This letter is in response to your letter of May 15, 1981 to the Spokane
County Commissioners regarding the mobile home moved in at the Mary
Uptagrafft residence at East 12005 Boone.
Current regulations would make it difficult to install two residences on
one parcel of land, and approval from the Spokane County Planning Department
would be required. The Uptagraffts', however, were issued a building permit
in 1956 allowing them to place a mobile home on their property. This
entitled them to what is known as nonconforming rights. The new mobile home
is merely replacing the previously existing mobile home, and the necessary
building permits have been issued.

This letter is in regards to the mobile home recently installed on your
property under building permit number 81A-2136.
Generally, the Spokane County Zoning Ordinance allows for only one single
family dwelling to be located on a single parcel of land in an Agricultural
Suburban Zone, in which your property is located. However, permit number
81A-2136 was released based on the fact that the new mobile home was re-
placing an existing mobile home for which a permit had been legally issued
in 1956, thus giving the new mobile home non -conforming rights.
Section 4.18.010 of the Spokane County Zoning Ordinance stipulates that,
"...if such non -conforming use is abondoned for a period of one (1) year,
or more, any further use of such lands or premises shall be in conformity
with the provisions of this Title."
This office has received reports alledging that the existing mobile home
had been removed from the property several years ago. If this is the case,
the new mobile home would not have non -conforming rights and permit number
81A-2136 would be null and void, thus requiring removal of the mobile home.
Since the non -conforming right status of the original mobile home has been
brought into question, you will need to confirm the non -conforming status.
Please submit the information indicated on the enclosed bulletin to this
office as soon. as possible in order that this matter might be resolved.

Uptagrafft, who has assured us that the mobile home is vacant and is for
sale. A classified ad has been placed with the Spokane Valley Herald ad-
vertising this mobile home.
We appreciate your concern in this matter, and will continue to monitor
the situation to make sure that the trailer is sold and/or removed within
a reasonable length of time. Failure to do so will necessitate this office

Dear Mrs. Uptagrafft:
This letter is in regards to the pending sale and removal of the mobile
home currently located on your property.
As you are aware, the mobile home does not have nonconforming rights as
a guest house, nor is it a permitted use under the Spokane County Zoning
Ordinance to have more than one residence located on a single parcel of
land, thus requiring removal of the mobile home.
We appreciate the fact that you are trying to sell this mobile home, how-
ever, the time frame for removal from your property, thus bringing the
property into compliance with ordinance requirements, cannot be left open-
ended.
Therefore, we are of the opinion that a period of 60 days, beginning with
your receipt of this letter, should be sufficient time for you to continue,
and hopefully conclude, your efforts to sell this mobile home. At the end
of this 60 day time period, if the mobile home has not been removed, we
will review this matter to determine if an extension of time is warranted.

since I have not heard from you about this ,ishall say that 1 am
expecting that the possible buyer, Ers. Uotgrafft or the
county sh11 have this mobile home removed from this property by
July 20, 1982.
In your letter of Sept. 23, 1981 you stated that you would give
Ers. tiptagrafft a reasonable length of time to sell or remove
the home. I believe that more than enough time has gone by, 9
months now and by July 26th I0months have gone by. you also said
that you loight have to turn this over to the prosecuting attorney.
