Approximately three weeks ago, there was an accident at N. 924 Bowman, Spokane
Washington. An automobile hit a 4 year old boy, who was riding down the
alley just behind the 9211 address. The boy could not be seen co -ling down the
alleybecause of a 6 ft. wooden fence at N. 9211 Bowman st. Fortunately the
little boy was not hurt very bad, but could have been killed. This alley is
used every day by cyclists and cars and it is totally a "blind alley"
I know that this 6 ft. fence is illigal by county rules, but never complained
before this incident. As there are many small children riding this alley on
bikes, T think it should have to come down to 4 ft. so people can see them
coming down the alley.
The driver of the car that hit the boy was going slow and that is the only
F\eason the boy was not killed. The driver did not get a citation, as the
State Patrolman could see -that no one could see up the alley because of the
6ft. wooden fence.
I am enclosing pictures taken at the scene of the accident. The property
belongs to Jody Powell, N. 924 Bowman, Spokane WA 99212, Phone 922-8182.
We 8-11 would appreciate it if you could get her to lower her fence at the
alley to 4 ft.

P.S. The little boy was riding a bike down the alley when he flew out in front of the car.
I am enclosing pictures of the scene of the accident. You can see the little red
bike. The little boy was pretty badly scratched up and had a cut face and knees.
The accident was investigated by the State Patro), and an accident report made by
the driver of the car, Tammy Parker, at the State Patrol office the same day. Just
thank God that the boy wasn't killed outright.
Laws and regulations in our society are, at times, difficult to understand
and fully comprehend. This is true of zoning ordinances, which are laws
intended to protect and govern the many different uses of land in Spokane
County. It is my responsibility, as the Zoning Investigator, when `.he
situation arises, to help resolve conflicts involving the Spokane County
Zoning Ordinance./

of the Spokane County Zoning Ordinance restricts _
in a Residential Mobile Home Zone, in which your property is located, to that
of an Agricultural Suburban Zone, in which, "
6. Interpretation of this section of the ordinance by the Spokane County Planning
Department states that, '...a vehicle must be considered either usable or in
storage. If a vehicle is to be considered usable, it must be licensed and
operable. If both of these characteristics are not present, the vehicle is
not usable andtherefore, is classified as storage. Vehicle storage in resi-
dential areas shall be screened or enclosed so as to obscure view from public
rights-of-way and/or adjacent property." (emphasis added)
7 Section 4.03.020(9) of the Spokane County Zoning Ordinance defines an auto
wrecking yard/junk yard as, ...an open area where waste, used or second
hand materials are bought, sold, exchanged, stored, baled, packed, disassem-
bled, or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, and bottles. A 'junk yard' includes an auto
wrecking yard, but does not include uses established entirely within an
enclosed building." (emphasis added)
We are of the opinion that since you have now been informed of the require-
ments of the Spokane County Zoning Ordinance, a period of 30 days, beginning
with your receipt of this letter, should be sufficient time in which to bring
your property into compliance

of this letter, should be sufficient time for you to contact this office in
order that we might discuss this matter and establish a time frame, (if
necessary), in which your property might be brought into compliance with the
Spokane County Zoning Ordinance. Do not hesitate to act upon this important
matter, since a violation of the Spokane County Zoning Ordinance is a misde-
meanor and does carry a penalty.

immediatery in order that an equitable time frame might be established in
which your property will be brought into compliance with the ordinance re-
nuirements.
