TH IS MATTER, Being the cansideration by the Board of Adjustrnent
for Spokane County, is an appeal of an adminystrative action by the Spokane
County ZonFng Adr-ninistrator of an ~nterpretation, file # AI-1-82 far the
purpose of allotnring farge farm animals ❑n a parcel of land 1/2 acre in size,
hereinafter referred 'C❑ as the "Proposad", ane# 'the Board of Adjustment of
Spokane County having he€d a pubiic hearing an February 1, 1982, and
having futly considered ail testimany presented thereat, and havEng rendered
a decisian on the lst day of February, 1982, approving said proposal, does
hereby rnake the following:

1, That the praposal is generally located nor~th of 8roadway-
Avenue and £ast of Vercler Road. 2, That the prflpasal consists of a use to aflQw Iarge farrn animals
vn a parcel of Iand 1/2 acre in size that is zoned AgrEcul'tural-Suburban.
3. Tha-t the Generalized Camprehensive Plarr for Spokane Caunty
indicates Urtaan Designation for the area encompassed by this praposal.
4. That on January 5, 1982, an- appeat from the decision of the
Zoning Adrnrnistrator of Spflkane County was filed by John Tenold, representing
IVlichal and Linda Sumner. .
5. That the existing land uses in the area of proposaE include
sirtgle family resiclences.
6. That the proQosal is campatible with existing uses in the
area.
7. Tha-t the propasai is no-t detrimen'tal or okherw`se harrnFul to
the public health, safety and welfare.
8. That the proposai is nat tQtally ineansistent with the surr~ounding
land use classkfications and does not grant a5pecial pravilege or righ-ts to
the applicant different than those enjayeri by adjacent property owners,
9. That the proper legal requirernents for advertising of the
hearing befor-e the Spokane County Board of Adjustment have been met.

10. That the property does not have non-conforming status,
however, because of testimony presented at the hearing it is evident that
the County's procedures were vague.
11. That the keeping of large farm animals is presently occurring
in the general vicinity. .
From the foregoing Findings and the Staff presentation of File No.
AI-1-82, the Board of Adjustment of Spokane County hereby in approving
the proposal does make the following conditions:
1. That fihe present owners, Michael and Linda Sumner, be allowed to
have up to three (3) large farm animals on the property (Parcel #
15542-1212), for the duration of their ownership. The subsequent
owners of the property would not be allowed this use.

The narcel under Board of Ad.i ustment revi ew vias seqreaated i n 1962 i nto i ts
present aDproximatel_y 112 acre size. The propert,y has been zoned Aqricultural-
Suburban since 1955. In 1962 the Aqricultural-Suburban zone rea,uired a minimum
of 1 acre per qarcel or tract for the maintenance of larqe farm animals, i.e.
cows, horses and niqs. It was the Zoninq Administrators interpretation that the
sub,ject parcel must meet the 1962 provisions of the Aqricultural-Suburban zone
and that larqe farm animals were not permitted on this 1/2 acre narcel. The
apolicant contends that large farm animals have been maintained on this and
adjacent properties for 30-40 years and that nori-conforminq, use status aqpl ies
to the subject aroperty.
