MANSON, DIRECTOR CERTIFIED -RETURN RECEIPT REQUESTED It has been some time now since we last contacted you regarding the; un- licensed/inoperable vehicles being stored on your property, located'at N. 2623 Bowdish, Spokane County, parcel number 09542-0838. In telephone conversations with this office in June, 1981, it w son71 dicated that the property would be brought into compliance with ordinance requirements by the middle of August, 1981. A recent visual inspection by our field inspector indicates, we bp f0e, that you are continuing to store these vehicles on your property and4hat the property has yet to be brought into compliance with ordinancereqiiire- ments. As stated in our letter of November 19, 1980, storage on your p which is located in an Agricultural Zone, is limited by Section of the Spokane County Zoning Ordinance to, "...storage of those normally used in connection with farm and agricultural activitie terpretations of this section of the ordinance by the Spokane Co Planning Department states that, "...a vehicle must be consider usable or in storage. If a vehicle is to be considered usable, be licensed and operable. If both of these characteristics are sent, the vehicle is not usable and, therefore, is classified a Vehicle storage in residential areas shall be screened or enclo to obscure view from public rights-of-way and/or adjacent prope (emphasis added) oerty, 403180 teals 4,1 s- Lit n- er t e - e. as Page 2. Cezel September 3, 1981 We to the length of time this matter has been pending, we are of the opinion that a period of 14 days, beginning with your receipt of this letter, should be sufficient extension of time for you to complete the process of bringing your property into compliance with the requirements of the Spokane County Zoning Ordinance. If these matters are not taken care of within the pre- viously mentioned 14 days, we will be unable to grant any further extensions of time and will have no choice but to forward this case to the Spokane County Prosecuting Attorney's Office for appropriate legal action. A vio- lation of the Spokane County Zoning Ordinance is a criminal offense and does carry a penalty of, "...two hundred and fifty dollars ($250.00) or imprisoned in the County jail for a term of not exceeding ninety (90) days, for each offense. Each day that a violation is permitted to exist shall constitute a separate offense." Please be advised that this is not a matter that will go away if ignored. I am sure it is important to you, as it is to me, that we resolve this situation quickly. MANSON, Director CERTIFIED - RETURN RECEIPT REQUESTED With regards to conversations with your wife on November 18, 1980, which took place on your property located at North 2623 Bowdish, Spokane County, parcel number 09542-0838, storage on your property, which is located in an Agricultural Zone, is limited by Section 4'04.080 of the Spokane County Zoning Ordinance to, "...storage of those materials normally used in connec- tion with farm and agricultural activities." Interpretations of this section of the ordinance by the Spokane County Planning Department state that, "''.a vehicle must be considered either usable or in storage. If a vehicle is to be considered usable, it must be licensed and operable' If both of these characteristics are not present, the vehicle is not usable and, therefore, is classified as storage' Vehicle storage in residential areas shall be screened or enclosed so as to obscure view from public rights-of-way and/or adjacent property." We are of the opinion that since you have now been informed of the require- ments of the Spokane County Zoning Ordinance, a period of 30 days, beginning with your receipt of this letter, should be sufficient time in which to bring your property into compliance. Do not hesitate to act upon this im- portant matter, since a violation of the Spokane County Zoning Ordinance is a misdemeanor and does carry a penalty.
