Per John Diffenbacher's letter of December 69 1974 ta me which I attach, adequate fire protection for Myron Estates No. 2, lst Edition and Myron Estates No. 3 has been provided and building permits may be issued in those two plats. Following the execution on December 18, 1974 of a Security Agreement which was ' acceptable to the fire distr3et, building permits may be issued in Myron Estates No. 2. You have a copy of the Security Agree- ment. ` According to John Diffenbacher's letter of January 23, 1975 to Mr. Huggins no building permits may be issued in Myron Estates No. 1 and No. 4. Mr. Diffenbacher's letter mentions Nlyron Estates No. 5 but no approval by the Planning Commission for Myron Estates No. 5 has been obtained and accordingly no permits would be issued in any event. True and accurate invoices specifically descriUing the size af pipe and fQotages installed and al1 material and Za.bQr used in the installation vf the water facilities, described in 5ectian 3 hereof, shall be furnished td the Company priar ta the Company's acceptance af such facilities in order that the Company may establish the installed cast of said facilities provided Uy the Contractvr. 5. When the new water mains and their appurtenances, described in Sectian 3 herein, (ar portions thereof) have been installed, tested, and accepted by the Company, the Cantractor shall convey, at no expense to the Company, all the water facilities tv the Company by bill(s) of sale, free and clear of any eneumbrances and in the form attached hereto as Exhib it "D." The Contractor shall not impose on nor collect from any lot or home purchaser in the area described in Section 1 herein, any separate charge, fee, or cammission as a charge far electrzc i and/or water service, nar represent that any fee, charge, or cammission x.mPosed on such a Purchaser is related in anY waY to the ~ availability of electric or water service or the use of related facilities. 11. The Contractvr shall not assign this Agreement or its interest in the area described in Section 1 herein without first securing the written cansent of the Company, which conSent wi11 not be unreasonably withheld. This Agreement will inure to the benefit vf and be binding upvn th+e successors and assigns af the respective parties hereta. 12e This Agreement contains all th+e terms and canditions bearing upon the subject matter and will not be modified except by written agreement executed by eaGh of the parties hexeto thraugh authvrized representatives. These discussions have been directed toward our approval of the water system that will be required to service the p lat prior to its acceptance. At this time we have not received any plans for tihe water system and have not given any written approval for the well site. We have, during the past year or so, looked at two possible well sites and have indicated we would approve the sites when we re- ceived a specific request for approval, accompanied by the exact legal description of the site chosen. We understand that this plat is located within the service area of the Washington Water Power Company and that they have agreed to furnish water for the plat. If this is true, then we see no problems on our part in approving water system plans when we receive these, providing they have met the requirements established by the Washington Water Pvwer Company and are in agreement with the comprehenaive plan for the area.
