1, That the plat be designed as indicated on tne preliminary plat of record
and/or attached sheEts as noted to coordinate the shape of lots in this
plat wlth the proposed plat to the North.
2. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
buildfng sites without filing a rcplat.

preliminary plat of record.

The water suppifer (purvcyor) wiil z1iso cerfiify prior to the filing of the
final plat on a copy of sald wazer plan that appropriate confiractual
arrangements havc becn made with the plat sponsor for constructlon of
thc water sy; tem, in accordance wtth the approved plan, and in accord-
ance with a time schedule. The time schedule will provide, in any case,
for completion of the water system and inspection by the appropriate
health authorities prior to applicatlon for building permfts within the plat.
The contractual arrangements will include a provision holding Spokane
County and the water supplier (purveyor) harmless from claims by any lot
purchaser rEfused a building permit due to the failure of the plafi sponsor
to sati sfactorily complete the approved water sysfiem.
ThE plat dedication will contain a statemer.t to the effect that the public
water system as approved by County and State Hcalth authorities and the
local fire district and water supplier (purveyor) will be Installed with,-:,
this plat, and the subdivider will provide for indivfdual service to eac:i
lot prior to sa.le of each Iot.
NOTE: The Spokane County Health Distrfct has determined that the soi!
condit:ons in the plat are suitablE for on- site sewage disposal
systems on each lot.
8. That a certificate of title be furnished the Planning Commission prior to
the filing of the final plat.
9. That the preliminary plat be given conditional approval to December 1,
1976.
10. That strEets be improved to standar:~s established by Spokane County
or a bond to cover the cost of such imDrovements be furnfshed the ;Rounty
Engineer. The bond may also cover c:ost of "as built" plans, engineer-
i ng costs, and placing of the final c:-?ter l.ine monuments.
11. That profiles of streets, cross sections, proposed grades, and d:ainage
pian of the plat bc submittQd and approved by the County Engineer and
by the Planning Director before the final plat f s drawn. Prior to acrep--
tance of the improvements or release of bonds, a certiffcate by a regis-
tered civil engineer or licensed land surveyor will be required indicating
that ali improvements have been installed fio the lines and grades shown
on thc approvcd construction plans.

ENVIRONMENTAL ASSESSMENT
At the time of the hearing of this proposed subdfvision, consideration will
have been given to (1) tha publfc use and interest proposed to be served by
the establishment of the subdivision and dedication 41CVU 58.17.110) and
(2) those elements necessary to determine the existence or non-existence
of a major action with significant effecte on the environment, The Planning
Commission, at this time, recommends to the Board of County Commissioners
that this application as presented will have no significant effects on the
environment provided that the above conditions attached to the preliminary
plat of record are met.
ZONING RECOMMENDtiTION
Planning Commission Recommendation: Approve Darcv Estates as indicaten
on the preliminary plat of record to the Sinqle Familv Residential (R-1) Zone

the Ponderosa Area Residents Asaociation.
My purpose in being here is to raise an objection to the size of lots
in the Darcy Estates Plata
We in the agea have been working fcsr the past several years towarda
maintaining uniformity of lot size in the Plats being proposed and we feel

To the West of thie propoaed plat is the Pondra Pinea Plat and all lots
are one acre in size. Imnediately across 44th Avenue, to the South, a11 lots
are one acre in size. In addition, a condition of the Myron Estatea Plat,
which begins at Van Marter and 44th is that they were to start with acre tracts
between Van Marter and Gillis Road thus creating a buffer zone with the rest
of the srea snd then a gradual decrease in lot size ae the Myron Estatea runs
East. The other Plat in thia immediate area is the Forest Medows Plat with
all lots approximately one-half acre in eize. Thfs plat is immediately acrose

44th Avenue from that postion of the IYiyron Estates which aleo has one-half
- acre size lots thus maintaining conformity as to aize of lot.

We as home ownere in the area feel that proper planning as to uniformity
betvieen plats ia extreanely important and so far, with the approval of exiating
plats, we feel this has been maintained.
It is our contention that the lots in the Darcy Estates are tcP small to
maintain proper uniformity and recommend they be increased to one acre in
size and that the same type of buffer be established on this side of 44th
as it wae with the Myron Estates on the other side. , J
Further, I would Iike to ask what plana have been made for the improve- 1,I~
ment of 44th and Bowdish extended. Representatives of our group have testified
in the past regarding the poor road condit3.ons with exieting hazards being ,
compounded by the growing population. This phreicular road runs over a creek
with a bridge barely wide enough for two care to pass and not wide enough for
a car and truck or bus to pass.
In addition to this, I would like to aek where the water aupply for the
Darcy Estates is to come from? Don Cole from the 4Jashfngton Water Power
