Dear Ms. Austin: The City has received your letter requesting an interpretation regarding 7914 East Buckeye Avenue meeting criteria of the Airport Hazard Overlay Zone to allow for further redevelopment. The site is located in zone 6b of the Airport Hazard Overlay Zone and pursuant to Section 19.110 of the SVMC, development of single-family lots must meet one (1) of the three (3) criteria established in Table 19-110-1. You are seeking an interpretation to determine if redevelopment of 7914 East Buckeye Avenue is consistent with Criteria 1.b stating; "Consistent with adjacent (not across public rights-of-way) property sizes for proposed development;" The adjacent parcels range from 6,169 to 14,787 square feet. The property in question is 17,744 square feet and proposed to be further divide into (2) lots. The current lot and adjacent lot sizes meet criteria 1.b in Table 19-110-1 of the SVMC and would allow for proposed land division. Be advised, if the Spokane Valley Municipal Code (SVMC) is updated or changed, this interpretation may become invalid. Sprague Ave., Suite 106 Spokane Valley, WA 99206 RE: Future sub -division of property at 7914 E. Buckeye (Parcel #45072.4802) Dear Karen, I am in the process of buying the property at 7914 E. Buckeye, Spokane Valley, WA. This parcel fronts on Buckeye and Marietta Streets. In the future I would like to divide this property in half and have 2 separate lots. One would front on Buckeye and the other would front on Marietta. This property is in the Airport Hazard Overlay in Zone 6B. I would like to request a written interpretation that would show that this property meets the criteria to allow me to sub -divide this property into 2 parcels as I have described. According to Table 19-110-1 criteria (1) B (Airport Land use Compatibility Prohibited Uses) of the Spokane Valley Municipal Code (SVMC) regarding consistency with adjacent lot sizes I believe this would meet the criteria to allow such division. I would greatly appreciate your help in obtaining this written interpretation. I believe it would be beneficial in the future when I make a request to the City to make this property division.
