ROBERDS FOR A VARIANCE FROM ) FINDINGS OF FACT, SECTION 4.05.040 SPOKANE COUNTY ) CONCLUSION OF LAW ZONING ORDINANCE FOR RELAXATION ) AND DECISION OF FRONTAGE REQUIREMENT ) FILE NUMBER: (VE) VN -84-80 DECISION: APPROVE DATE OF ORDER: June 20, 1980 This matter being the consideration by the Zoning Adjustor of Spokane County of a variance application in conjunction with a proposed single family residence and pursuant to Chapter 4.25, Section 4.25.010 granting the Zoning Adjustor the authority to hear and decide such matters coming before him, and after conducting a public hearing on June 4, 1980 to receive all public testi- mony and after reviewing the public record, examining available information, and visiting the property and surrounding area, the Zoning Adjustor in accordance with Chapter 36.70.810 (2) Revised Code of Washington, and Section 4.25.030 (b) of the Spokane County Zoning Ordinance, hereby makes the following: FINDINGS OF FACT That Gail M. Roberds, hereinafter referred to as the "applicant" filed an application on April 23, 1980 with the Spokane County Planning Department for a variance in order to obtain a building permit for a single family residence to be constructed on a site consisting of 3/4 of an acre having frontage on a county road but not maintained, located east of Spokane legally described as follows: Section 16, Township 25, Range 44 EWM The W 1/2 of the W 1/2 of the N 1/2 of Blk 45, except the N 130 ft. of the E 67.5 ft. II. That the access which is by Desmet Avenue is a county road but not maintain- ed has been found to be physically accessible to provide adequate vehicular access to the subject property. The applicant may be required to post no park- ing signs to prevent residents of an adjacent apartment building from parking within the right-of-way of Desmet Avenue and Robie Road. III. That the subject property is found to be a tax segregation within Block 45 of the Plat of Opportunity and thereby is not a replat of said plat as provided by Chapter 58.17 Revised Code of Washington (RCW). However, when it can be demonstrated that the public interest will not be adversely affected, a building permit may be issued upon the execution of an Indemnity Agreement by the Planning Department (refer to 58.17 RCW). This file contains a memo from the Planning Department that the proposed division of land7has been examined and found to be in compliance and that a building permit maybe issued. This variance approval will be conditional to the execution of an Indemnity Agreement. IV. That in review of the assessor's maps for Section 16, Township 25, Range 44 it is found that there are other divisions both smaller and larger in size which do not have frontage on a county maintained road as required by Section 4.05.040 of the Zoning Ordinance for the Agricultural Suburban zone classification. The applicant's property does have 100 feet of frontage along said unmaintained road. .(VE) VN -84-80 Therefore, the granting of the variance does not constitute the granting of a specal privilege inconsistent with the classification as cited in Chapter 36.70.810 (2) RCW, and if denied, the applicant would be deprived of a minimum and basic right to construct a single family residence on a parcel of land which is found to be sufficient in size to support such a use. That the project lies over the Spokane Aquifer and within the Critical Water Supply Service Area #3. That the subject property will be supplied domestic water by Modern Electric Company. This project is also within the "201" Sewer Study Area Zone No. 3 and within the Primary Sanitary Sewer Area recommended in the "208" Study. On-site sewage disposal may be author- ized. A memo dated May 27, 1980 from the Health District and made part of the file had recommened to the Zoning Adjustor that approval of the applicant's project be subject to the issuance of a permit by the Health Officer. Spokane County Health District has jurisdiction over the installation of an on-site sewage system. The Spokane County Utilities Department and the Spokane County Engineer's Office found that this proposal would be consistent with their re- quirements if incorporated into thisction. That the county has no responsi- bility for maintaining this.road until it is built to county standards and accepted. VI.. That this action and supported by the above noted findings will not be materially detrimental to the public welfare or injurious to adjacent properties and improvements. VII. Any Conclusion of Law hereinafter stated which is deemed a Finding of Fact herewith is adopted as the same. From these Findings, the Zoning Adjustor comes to these: CONCLUSIONS OF LAW That the Zoning Adjustor of Spokane County has jurisdiction over the issuance of the building permit for the project to the applicant pursuant to the provisions of Chapter 36.70.810 (2a) and (2b) RCW and Section 4.25.030 (bl) and (b2) of the Spokane County Zoning Ordinance. II. That the applicant submitted an application to the Planning Department requesting a public hearing before the Zoning Adjustor, and that pursuant to Chapter 36.70.840 and Section 4.25.040 of the Zoning Ordinance, notice for a public hearing was given through the United States mail to all property owners within a radius of 300 feet from the subject property. That all citizens and public agencies having jurisdiction notified were afforded the opportunity to testify or submit written comments on the proposed project. IV. That pursuant to the above cited provision of law, Findings of Fact herein- above substantiates approval of the application and issuance of a building permit for the project. (VE) VN -84-80 V. Any Finding of Fact hereinabove stated which is deemed to be a conclusion of law is adopted as the same. From the Findings of Fact and Conclusions of Law the Zoning Adjustor hereby enters this: DECISION TO APPROVE WITH CONDITIONS THE APPLICANT'S REQUEST FOR A VARIANCE FROM THE PROVISIONS OF THE SPOKANE COUNTY ZONING, ORDINANCE WHICH WILL ALLOW A BUILDING PERMIT TO BE ISSUED ON A PARCEL OF LAND NOT HAVING FRONTAGE ON A COUNTY MAINTAINED ROAD. Conditions of Approval: That an on-site sewage disposal system shall be approved by the County Health Officer.• II. That the proposed project shall be in substantial conformance to the plot plan on file with this application, and shall observe all setback re- quirements as prescribed by the,Spokane County Zoning Ordinance. That the subject property shall not be further subdivided unless said division is in compliance with Chapter 58.17 RCW and applicable County Ordinance governing such divisions. IV. Prior to the issuance of a building permit, the applicant shall complete the following requirements: 1) Applicant shall dedicate the south 25 feet of the advertised property for roadway purposes. 2) Applicant shall agree to participate in any future RID involving said property. 3) Applicant shall an Indemnity Agreement from the Spokane County Planning Department.
