Mr. Graham: This i$ a waiver of set back. The resideace is tob close to the
center line of the road by two feet. The set back is 32 3/4 feet and it should
be 34 feet. It is at East 8006 Jackson which is a road that is very littlo
traveled out in Orchard Avenue. According to the pictures, it is well back of
the road. I recommend tha,t it be grantod.
NIr. Bienz: What is the required numbor of feot to bo back?
Mr. Graham: They should bo back 50 faot from the conter of the road and thoy
are back 48.48 feet.

them up with the houses on Either aide, aasuming, of courso, that they are sat

rYlr. Fountain: The woman I bought this property from told me the pro-oerty ha.d
been surveyed and said the fenco all the way around it sot in a foot on her
land. So I built the houso, and the building permit didnit state how fax it
should bo built from the road. I checked with the Planning Commisaion, I believe
with this girl, and she told me they usad to put on the permit how far thcy
should bo set back from the road. Sho said they quit it for somQ reason or
anothQr. I lined up with the rest of the houses. It showed,approximatoly
35 foet. I sold this, and whon the surveyors camo out thoro, the steel stake
came up way on the far side of the fence. '1'hat is all I have to say.
Mr. Bienz; Is it in lino with the othors?
Mr. Fountain: Yt is and it isntt. The ne"--t house I lined up to, the porch sticks
out approxi.ma,toly 2 foet closer to the road than my house doos. Tho long sido
of his house is on the back sido naturally, and my long side is on the back side.
So to get squar e with the world, I lined up with the back sido and went back up
front and did the measuring to what I thought was far onough from this fence.

1flr. Graham: We ha,ve 4 13reliminary plats and 1 fina,l plat to dispose of.
I suggest that Mr. State, Chairma.n of the Platting Committee take over.
Mr. State: I think we might disnose of these preliminary plats first.
The representatives are all here. First we will have the preliminary
plat of GRAI3Ai-I15 SUBDIVYSION. From what tue have sesn in the preliminary
plat, it is largely asubdividing of existing blocks in there, and there
ar e no new street dedications. This platting is the outgrowth of a request
from the Agsessoris office to facilitate assessing, tax collections, etc.,
instead of these metes and bounds descriptions . They ax e requesteci.to
file plats so hereafter the property will be knokrn as, for instance, Lot
1, Block 2 or Lots 6& 7; Block 20 They are merely filing a plat of wha,t
has formerly been metes and bounds description land. There are no new
street dedications.
Mr. .Anderson: The wa,ter and streets are all there, then?
Iv1r. State: I think that is true that all of the water is in, and the only
thing that they will have to do, is the grading of the street, and if the
water is in, we can accept it as a preliminary plat and will ha.ve to r:la.ke
the investigation to determine that the water is in.

Mr. State: Any remarks you want to make, IvIr. Cameron?
i•s. Cameron: There has been a 30--foot easement ri;;ht here that has been
granted by the City of Spokane, for access to that area. As far as the
actual dedication of the street, there isntt any dedication. I talked to
IuIr. Davis and he said when a plat was up for approval, he could see no
reason why that couldntt be granted for the right-of-way. There is a'
4--inch 'Ara.ter main going right through the centor, as it is right now and
there are trro hydrant s.
Mr. Andersont How wide are the lots?
NIr. Cameron:- They are 85 feet. This is at the 17E corner of -velts Field.
The City boundary runs here ( slzowing on map). Z1re will be able to obtain
dedica.tion from the City for 60 feet from here to here.
If?r. State; If they are notified that the preliminary plat is accepted in
the County, then they can proceed to do what is necessary to dedicato
that street.
I•ir. Posseen: What is your recomrnendation, 1.1r. State?
Mr. State: I move that it be accepted as a preliminary plat.
Mr• :=.nderson: I second that rnotion. Motion carried.
Nr, jjsalker: That is going to raise a legal question concerning the vacation
of that streot. That, we will have to watch very carefully in the Final
P lat. Itm just throwing this in for the record.
Mr. State: 11'7hat did you have in mind, 1Ir. LralYer?
Mr. j~lalker; The ~14'Ucation of the City of its prolperty for public use is
really for the benefit of private property. ^his isn't for the development
of that airport. It is for the benefit of that subdivider. There is a
