A. INTRODUCTION
This matter having come before the Examiner Committee on February 27, 1979,
and the members of the Committee present being Jvhn Culler, Ted McCoury,
and Chairperson, Abby Byrne.
B. PROPOSAL
The sponsor, W. F. Southern, Jr., is requesting approval of an Extension of
Time, PE-981-75, Southern's Mobile Park Addition, and ZE-7-75, Agricultural to
Residential Mobile Home Zone for subdivision of 4.25 acres into 17 lots for
mobile homes as permanent residences and there being present, the following
applicant or representatives:
W. F. SOUTHERN, JR.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential.
2. That the Comprehensive Plan designates this area as residential.
3. That the existing Zoning of the property described in the application is
agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulf i I led .

6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the proposed use is compatible with existing uses in the area.
8. The Hearing Examiner Committee finds the proposed use is not detrimentat
to the general purpose or otherwise harmfull fio the public health, safety,
and welfare.
9. That the owners of adjacent lands expressed neither approval or
disapproval of the proposed use.
10. The following are additional findings of fact considered by the Hearing
Examiner Committee:
a) With additional conditions as presented in the staff analysis updating
the plat to County standards.
D. SPECIAL CONDITIONS OR CONTIGENCIES APPLICABLE TO THIS
SUBDIVISION APPROVAL:
If approval is granted, the following conditions are recommended.
1. Those conditions already attached to the preliminary plat of record.
2. That the project sponsor is responsible for requesting a time
extension to review any preliminary plat approval.
3. That all public roads within the plat be curbed and/or paved to the
specifications of the County Engineer. Existing County roads
providing direct access to lots of the plat shall be paved and curbed
to the standards of the County Engineer.
4. That the owner, his grantees and assigns agree to participate in and
not oppose or protest an R I D on Barker Road to accomplish the
second condition above.
5. That the time extension be granted to March 1, 1980.

I. GENERAI, INFORMATION
A. Location
The proposal is located in the Spokane Valley adjacent to and east of Barker
Road approximately 700 feet north of Sprague Avenue.
B. Proposal -
- 4.25 acres subdivided into 17 lots for residential mobile home use
- Typical lot frontage = 70 feet
- Typical lot size = 8,050 sq. ft.
C. History
The original proposal was heard and approved in November, 1975. The applicant
is now requesting an additional Extension of Time, due to health problems, in
order that he may have enough time to finalize the plat.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has re-examined the preliminary plat and recommends
that the plat be conditioned the same as the preliminary plat of record with
the additional conditions that all public roads within the plat be curbed
and/or paved to the specifications of the County Engineer. Existing County
roads providing direct access to lots of the plat shall be paved and curbed to
the standards of the County Engineer. Also, that the owner, his grantees and
assigns agree to participate in and not oppose or protest an RID on Barker
Road to accomplish the second condition above.
B. Sewage Disposal
For economic reasons, and to provide the most realistic alternative, the
applicant's engineer feels on-site septic tanks should be utilized.
C. Drainage
The County Utilities Engineer reports that final construction plans must be
reviewed and approved prior to the final plat filing.
D. Water Supply
The Proposal is located within the recorded service area of Consolidated
Irrigation District #19.

WHEREAS, the Spokane County Flanning Commisston dld hold a publtc meeting
on January 20, 1978 to conslder the testimony and requests of several applicants,
objectors and other tnterested partles concerning the below refecenced zone reclassE-
ficattons and other items of business, and
WHEREAS, at said hearfng opportunlty was afforded those favoring and those
opposing all items of business, and
WHEREAS, Nir. McCoury, Nirs. Byrne, Nirs. R3wlings, Messrs. C•ulgley and
Thomes were t'n attendance and constltuted a quorum, and
WHEREAS, the Spokane County Planning Commisston fully consldered the testl-
mony given, the environmental review, and all other evtdence presented, recommend:
to the Board of County Commissloners the followtng:
1. After discussion of the Short Plat Ordtnance, the following changes were
adopted to be lncluded In the flnal draft of the Short Plat Ordinance whtch
had been dlstributed to the Commfsslon members at thelr january 13, 1978
hearing:
a) Insert for Item 4.3 The Countv Enqineer.
It shall be the duty of the County Engtneer or his destgnated
representative (a) to revlew proposed short plats, as appropriate
and applicable, (1) for adequacy of survey lnformation and legal
descrlptlon; (2) general design in respect to surrounding develop-
ment, topography and road system conflguratton; (3) access and
need for public rtghts of way; (4) utllity easements; (S) dralnage
and flood protectlon requlrements; (6) prlvate and publlc road
requirements; (7) sanltary sewer requtrements, tf appllcable;
(b) to furntsh hls wrltten recornmendations In respect to these Item;
to the Short Plat Admfnistrator; (c) to adminlster all engineertng
requlrements for engineering, surveytng, installat[on, bonding,

In the r.matter of the plat submitted for your approval, this Company
has examined the records of the County Auditor and County Clerk of
Spokane County, tidashington, and the records of the Clerk of the United
States Courts holding terms in said County, and from such examination
hereby certifies that the title to the following described land situate
in Spokane County, to-wit:
Tracts 7 and 8 in Block 20 of CORBIN ADDITION TO GREENACRES, as
per plat thereof recorded in Volume "S" of Plats, page 30, lying
Southerly of the following described line:
Beginning at the Northwest corner of said Lot 8 and the beginning
of said line description, said point being the Southwest corner
of the plat of LaBerry Mobile Park; thence North 84°19.9' East
along the Southerly line of LaBerry Mobile Park, 640 feet to a
point in the East line of Lot 7 in Block 20 of CORBIN ADDITION TO
GREENACRFS, the terminus of said line description.

ELBERT G. WORDEN and LORErlE C. WORDEN, husband and wife

The Company hereby reserves and the purchaser does hereby grant unto
the said Company the rights of way now or hereafter deemed necessary
by said Company for the construction and maintenance of irrigation
flumes, ditches and pipe lines over and across the above described
land for the irrigation of said land as well as other lands, with
the rights and privileges to enter upon said land for survey,
location, construction and repair of said irrigation conduits,
either by the Company, or by the owner or owners of lands served
by thern.
6. Water contract contained in Deed dated August 5, 1938, recorded
August 6, 1940, as Document No. 452286A, as follows;
This deed is also made upon the express condition that this deed
and the lands herein described are subject to all the rights,
privileges, duties, liabilities and obligations of the parties
to this deed as the same are now contained in a certain contract
dated July 5, 1923, made between the Spokane Valley Farms Company,
a corporation, as party of the first part, and the Community
Service Company, a corporation, as party of the second part, now
of record in the office of the Auditor of Spokane County, tidashington
in Volume "X" of Miscellaneous Records, at page 282 thereof, and
that all subsequent deeds conveying said land shall be made
subject to said contract and said contract shall run with this
land with the same force and effect as if the said contract were
expressly written in such deed.

A. CONDIfiIONS:
1. That the plat be designed a s indicated on the prel iminary plat of record

The water supplier (purveyot; v+rill also certify prior to the filing cf the
final plat on z copy of said vaat-cr plan that appropriate contractual
arrangEments have been made with the plat sponsor for constructior of
the water system, in accordance with the approved p1an, and in accord-
ance with a time schcdule. The time schedule will provide, in any case,
for completion of the water system and inspection by the appropriate
health authorities prior to appllcation for building permits within the plat.
The contractual arrangements will include a provision holding Spokane
County and the water supplier (purveyor) harmless from claims by arsj• lot
purchaser refused a building permit due to the failure of the plat spon-sor
to sati sfactorily complete the approved water system.
The plat dedication will contafn a statement to the effect that the public
water system as approved by County and State Health authorfties and the
local fire distrfct and water supplier (purveyor) will be installed withi.n
this plat, and the subdivider will provide for individual service to each
lot prior to sale of each lot.
NOTE: The Spokane County Health District has determined that the soil
conditions in the plat are suitable for on-site sewage disposal
systems on each lot.
8. That a certificate of title be furnfshed the Planning Commission prior to
the filing of the final plat.
9. That the prelzminary plafi be, given conditional approval to December
1, 1976.
10. That streets be improved to standards established by Spokane County
or a bond to cover the cost of such i•i-i,rrovnments be furnished the Coun*y
Engineer. The bond may also cov~:r tao cost of "as built" plans, engi-
neering costs, and placing of finai centor l1ne monuments.
11. That profiles of streets, cross sections, proposed grades, and drainag2
plart of the plat be submitted and approved by the County Engineer and
by the Plannfng virector before the final plat is drawn. Prfor ta acrp-p-
tance of the improve:,ments or rclease of bonds, a certificatc by a reg-
istered civil engineer or iicensed land surveyor will be rcquired indicating
that all improvements have been installed to the lines and grades shown
on the approved construction plans.
12. Conditional approval of the plat is givc;n subject to the dedication of the
right of way to the public and appro\,31 of the road s~ystem in the plat
by the County Enginecr.

ENVIRONNiENTAL ASSESSMENT
At the time of the hcaring of thi s proposed subdf vi sion, considEration will
havc been given to (1) the public use and fnterest proposed to be served by
the establishmenfi of the subdivision and dedication (RCW 58.17,110) and
(2) those elements necessary to determine the existence or non-existence
of a major action wlth significant effects on the environment. The Plannfng
Commission, at this time, recommends to the Board of County Commissioners
that thf s application as presented will have no significant effects on the
environment provided that thc above conditions attached to the preliminary
plat of record arc met.

Addition as indicated on the areliminarv plat of record to the Residential Mobile
Home Zone upon filinct of the final plat.
ANALYSIS
1. Southern's Mobile Park Addition has been designed to dccommodate
mobile homes on individual lots o 1. e,, P:11 of the lots would have
at least 70 fcet of frontage and 115 i~et of dcFth.
2. The proposzd plat is situated within a developing mobile home area.
Surrounding land uses fnclude Uadlvift~61 mcbilc home lots to the north
and west, residences to the east, and acreage tracts and scattered .
residences to the south. The area to be platted includes one single-
family re sidence .
The Residential Nobile Home Zcne F-ch''zlits intcnsive agricultural
activtties and contractor's yards. Tsail~r courts are allowed only
by conditional u5e permit and are generally discouraged in subdivisicns
platted for indivtdual lot s.
4. The Staff notes that the residences along the east side of the proposed
mobile home plat enjoy a rcar yard relationship with the mobile homes
