RE: 1501 S. Bettman Road — Grading / Floodplain Development
The recent grading of your site — to include the placement of fill within a designated floodplain
(see enclosed photo) — was conducted without permits and approvals required by both the
Spokane Valley Municipal Code (SVMC) and the National Flood Insurance Program (NFIP). A
stop work order was posted on August 14, 2008 to provide notice to the owner.
Since that time, your contractor has indicated that the placed fill may either be completed or
removed. Either option requires that "A development permit shall be obtained before
construction or development begins within any area of special flood hazard ..." and that "The
permit shall be for ... all development including fill ... defined in Appendix A" per SVMC
21.30.070 A. The requirements for making application for a floodplain development permit are
stated in SVMC 21.30.070 B.

I have enclosed both a grading permit application and a floodplain development permit
application which both need to be completed and submitted to the City of Spokane Valley
Permit Center no later than September 29, 2008. If we do not receive the completed
application(s) by this date, the City will be compelled to initiate a code compliance action against
the above referenced property in conformance with SVMC 17.100.

As we have discussed, the fill deposited in the floodplain (see enclosed photo) was placed without required
permits and approvals. A stop work order was posted on (DATE). Since that time, you have indicated that the fill
will be removed. However, as we have also discussed, such activity still requires permits. The requirement for
permits is part of the Spokane Valley Municipal Code (SVMC) and the Federal Flood Insurance Program. If you
would like to review the applicable portions of the municipal code they can be found in SVMC 24.50.020 and
21.30.070.
