VE-38-83 ZONING ADJUSTOR ~ ~ D SPOKANE COUNTY, wASHINGTON VOZANt cOuMit cn("N4" IN THE MATTER OF VE-38-83 - TAYLOR ) FINDINr,S OF FACT, DECIAaIR2 01983 RELAXATION OF FRDNT YARD SETBACK REQUIREMENT) AND CONDITIONS ' THIS MATTER, Being the consideration by the Zoninq Adjustor of Spokane County, approvinq the application (VE-38-83), for the prupose of allowinq a qaraqe to extend into the required front yard, hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a public hearing on April 12, 1983, and having fully considered all testimony presented thereat, and further havinq visited the site and vicinity in question, and having rendered a decision on the 20th day of April, 1983, approving said proposal, does here- by make the following: FINDINCS OF FACT 1. That the proposal is generally located on the northeast corner of Wellesley Avenue and Bannen Road in Section 35-26-44. Parcel # 35643-0909. 2. That the proposal consists of an addition to establish a two car garage which will be located no closer than 36 feet from the centerline of Bannen Road. 3. That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates Urban usage of the area encompassed by the Proposal. 4. That the site is zoned Agricultural. 5. That the existing land uses in the area of proposal include vacant land to the west, to the south and east are single family residences and to the north is an open yard and single family residence. 6. That the purpose of the variance is to convert a single car qarage to standard two car garage. 7. That there are no residences in the ininediate area which would have their view blocked nor would traffic vision be a problem as the addition is not located directly at the corner of Wellesley and Bannen Road. 8. That no comments, oral or in writina have been received in opposition to this proposal. 9. That the requested use is consistent with other uses in the vicinity and dces not confer a special privilege to the applicant. 10. That the proposal otherwise meets all current standards of the Spokane County Zoning Ordinance for this use. 11. That the proper legal requirements for advertisinq of the hearing be- fore the Zoning Adjustor of Spokane County have been met. CONCLUSIONS 1. That the proposal is compatible with existing uses in the area. 2. That the proposal is not detrimental or otherwise harmful to the public health, safety and welfare. DECISION From the foreqoing Findiiigs, a review of the Planning Department File No. VE-38-83, testimony at the public hearing, and a site visit, the Zoning Adiustor hereby in approving the proposal makes the following conditions: A.
