III VARIANCE PERMITS
1. Approval of the application of William P. Miller, Route 5, Spokane, for a
waiver of front yard area to permit building within 4 feet from corner . of
extended highway rift- of -tay. Building will be back 42 feet from
regular right -of. way, northeast of junction, Said property being Net
'northeast of junction of PSH .#6 and PSH 0, 'being all that part of the
`Si of Si of SW`s of NWW of N'W* of Sec, 202643, lying east and -south of
State Highway #6, exc. S. 25t and the E. 20t. This property i8 located
in a Commercial zone. It was found that the State Highway Department
bad purchased enough right -of -wag at the intersection to allow for clear
v ie ion of traffic. The unusual shape of the lot and its relationship, to
other property and the highway as well as the unusual delineation of' the
highway right of-way constittLte reason for the variance as enumerated in
the County Zdning , 0rdinaace,
2. Approval of the application of the Whitworth Construction Company, Route
5, 'Spokane, for a variance permit to locate the rear yard. of 4a residence
to within 20.55 feet of property line, a waiver of `4.45 feet of rear, .yard
requirement. In order to retain, a 25 t set beak -.from the front property -
line, a rear yard of only 20.55 - feet can be obtained due to the depth of
the residence. Said- property being a part of Tract 42, Country Homes
Eats tee, lying south of Graves Roads facing Stevens- Street. It was found
that the property constituted - a bona -=fide building site but that the
shallow depth Would force the construction of an unconventional ,and
inefficient - re cidence if the standard rear yard were provided.
3, Approval of the application of (Madison Lumber, & M111 Company, for , a
variance permit, of 5 feet on flanking street (Derr• ins) to permit con-
struction to within 10 feet of property-line. Said property being a
portion of the 14 of' Tract 155, Opportunity, and a cont inuation of the
`building .known as Bast 11919 Sprague. It was found that the site
distance at this corner will not be impaired because of the extra set
back from. Sprague 'due to the railroad.
4. Approval of a recommendation to Waive the rear yard ,requiremente on all
property in the area between the U. P. Railroad, Sprague Avenue, Havana
and Park 'Road. this action was taken to 'allow full use of the land, for
manufacturing purposes up to the railroad right -of -way, and to make use
of the railroad trackage. It is taken into consideration that this
property does not have the normal depth for such use ,being, from approxi-
mately 10 feet to 200 feet in depth.

ID PROPOSALS TO CHANGE THE ZONITIG MAP
1. Dental an the application of Ted Bolin to change the zoning map from
Agricultural to Local Business on the N. 200 of the N0M of Sec. 26-25-41,
lying due south of Airway Heights, for the following reasons: A similar
request was ma'ie in this general area in August, 1954. At that time the
Planning Commission stated: "The location of the Commercial zones along
the Sunset Highway and the Cheney cut -off were well considered at the
time they were established. The Commercial zones were spaced on both
sides of the highway so as to provide adequate area for present and
future business development and to serve the public. Future highway
development plans were a major factor in determining the location of the
business areas. There is a great deal of vacant undeveloped land zoned
as commercial at the present time that can be used for this type of
business without changing the zoning map.
In the not too distant future limited access treatment will be given to
this highway. The proposed location is a considerable distance from a
proposed access point and. should a commercial development be permitted
it might very well necessitate an expensive overhead crossing or expensive
relocation of the highway. The present staggered location of the com-
mercial zones is to avoid such possibilities.
A plan for this area has been adopted and enacted into lti7. It is the
opinion of the Planning Commission that the applicant has not shown that
the development in the area warrants amendments of the p wm or that such
amendment is necessary in the public interest."
The report of the Comprehensive Plan Committee presented at the February
24th meeting stated: "The principles upon which etc August, 1954 decision
was based remain valid and the conditions remain essentially unchanged.
The State Highway is of benefit to Airway K ^ights gma 'ie °'l.pi.cnt which
would cause, its relocation should be avoided, if peas i 31a . The
State Highway Departments' 10 year plan includes a limited access or
partial limited access treatment for this section of highway to be
undertaken in the 1959 -61 biennium. Commercial development spanning
this highway at Airway. Heights may well make the cost of buying access
rights prohibitive, Should businesses be established on the south side
of the highway to serve highway traffic primarily, the State Highway
Department would have two alternatives, (1) To buy the businesses at
their market value or (2) To relocate the highway to avoid the entire
community in order to reduce the cost of limited access treatment.
Experience in other parts of this State has already indicated that it is
cheaper to move the highway than to buy out businesses established along
both sides.
Establishment of businesses on the south side of the highway may very
well have the effect of depriving the commercial establishments which are
dependent on highway traffic of their source of business,
There are existing zoned areas an the south side of the highway with
vacant land which is available for development. No z m e changes are
necessary to provide additional services for highway traffic on the
south side of the highway. It should again be pointed out that residential
area of Airway Heights is on the north side rather than the south side
of the highway.
It is recommended that in order to preserve the existing business area of
Airway Heights and to protect the public's investment in the existing
highway, that the petition be denied.
• The applicant- presented no additional facts to support his contention
that the, Planning Commission should change its opinion.
2. Denial on the , application of HLberta Walker to change, the zoning map - trot
Agricultural to Local Business on the NE earner of Hayford Road° and Sunset
Highway, being a part of `Government Lot_ h in Section 194'542. It , was
found that guile. this property is approximately two miles east of the
property deeoribed in the above application, it is in the same planning
area, located on the same highway, and the same type, of relationship to
an established- commercial zone.- in the opinion of the Planning Commission,
no facts were presented to distinguish between this proposal and the
above proposal or to show that conditions }lave substantially changed since
the zoning plan was ,adopted. It is therefore the opinion of the. Planning
Commission that this proposal , should not be given favorable consideration
for the reasons stated in the above recommendation. It_ was recognized
that Mrs. Walker bas an established non - conforming use for a service
etation and - restaurant.
3. Approval on the proposal to change the zoning map from Agrtoultur_al to
Restricted -Industrial on property lying south of Mallon Avenue 'between
Stanley and Bowe- Streets, being Block's 4 & 5, Town of Yardley. It is
noted that thin property -is virtually surrounded by property classified
Manufacturing under the provisions of the Zoning Ordinance and that the
predominate use is in fact manufacturing. It is consistent with the
comprehensive plan for the Spokane Valley area to change the zoning map
to classify this property for industrial purposes.
4. Action on a hearing to consider changing the zoning map from Restricted
industrial to Rock Quarry, Sand- and Gravel Pit Zone on that property south
of the center line -of the Freeway, north of the center line of Valleyway,
east -of the center line of Thierman, west of the center line of Coleman
Road, was postponed until the next hearing of the Planning Commission to
allow further 'star.
5. Action on a hearing to consider changing the zoning map from Agricultural
and Rock Quarry. Sand and Grave Pit Zone to Restricted Industrial on that
property south c of the center line of the PreeLaj, north of the center line
of-Broadway, west of the center line of the alley 'between Girard and Lily
Stree to ; ,also south of the center line of Coleman, north of the center
line of Springfield extended, was postponed until the next hearing of the -
Planning Commission to allow further study.
6. Action on the cont inuat ion of the hearing to consider the adoption of a
zoning plan for the =zoned portions of the following , sections, except
that area acted lipori March 10, 1955, being Sections 15, 16,, 21, 22, 2?
and 28 in Township 25 N., F.ange Y lying north of 32nd. Ave., east of
University, west , o'f McDonald and south of Main Avenue laas ppostponed toy
further consideration. Also postponed- for further consideration to the
next meeting of the Planning ' Commission, that unclassified area in Section
8, ''Township 25 N., Binge 44, exolus ive of the incorporated Town of Millwood.
Said property lying south of the Great Northern Railroad Tracks, north
of the Valley Preeway, and west of University, and east of Locust Road,
