BUDINGER& ASSOCIATES, INC.

For good and valuable consideration, the legal sufficiency of which is hereby acknowledged,
City and the Consultant mutually agree as follows:
I. Purpose:
This Amendment is for the Contract for geotechnical exploration and analysis for the 8th Ave
Reconstruction project by and between the Parties, executed by the Parties on February 6, 2014,
and which terminates on December 31, 2014. Total compensation under the Original Contract is
not to exceed $12,314.50. Said contract shall be referred to as the "Original Contract" and its
terms are hereby incorporated by reference.
2. Original Contract Provisions:
The Parties agree to continue to abide by those terms and conditions of the Original Contract,
dated February 6, 2014, and any amendments thereto, which are not specifically modified by this
Amendment.
3. Amendment Provisions:
This Amendment is subject to the following amended provisions, which are either: ❑ as
follows, or® attached hereto as Appendix "A". All such amendment provisions are hereby
incorporated by reference herein and shall control over any conflicting provisions of the Original
Contract, including any previous amendments thereto.
4. Compensation Amendment History:
This is Amendment#1 of the Original Contract and the history of amendments to the
Consultant's compensation is as follows:

APPENDIX"A"
1. Paragraph 3 (Compensation) of the Original Contract is hereby amended to increase
the total compensation paid by $6,016.38. Paragraph 3 of the Original Contract is
amended to read as follows:
"3. The City agrees to pay up to $18,330.88 as full compensation for everything
furnished and done under this contract, in accordance with the provisions outlined in the
scope of work,as previously and/or presently amended."
2. The Scope of Work, (Exhibit 1) of the Original Contract, is hereby amended to include
the following tasks and/or services additions:
a. Consultant will perform materials testing services including:
i. Earthwork testing and observations associated with installation of
stormwater structures and construction of cement treated base,
including provision of a technician for density testing and sampling
and providing associated results of tests.
ii. Asphalt pavement testing, including density tests on asphalt placed,
obtaining samples for laboratory testing and providing associated
results of tests.
iii. See attached proposal dated July 22, 2014.

The one page(s) entitled “Cost Estimate – Subconsultant Fee Determination Summary Sheet”
contain(s) confidential cost and rate data and is(are) withheld from public disclosure pursuant
to 23 USC 112(2)(E).
Prenotification; confidentiality of data. A recipient of funds requesting or using the cost
and rate data shall notify any affected firm before such request or use. Such data shall be
confidential and shall not be accessible or provided, in whole or in part, to another firm or to any
government agency which is not part of the group of agencies sharing cost data under this
paragraph, except by written permission of the audited firm. If prohibited by law, such cost and
rate data shall not be disclosed under any circumstances.
You may petition for a review of our findings pertaining to any redacted or withheld documents
pursuant to Spokane Valley Municipal Code (SVMC) 2.75.080; and obtain judicial review
pursuant to RCW 42.56.550.
