There appears to have been some confusion raised in
the last 30 days in regard to the policy of issuance of build-
ing permits in Myron Estates and this letter is issued to clarify
any confusion
Per John Diffenbacher's letter of December 69 1974
to me which I attach, adequate fire protection for Myron Estates
No 2, lst Edition and Myron Estates No 3 has been provided and
building permits may be issued in those two plats Following the
execution on December 18, 1974 of a Security Agreement which was
acceptable to the fire district, building permits may be issued
zn Myron Estates No 2 You have a copy of the Security Agree-
ment ,
According to John Diffenbacher's letter of January 23,
1975 to Mr Huggins no building permits may be issued in Myron
Estates No 1 and No 4 Mr. Diffenbacher's letter mentions
Nlyron Estates No 5 but no approval by the Planning Commissian
for Myron Estates No 5 has been obtained and accordingly no
permits would be issued in any event

AGREEMENT
AGREEMENT, made and entered into the 26th day of February,
1974, between RALPH D. GUTHRIE, hereinafter called "Owner", and
WEST VALLEY EXCAVATORS, hereinafter called "Contractor", as follows
1. Contractor agrees to install, hook-up, make operable 210 lineal
feet of 16-inch water line, commencing at the center line of Dishman-
Mica Highway, Spokane County, Washington, and running at a right
angle 900 for 210 lineal feet under the Union Pacif ic Railroad
Company tracks and connecting to the presently installed 16-inch
line. The installation must be in accoraance with plans approved
by the Washington Water Power Company, the appropriate fire district
and the Spokane County health authorities.
2. The work shall commence upon the execution of this agreement
and shall be completed by April 15, 1974, and approved and accepted
by the Washington Water Power Company.
3. Contractor agrees to furnish a$3,500.00 performance bond,
acceptable to the Owner and the appropriate county authorities.
4. Contractor agrees to correct any deficiencies in the installation
as may be reasonably determined by the Washington Water Power Compatay,
the fire district or the county health authorities.
5. Contractor further agrees to warrant all workmanship for a period
of one year from date of completion of the installation.
6 Owner agrees to pay to the contractor for the performance of
the above work, including labor ana materials, the sum of $3,500.00
plus Washington state sales tax, which sum shall be paid upon com-
pletion of the work by the contractor.
IN WITIUESS WHEREOF, the parties have executed this Agreement

8 This license may be revoked at any time by the Railroad Company or ite successore or aesigns by the giving of
thirty (30) days notice in writing mailed to the Licensee at the addreas noted below the signature of the Licensee
hereto and ehould the Pipe Line be permitted to be in bad order or condition for twenty Your (24) houre then the
Railroad Company may at once revoke this license without notice and in the event aY termination of thie agreement
howsoever the Licenaee shall be without recourse or redress of any character againat the R,ailroad Company by reason

erty of the Licensee herein provided for from that portion of the right of way of the Railroad Company not occupied by
the said roadbed and track or tracks ana ahall restore to the satfsfaction of the Railroad Company the said right a!
way to as good condition as it was in at the time of the construction of the Pipe Line and iP the Licensee Yails so to
do the Ftailroad Company may do such work of removal and restoration at the cost and ezpense of the Licensee The
Railroad Company may at its option upon such termination at the entire coet and egpense of the Licensee remove the
portion of the Pipe Line located underneath said roa.dbed and track or tracks and restore said roadbed to as good a con-
dition as it was in at the time of the conatruction of the Pipe Line or it may permft the Licensee to do such work of
removal and restoration under the superviaion of the Railroad Company and in the event of the removal by the R,ailroad
Company aY the property of the Licensee and of the restoration of safd roadbed and rigbt of way as herefn provided the
Railroad Company shall in no manner be liable to the Licensee 4or any damage sustained by the Licensee for or on ac-
count thereof and such removal and restoration shall in no manner Arejudice or impair any right of action Por damages
or otherwise that the Railroad Company may have against the Lfcenaee
10 The wafver by the Railroad Company of the breach of anq condition covenant or agreement hereia rontained
to be kept and performed by the Licensee shall in no way impair the right of the Ra.ilroad Company to avail itselY of
any subsequent breach thereof

work until such plana ahall have been approved by the Chief Engineer of the Railroad Company and then only
under the supervision of said ChieY Engineer or his rePresentative The Railroad Company shall have the right, iP
it so electe to provide such support as it may deem necessary Yor the saYety of ita track or tracks during the time

This letter is to answer your letters of November 19, 1973 and
February 28, 1974, al so Mr Jerry Nei 1's 1 etter from the Prosecuting
Attorney's office, of December 28, 1973 The 16" water transmission
main from the Dishman-Mica and Thorpe Road Intersection to the vacinity
of 44th and Bates has been installed by Mr Guthrie's contractor,
pressure tested and accepted by WWP, and bacteriology found acceptable
by the Spokane County Health District
In consultation with Mr Neil, Mr Kirkwood of WWP, and Don L Hunt,
Chief of the Spokane Fire Protection District #8, agreement has been
reached to allow the issuing of building permits under the following
conditions
1 All installations shall be completed, as described by
Mr Hunt's letter of March 28, 1974 by May 31 , 1974
2 All installation shall be acceptable to all agencies
men tioned in this letter
3 If completion is not obtained by the specified date other
action is assued by Mr Neil's office

In regard to your letter dated December 28, 19749
on the Myron Estates water proposal, I have drawn and
executed a contract between Mr Ralph Guthrie and West
Valley Excavators for your review Upon your acceptance
West Valley Excavators will authorize their insurance
company to post the performance bond required
In reference to paragraph four in your letter, I
feel that it is not necessary due to the fact that at
this time Mr Huggins and myself were discussing how to
accomplish our objectives The railroad had not officially
given us a signed contract from their West Coast office
However, they had approved it and told us to go ahead and
they would provide us with an inspector to approve the
installation without a signed contract Since that time,
we have received the signed contract from the railroad
and would have the actual installation of the pipes under
the tracks covered in the overall contract with West Valley
Excavators
I have discussed these items with Mr Huggins and I
am writing you this letter at his request and suggestion
There are many builders that are being held up on this
matter due to their not being able to obtain building per-
mits I am sure that you and your office would be doing
the community a great service to expedite this agreement
as quickly as possible
