MANSON, DIRECTOR Laws and regulations in our society are, at times, difficult to understand and fully comprehend. This is true of building and safety codes as well as zoning ordinances adopted by Spokane County for the purpose of providing reasonable assurances that the public health and safety is being protected. It is this offices' responsibility, when the situation arises, to help resolve conflicts involving these codes and ordinances. This office has received reports regarding a commercial florist business on your property located at South 3011 Bowdish, Spokane County parcel number 28544-1814. This property is zoned Agricultural -Suburban. A recent visual inspection by this office indicated that these reports are accurate. The external appearance of your residence apparently has been altered to accomodate the commercial use. Also evident were placement of signs and a display window. A research of our records indicated that no permits were obtained for the conversion. Section 502 of the Uniform Building Code states that no change shall be made in the character of the use of any building which would place the building in a different division of occupancy or use unless such building is made to comply with the requirements of the building codes. Section 4.05.1008 of the Spokane County Zoning Ordinance prohibits commercial uses within the Agricultural -Suburban Zone. However, Section 4.03.20(27) would allow a portion of your residence to be used for a home occupation business, provided that criteria specified in the definition of home occupation are complied with. Enclosed is the home occupation provisions. It is the intent of this letter to advise you of an apparent violation of a county code and to request compliance within a suitable time frame. Accordingly, we are of the opinion that since you have now been informed of the requirements of the Spokane County codes, a period of ten (10) days, beginning with the date of this letter, M. A. Pittman February 28, 1986 Page 2 of 2 should be sufficient time in which to br'ing your property into compliance. Specifically, a change in use permit will be required from this office and strict compliance of the home occupation provisions will be demanded. Please note that the sign located in the front yard is not allowed. Do not hesitate to act upon this important matter, since a violation of a county code is a misdemeanor and does carry a penalty. If the above-mentioned time frame is insufficient, please contact this office within ten (10) days in order that an equitable time frame might be established in which your property will be brought into compliance with the building code requirements. Home Occupation: "Home occupation" means an occupation, profession or craft, carried on within a residence by the occupants, which activity is clearly incidental to the use of said residence as a dwelling and does not change the resi- dential character thereof, is conducted in such a manner as to not give any outward appearance of a business in the ordinary meaning of the term, and does not infringe upon the right of neighboring residents to enjoy a peaceful occupancy of their homes. An occupation which does not comply with the following criteria shall not be deemed a home occupation: • a. There shall be no exterior alterations to the dwelling which changes the residential appearance or character thereof. b. The use, including all storage space, shall not occupy more than forty-nine (49) percent of the residence's floor area which is finished for living purposes. No home occupation shall occupy a detached accessory building except within an Agricultural Zone, a home occupation may occupy a pre-existing detached accessory building; provided such building is located at least seventy-five (75) feet from any residence other than the residence of the owner. Notwithstanding the above, a commercial greenhouse operated as a home occupation may occupy a detached accessory building. c. Only members of the family who reside on the premises shall be engaged in the occupation. d. Signs identifying a home occupation shall be limited in size to a maximum of two square feet, be unlighted, and be placed flat against the building housing the home occupation. e. There shall be no window display nor shall sample commodities be displayed outside the building, except that horticultural and floricultural products grown on the premises may be so displayed. f. There shall be no stock in trade stores nor commodity kept for sale which is not produced on the premises, except items accessory to the product or service produced on the premises. g. No material or mechanical equipment shall be used in a manner detrimental to the residential use of surrounding properties because of vibration, noise, dust, smoke or odor. h.
