Dear Jim:
There appears to have been some confusion raised in
the last 30 days in regard to the policy of issuance of build-
ing permits in Myron Estates and this letter is issued to clarify
any confusion.

Per John Diffenbacher 4 s letter of December b, 1974
to me which I attach, adequate fire protection for Myron Estates
No. 2, lst Edition and Myron Estates No. 3 has been provided and
building permits may be issued in those two plats. Following the
execution on December 18, 1974 of a Security Agreement which was
' acceptable to the fire district, bu3lding permits may be issued
in Myron Estates No. 2. You have a copy of the Security Agree-
ment. ,
According to John Diffenbacher's letter of January 23,
1975 to Mr. Huggins no building permits may be issued in Myron
Estates No. l and No. 4. Mr. Diffenbacher's letter mentions
Nlyron Estates No. 5 but no approval by the Planning Commission
for Myron Estates No. 5 has been obtained and accordingly no
permits would be issued in any event.

To faciiitatt compliance with Condition #7 and #15 0f the approved preliminary
plat of record dated November 10, 19 72, the staff flnds the following hns
yet to be completed:
"A 16 " water main tn operation comirig from Diehman Mica Road and
con»ecting to the f" main that is presentiy in existence."
Thts condition has been excerpted from an agreement with the fire district
and included in a letter to Mr. Huggins and Mr. Guthrie dated June 20, 1973.
Condition #7 of the preliminary plat of record will be met when that work has
been completed to Lhe satisfaction of the Fire District, the Health District
(both County and State Health authorities) and the Spokane County P1anninQ

PRELIMINARY SUBDIVISION AND ZONE CLASSIFICATION UPGRADING
PE-8 74-72 - NICHOLS ESTATES NO. 2. GUTHRIE
ZE-144-72 - AGRICULTURAL TO SINGLE FAMILY (R- 1) RESIDENTIAL ZONE
Planning Commis sion Recommendation. Approve, subaect to the followina
conditions:
A. Conditions.
1. That the plat be de signed as indicated on the preliminary plat of
record and/or attached sheets as noted and in substanttal conform-
ance to the overall plan approved for the entire Nichols Estate.
The Planning Commission staff will work with the sponsor to
determine logical divisions of this plan to be included in final plats.
2. That a statement be placed in the dedication to the effect that no
more than one dwelling structure be placed on any one lot, nor
shall any lot be further subdivided for the purposes of creating
addita.onal lots or building sites without filing a replat.
3. That the plat provide for right of way width for streets as
indicated on the preliminary plat of record.
4. That appropriate provisa.on be made that the following described
property be hel.d in trust until the continuation of the streets be
dedicated or deeded: A 1' strip at the ends or edges of all
streets that terminate or border the plat boundary. .(Temporary
cul de sacs are required when streets terminate at the plat
boundarie s . )
5. That appropriate street names be indicated.
6. That appropriate utility easements be indicated on copies of the
approved preliminary plat for distri.bution to the Planning Depart-
ment and the utility companies. Written approval of the easements
by the utility company must be received prior to the submittal of
the final plat.
7. That a plan for water facilities adequate for fire protection be
approved by the water suppla.er and the fire protection district.
The water supplier will certify that appropnate contractual
arrangements have been made with the plat sponsor for construc-
tion of the water system pnor to filing of the final plat.
8. That a certificate of title be furnished the Planning Commission
prior to the filing of the final plat.

9. That the preliminary plat be given condita.onal approval to
December l, 1973.
10. That streets be improved to standards established by Spokane
County, or a bond to cover the cost of such improvements be
furnished the County Engineer in the amount as determined by
the County Engineer.
11. That profiles of streets, proposed grades, and drainage plan of
the plat be submitted and approved by the County Engineer
before the final plat a.s drawn. The County Engineer may require
that design of drainage a.mprovements for the enta.re plat be
made by a registered civil engineer.
12. Conditional approval of the plat is given subject to dedication
of the nght of way to the publa.c and approval of the road system
in the plat by the County Engineer.
13. That a name be indicated before the final plat is filed; such name
to be approved by the County As se s s or.
14. That percolation and/or soil clas sificati.on te sts be submitted as
re quired by the County He alth Offa.cer. . Subdivider i s not authonzed
to have the final plat drawn until the County Health Officer ceritfies
in writing that lot sizes, soil porosity, and topography are such as
to reasonably expect on-site sewage systems to be workable and not
injurious to water strata used for potable water wells or springs.
15. That a program for development of a public water system, adequate
for dome stic water use and providing for service connections fio
each lot, be approved by County and State Health authorities pnor
to filing a f.tnal plat.
The plat dedication will contain a statement to fihe effect that
the subdivider will provide for the installation of a public water
system as approved by County and State Health authorities pn.or
to sale of lots.

A. Analysis:
1. The single family lots in Block s 2, 3, and 4 have been de signed
to accommodate the single family re sidence s; i, e., all of the
lots have at least 8 0' of frontage and 12 5' of depth. The lots in
Block 5 have been de signed for singie f anu.ly re sidence s and
limated anzmal keeping activities. ,
2. The Planning Commission has been routinely upgrading similar
re sidential plats with lots le s s than one acre a.n si ze to the Single
Family Residentlal (R-1) Zone in the Spokane Valley. Lots in
exce s s of one acre in size have been upgraded to the Agricultural
Suburban classification.
3. The Agncultural Suburban Zone prohubits mobile homes, intensive
agricultural activa.ties, and contractor's yards. In addition to
the se , the Sa.ngle Family Re sidential (R-1) Zone prohibits
duplexes, arumal keeping other than household pets, and home
occupations.
B. General Data:

As a la.nd owner in this vicinity, south of 44th Avenue, please put
me on record as stating that I am strictly opposed to this proposition
and my vote, if I were in the position to be present, would be an
emphatic N0. I feel that not more than one house should be allotted
for one acre of ground. Also, the type of dwelling should conform to
the sta.ndards and type of dwellings built in the Pondorosa. My vote
is N0. I do not believe this proposal will help the value of land in
this vicinity.
