legal question ,,..3re as it is just openin;; a stuo sLreet. It start-:, n::)

It raiaes a queation in my mind whether the city can legally do that. II,::

2-Ir. State: There is already an easement granted for this 30 feet. ^r,:'s
property here had an easement over city property now of 30 feet. Thev
intend to augment that by a further easement here.

Nir. Walker: O.K. , it is in the record, I iri satisfied.

hir. State: Here is ar-reliLnina.ry piat of Veracial.e iieigiits. L:r. liobins.-T:
is the Engineer for this.
Mr. Aobinson: This street k►as 401 wide and we are going to make it 501..
Thia street will be dedicated here. (A brief discussion was held.)
IVIr. Stato; Itll grant your position that there is already a40--foot road
hore. It will have to be 501 to comply with the Platting RegulGtions.
14r. Fosseen: Any recommendations, riIr. StateY
Mr. State: The only thing I can recommend now is that the County Engir_r
and myself be requested to ezamine this on the ground as there comes a
time when buildings are located close to the street. Now these are ca~;
where the buildings are already in thore. If the pronerty is unimproved,
then the width of the street can be obtained. But this man has a point,
that if there is a building already there, then the road would come up
too close to it.
Mr. gnderaon; Thore a.re buildings on that ground noivp
111r. State: Yes. I think in fairness to him we should investigate before
wo have to tell him ho does or does not have to Provide this extra 5 feet
on oach side.
Mr, Walker: I move it be accepted as a proliminary plat and be subject
to apIDroval only after Enginoering s tudy by the County yngineer ls of f ice
and by a field study.
NIr. State: Itll second the motion. Motion carried.
ACTIOi1: Preliminary plat be accepted subject to the County Engineer ts
investigation.
aO-UNSOZJ IS ADDI TION PR3LIIUlINARY PIAT
Nir. Robinaon: This is a rlat of Sorensonls gddition and it is quite well
built up. There are only a few lots that are vaca.nt. This is also the
result of a request by the 9ssessorts o£fice that this be pla, tted. Van--
lviarter is deedod to the County, and it is 50 foet wide. That ought to
take care of the sitUa.tion there.
I4r. ,Andorson: Is the water in?
NIr. Robinson: Yes, the water is in, the power lines, and the road is
graveled.
IlIr. State: ITe axe familar with the establishment of Van ivlarter Street. It
is a 501 wido street, and has boen legally established as a County Road.
It is graded nnd in existanco. They aro filing this plat at the request
of the Asseseorls office so they can transfer title by lots and blocks.
