HOLD HARMLESS AGREEMENT
THIS AGREEMENT, made and entered into this 2/ day of
, 1990, by and between SPOKANE COUNTY, a political
subdivion of the State of Washington, having offices for the
transaction of business at West 1116 Broadway Avenue, Spokane,
Washington, 99260, hereinafter referred to as the "County", and
ROY H. NYHOLM and MARIE E. NYHOLM, husband and wife, WESLEY B.
ANDERSON and. ALICE M. ANDERSON, husband and wife, and HAROLD G.
ANDERSON, JR., individually, hereinafter referred to jointly and
inc '_v_; Iually as the "Owners", jointly referred to, along •.:Ith t .e
County, as the "Parties".
WITNESSETH:
WHEREAS, the plat of Evergreen Point Fifth Addition, PE -14-
69-84, has not yet been approved, and the provisions of Chapter
58.17 RCW have not yet been complied with in regard to the plat;
and
WHEREAS, the Owners have requested a building permit for
footings and foundation only for a single-family residence on Lot
4, Block 16, of Evergreen Point Fifth Addition; and
WHEREAS, the Spokane County Planning Department has advised
the Board of County Commissioners that pursuant to RCW Section
58.17.210, the public interest will not be adversely affected by
the issuance of the building permit;
NOW, THEREFORE, the Parties hereto do mutually agree as
follows:
Section 1: Prior to finalization of PE -14-69-84, the
Spokane County Department of Building, upon proper application and
subject to approval by all County reviewing departments and state
agencies with jurisdiction, will issue a building permit for
footings and foundation only, for a residence on Lot 4, Block 6,
of Evergreen Point Fifth Addition.
Section 2: The Owners agree that they, their successors and
assigns, at all times, shall indemnify and save harmless the
County, its successors and assigns, against any and all claims,
suits, actions, debts, damages, costs, charges and expenses,,
including court costs and attorneys fees, and against all
liability, losses and damages of any nature whatsoever that the
County shall or may at any time sustain or be put to, by reason of
issuing the building permit set forth above prior to finalization
of PE -14-69-84 pursuant to Chapter 58.17 RCW and County proce-
dures.
Section 3: The Owners waive all claims against the County,
and shall not bring any action, legal or equitable, against the
County arising out of the issuance of the building permit set
forth above, or in the event PE -14-69-84 is not approved for any
reason whatsoever. Execution of this document by the County shall
not in any manner whatsoever be construed as a representation that
PE -14-69-84 will be approved. In the event PE -14-69-84 is not
approved for any reason whatsoever, the Owners agree to remove, at
their sole expense, the footings and foundations constructed
pursuant to the building permit set forth heL.ein.
Section 4: The Owners agree that, at the option of the
County, Owners shall defend, at their sole expense, any claims
brought against Spokane County with respect to the subject of this
Agreement, whether such claim or action is rightfully or wrongful-
ly brought or filed.

Section 5: The Owners acknowledge that they have been
advised to contact legal counsel prior to executing this Agree-
ment, and they are fully informed of their legal obligations
arising herein.
IN WITNESS WHEREOF, this Agreement has been executed on the
day and year first set forth above.
