HUBBARD, DIRECTOR July 5, 1995 RE: Status of S. 216 Bowdish Rd; also identified as assessors parcel number 45212.0805 Dear Dr. Glasgow: In response to your request, this correspondence confirms that the veterinary clinic operated on the above referenced parcel can be considered a nonconforming use. Therefore, said use can continue to operate on the site provided the use complies with the nonconforming use provisions specified by Chapter 14.508 of the Spokane County Zoning Code (see attached). Recognition of the current veterinary clinic as a nonconforming use is based upon the verbal statements made to Commissioner Hasson and myself at our recent meeting with you, and the affidavits provided by the real estate agents involved in the sale of the property, the closing attorney, and your ex-wife. These documents provide sufficient proof that you acted in good faith in purchasing the property for the intended purpose of establishing a veterinary clinic, and were assured by various officials within county government that said use was a permitted use in the previous Agricultural Suburban zoning classification. Review of building permit records for the property reveals that the site was previously used for a repair garage and maintenance shop in the late 1950's (see attached permit C 4761). Existence of the previous repair business, in effect establishes a chain of nonconforming land use activities on the subject property. As provided by Chapter 14.508 of the Zoning Code, lawfully established nonconforming uses may continue if operated continuously. In addition, normal repair, maintenance, and upkeep of nonconforming uses is also permitted. Expansion of nonconforming uses may be authorized by approval of a Conditional Use Permit. From review of the Zoning Code and the information provided, it is apparent that the existing veterinary clinic is a nonconforming use. Nonconforming uses run with the land as opposed to an individual and can therefore be sold or transferred pursuant to Chapter 14.508 of the Zoning Code.
