Qeneral vicinity it is . found that there are othe r divisions of land both smal1e r and larqe r which do not have the required road frontage on a public maintained road as specified by the zoning ordinance. Therefore, this action does not constitute the arant- . ing of a soecial ~rivilege inconsistent ~rith the limitations nlaced upon other properti es in the vi cini ty and under the same ~zone cl assi fi cati on as ci ted i n Chapter 36. 70.810 RCGJ, an.d i f denied, the appl i cant woul d be depri ved of a minumum and basic right to construct a single family residence on a oarcel of land which h~s been found to be sufficient in size to support such a use. U. The Zoning Adjustor found that the proposed use on a parcel consi stinq of 11,188 squarP feet of lot area and havinq 75 feet of frontage on a aublic road i s a reasonabl e request for rel axati on of the zon i nq ordi nance. That fu~rthermore, thi s acti on conforms to the intent of the zoning o rdinance an d general con~prehensive nlan adopted for Spokane County. That the Planninq Department acknowledaed that an Indemnity Agreement will be honored by Spokane County. VII. ~ The Zoni nq Adj ustor found that the sub ject lot does not meet th.e mi nir~um lot area for the agri cul tural zone, however, from revi e~r of the assessor` s maps and from ~ite in~pectic~n, it is found that there are other properties in the immediate vicinity which are substandard in area andsmaller than the ap~li- cant's lot. Therefore, the lot size is compatible and consistent with aas~ actions. Further by approvinq this application, development of the property can occurr which would be an act to encouraqe "fill-in" develcpment to allow for a more viable uti 1 i ty improvement di stri ct shoul d such a program be ini ti at- ed to provide central sewera~e this this area. VIII. The Zoni ng i~dj ~;stor has concl uded that even ~haugh the a~pl i cati on di d not request a vari ance for rel axati on of 1 ot area and the noti ce of;~heari nq ~ di d not speci fi cal ly i den~ti fy same, the matter was 1 eqal ly adverti sed qi vi nq  the Zoninq Adjustor the authorit,y to grant a variance fo r lot area. The Zoning Adj ustor i n s upport of thi s acti on acknowl edqes that the 1 ega 1pub 1 i c noti ces cited Section 4.04.040 of the Zoninq Ordinance which is the aroaer citation for relaxation of botili lot area and frontage requirement. IX. Any Conclusion of Law which is deemed a Findinq of Fact is hereby adopted as the same.
