Included with the City's Mitigated Determination of Non -Significance (MDNS), issued on April 15, 2005, was the Lead Agency Review form also dated April 15, 2005. Section B-1 (Environmental Elements - Earth) of the Lead Agency Review Form noted in bold "as an advisory, if more than 500 cubic yards of dirt will be moved on site, an additional detailed SEPA Checklist may be required or additional information provided, to supplement the existing environmental checklist." The information submitted in Mr. Worlock's letter dated September 13, 2005 indicates an excepted total of 20,900 cubic yards of soil disturbance to occur. Pursuant to Section 11.10.070(5) of the City's adopted Environmental Ordinance (No. 48) landfills and excavations in excess of 500 cubic yards shall require an Environmental Checklist. As requested in a previous letter dated September 8, 2005 the City requires an amended environmental checklist or supplemental letter be submitted only addressing the sections which pertain to all grading of the site, which was not previously addressed in the environmental checklist dated November 23, 2004. NOISE Surrounding zoning designations consist of UR -3.5 zoning to the north, south, west and east. Located further to the west across Bowdish Road is zoned B-3. The checklist states existing noise is associated with traffic from Bowdish Road, Dishman-Mica Road and Wilbur Road as well as adjacent residential uses. The Checklist states there will be noise from equipment and vehicles during construction of the site and noise from residential vehicles and activities upon completion. Staff note, the proposal has changed to provide no through access from Bowdish Road onto Wilbur Road. No concerns noted. 8. SHORELINE AND LAND USES The request is to rezone from UR -3.5 to UR -7* with preliminary plat approval to subdivide approximately 6.96 acres into thirty-one (31) single-family residential lots. TRANSPORTATION The site accesses onto Bowdish Road at two entrance points approximately 560 feet apart and is adjacent to Wilbur Road. The Checklist states private roads will access the proposed lots. Staff note per the resubmittal dated March 16, 2005 the applicant has designated the roads as public to serve thirty (30) of the lots, while the northern entrance onto Bowdish Road is intended to only serve one (1) lot ( Lot 10, Block 2). The entrance onto Wilbur road is no longer an access point. The City of Spokane Valley's Development Engineering Division has deemed traffic concurrency has been met. In your letter you ask for information regarding the grading permit application recently submitted to the City of Spokane Valley Building Division and indicate that a new or amended SEPA checklist may be needed. Mr. Johnson is one of the developers of the Watkins Addition project and CLC Associates is the civil engineering and survey firm who is providing design and final platting services for the project. The project was approved by the Hearing Examiner on June 16th, 2005, file # REZ-15-04/SUB-10-04. As you may or may not know, the reason we have applied for the grading permit is to allow Mr. Johnson to install the public utilities (including public sewer, water, streets, drainage, etc.) within the proposed development prior to the City accepting the streets therein as public roadways. These public improvements, together with the grading associated with their installation, are a prerequisite to the finalization of the plat/dedication of roadways and were fully anticipated and identified as part of the project reviewed under SEPA in April 2005. I have attached a copy of the MDNS, together with the SEPA checklist for your reference. As per your request, we have provided under separate cover a revised grading plan which identifies an expected total of 20,900 cubic yards of"soil disturbance" to occur on the site. Of that, there will be approximately 1,700 cubic yards of earthwork to establish the finished grades for the street. The,remainder, approximately 19,200 cubic yards, is the amount of soil that will be excavated and replaced for the installation of utilities (sewer and water). Overall, this amount of grading is considered "minor" given the size of the site (6.95 acres) and the length and depth of utility trenches which need to be excavated for sewer, water and other utilities. For your information, the net cut/fill for the site improvements, including public sewer, water streets and drainage is just 624 cubic yards. With respect to your reference to 500 cubic yards of soil being disturbed, we understand that under the Spokane Environmental Ordinance, landfills or excavations of greater than 500 cubic yards may be considered a "proposal" for which the lead agency must issue a threshold determination. Conversely those projects under 500 cubic yards are "categorically exempt" from any further environmental review. In this context, the importance of 500 cubic yards is simply for the responsible official to determine whether the project is categorically exempt or not, and consequently whether to conduct further environmental review or not. For the Watkins Addition project, it's really a moot point. The project is not categorically exempt but has already undergone a complete and thorough environmental review. This occurred early on in the project review process because the project involved among other things a rezone and preliminary plat. Consequently, the decision now is not whether a "new" or "amended" SEPA review is required but whether the action now contemplated for permitting (ie the installation of utilities) is the same as and was already addressed as part of the overall project. We are confident that after reviewing the prior SEPA checklist and April 15, 2005 MDNS conditions in which two of the three measures directly address grading and site construction activities (through an erosion and sediment control plan) you must find the existing SEPA review to be sufficient for the utility construction and associated grading now proposed. It would be hard to imagine, under any circumstance, what additional measures or requirements the City would impose on this basically flat, valley floor site.
