This matter beinq the consideration by the Zoning Adjustor for Spokane
County and pursuant to Chapter 4.25, Section 4.25.010, the Zoning Ad,justor has
the authority to hear and decide such matters cominq before him. After con-
ductinc7 a public hearinq ta receive all public testimony and after reviewinq
the public record, examining available information, and visitinq the oroperty
and surroundinq area, the Zoning Adjustor in accordance with Chapter 36.70.810
Revised Code of Washinqton, and Section 4.25.030 of the County Zoninq Ordinance,

1.
That the Zoning Adjustor of Spokane County has jur°isdiction over the
issuance of a building permit for the pro.ject to the aprlicant pursuant to the
nrovisions of Chapter 36.70.810 RCW and Section 4.25.030 of the Spnkane County
Zoninq Ordinance.
II.
That the applicant submitted an application to the Planninq Oepartment
requestinq a public hearinq before the Zoning Adjustor, and that pursuant to
Chapter 36.70.340 and Section 4.25.040 of the Zoninq Ordinance, notice for a
public heariny alas given throuqh tl7e Ilnited States mail to all property owners
within a radius of 300 feet froni the sub,ject property.
III.
That all citizens and puhlic aqencies havinq jurisdiction notified were
affor°ded the opportunity to testify or subniit written comments on the proposed
project.

That pursuant to the abave cited provisions of law, Findinqs of Fact here-
` inheloar substantiates approval of the application and issuance of a buildinq
perini t for the pro.ject.

FINDIP1GS OF FACT
1.
Tilat the applicant filed an applicatiori with the Spokane County Planninq
Department on October 6, 1980 in conjunction with a niobile home as a residence
for a dependent relative. A letter from a licensed physician dated Qctober 8,
1980 verified that a inedical problem exist vjith the applicant's parents which
requires necessary assistance from family members.
II.
That this action was taken after findinq that the public health, safety,
and gene►•al welfare will not be infringed upon. That furthermore, this action
conforms to the intent of the Zoninq Ordinance and general coniprehensive plan
adopted by Spokane Coimty. Approval was qranted at the heai°inq after findinq
that the appl icant can coniply wi th al l of i:fie condi tions requi red in Section
4.24.560.
III.
That all rnatters before the Zoninq Atljustor are revieti•,ed by aqencies of

SPOKANE COUNTY ENRINEER'S OFFICE: In a niemo dated November 7, 1980 the
Lngineer's Office has requested as a condition of approval that the applicant
5hall agree to participate in any future Road Improvenient Pro.jects and to dedi-
cate the south ten (10) feet of the advertizetl propert.y for road purposes. In
keepinq ►iith tiie Zoning Ad,justor's policy to not require road improvements for
teniporary use permits unless it is denionstratod that the improvements are ne-
cessary to protect the public health, safety k-::id qeneral welfare, this action
i s bei nq taken wi thout the requi ri nq of i°oad i mprovernents . flo addi ti onal i n-
formation was presented reqardincj this recoininendation.
SPOk:AfdE COUNTY UTILITIES DEPARTMEfdT: In a niemo dated November 11, 1980 the
Department indicated that water service shall be cooi°dinated with Consolidated
Irriqation District in accor~iance ti•jith the Coordinated Water Systern Plan foi°
Spokane County.
SPOK/aNE COUNTY HEALTFI DISTRICT: The Health District had no comments reqardina
this proposal.
SPOKANE COUNTY PLAPdNINr, DEPARTMFfdT: In the staff presentation at the hearinq,
it was reported that the file is in order and the applicant can comply viith
, the conditional standards as stated in Section 4.24.560 of the zoninq ordinance.
IV.
~ The Zoninq Adjustor foun(i that the praposed residence for a dependent re-
lative i•lill not be in conflict with ad.jacent laiid uses nor be detriinental to
the qeneral comprehensive plan - 1968. Nar vrill this action involve the erection
of a substantial structure. The site is zoned aqricultural which is a classifi-
cation suitable for farmina and aqricultural pursuits. Therefore this action
would have the least impact on adjacent proper•ties.
V.
That this action and suPported by the above noted findinqs will not be
materiall_y detrimental to the public welfare or in,iurious to adjacent properties
and iniprovements.
VI.
The opportunity afas afforded at the hearign to any interested person to
testify regarding the applicant's proposal. Plo one aj~peared nor any written
cornments were received in opposition.

CON[)ITIOPdS OF APFROVAL
1.
The permit may he renewed administratively by the Director of Planninq
upon recertification by a licensed physician that a medical problem still
requires care. The r°enetval period shall be every year frorii the date of the
original permit.
II.
The mobile home shall be as defined in Chapter- 4.03.
III.
Upon termination of the need foi- care or the sale or lease of the property
the applicant shall r-einove the mobile honie froin the site within forty-five (45)
days.
iv.
A statement shall be attached to the deed and recorded in the County
Auditor's Office statinq that the mobile hoiue is temporary and for the use of
the dependent relative for which the Conditional U5e Perinit is anproved and
not considered a permanent structui-e to be transferred with the property if
sold or leased.
V.
The placenient of the mobile hoine shall be in compliance with all plat
dedications.

The mobility qear shall not be perinanently affixed to the land, except for
temporar,y connections to utilii.ies.
VII.
Only one temporary resirience inay he perini tted on a lot, parcel, or tract
of land under the ot•lnership or lease by the ar,;icant for the Conditional IJse
Permit.
VIII.
