That the final plat of Curtis Park Club Tract First Addition was filed in 1961, and accordingly, subject to the provisions of RCW Chapter 58 16, naw repealed In light of the above f acts , it appears to the undersigned, that the condition of final plat approval was met by the developer when a statement was placed on the f inal plat Accordingly, it does not appear that the developer has violated any of the conditions of approval as required by Spokane County in conjunction with its approval of the final plat In addition to atentative conclusion that no conditions have necessarily been violated, I have reviewed in detail the provisions of RCW Chaptex 58 16 That is the state law which regulated the platting and subdivision of properties within Spokane County It was subsequently repealed in 1969 The provisions of RCW Chapter 58 16 did not contain any provisions authorizing Spokane County to bring injunctive action or consider the possibility of filing a criminal charge for a violation of conditions of plat approval, such as those referred to in the final plat approval of the Curtis Park Club Tract First Addition In 1969, the legislature promulgated new state laws regulating the subdividing of properties within the State of Washington These laws do not govern the Curtis Park plat These regulations, as I am sure your attorney has properly pointed out, do provide certain remedies in the event of a violation of the laws ~ RCW Section 58 17 210 provides that the Prosecuting Attorney's 4ffice shall commence an action to restrain and enjoin "subdivisions of property" prior to the filing of a f inal plat thereof In the instance case, there was a final plat filed y 4 Ja , a f !
