(Vote was unanimou s . ) A. ANALYSIS AND BACKGROUND: In September, 1971, the subject property was submitted as a preliminary plat together with 34, 200 square feet of property adjacent to the west. Six lots were approved, at that time, subject to the sponsor obtaining sufficient property to increase their frontage to 80 feet. Subsequent to thts plat ex- piring in 1973, three segregations were dt5eated on the west halfof the subject propertys All three segregations have 76 feet of frontage and 151 feet of depth. Duplexes were constructed on all three lots. At that time duplexes were allowed on segregations containing 70 feet of frontage and 7, 800 square feet of land area. The present plat sponsor is requestfng three lots to be approved, each with 76 feet of frontage and 151 feet of depth and all for single-family homc:s. The staff feels that a conflict in land uses exists fn this area and must be addressed fn determining the frontage requirements. The qeneral character of the section is that of acreage-type segregations, of which most are one acre to ten acres in size. The land uses consist prfmarily of pasture land, orchards, truck farmtng, and anfmal kceping. In contrast to this more rural type of lot size and land uses, there have been two subdivisions flled fn this sectfon consisting of 49 lots whfch average 10, 000 to 15, 000 square feet of area. In 1969, Friske Subdivision was approved with 25 lots, of which seven have 75 feet of frontage. Therefore, the staff reNcommends approval of the plat with three lots if the Planning Commission feels thafi Frf ske Subdivision has set an acceptable precedenfi to be further allowed in the area. The sponsor shall submft appropriate documents to the Zoninq Adjustor to seek approval of vartances for all three lots within the plat in order to obtain building permits prior to filing the final plat. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creattng additional lots or building sites without filing a replat. 3. That appropriate utility easements be indicated on copies of the appraved prelimtnary plat for distribution to the Planning Department and the utility compantes. Said water plan must also have been approved by the appropriate health authorities. The health authorities, water supplier (purveyor), and fire protection district wi11 certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with thefr requirements and will ade- quately satf sfy their respective needs. Sa id water plan and certification will be drafted on a transparency suitable for reproduction. The water supplier (purveyor) will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for constructton of the water system, in accordance with the approved plan, and in accordance with a time schzdule. The time schedule will provide, in any case, for completlon oi the water system and inspection by the appropriate health authorities prior to applicatfon for butlding permits within the plat. The contractual arrangnments wfll lnclude a provision holding Spokane County and the water supplier (purveyor) harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system, (C ont' d) -2- - ~ PE- 995- 76 - TOHN HENRY SUBDIVISION (Cont' d) The plat dedication will contain a statemertto the effect that the public water system as approved by County and State Heaith authorittes and the local fire district and water supplier (purveyor) will be installed within this plat, and the subdivider wfll provide for fndividual service to each lot prior to sale of each lot. NOTE: The Spokane County Health District has determined that the soil conditions fn the plat are suttable for on-stte sewage disposal systems on each lot, 7. That a certificate of title be furnished the Planning Commission prior' to the filing of the final plat. 8. That the preliminary plat be given conditional approval to April 1, 1977. 9. That streets be improved to standards established by Spokane County or a bond to cover the cost of such improvements be furnished the County Engineer. The bond may also cover the cost of "as built" plans, engineering costs, and p2acing of final, center line monuments. 10. ENVIRONMENTAL ASSESSNigNT: The proposed plat i slocated on the south side of Broadway Avenue between Sullivan Road and Conklin Road. The plat consists of three lots on .90 acres. The site is generally flat in nature and is presently vacant. No additional right-of-way dedication is necessary to pi-ovide access to adjacent ownership. ANALYSIS 1. The lots in john Henry Subdivisfon have been designed to accommodate single family residences, ie,, all of the lots would have at least 76 feet of frontage and 10, 000 square feet of area, and cn•ould require varfances in order to meet the singie famlly standards in the Sfngle Family (R-1) Residential Zone. The staff does not anticipate that the narrower iots would reduce the ir utilization for single family home site s. 2. The plat is situated within the Vera Community. The Commfssion has been upgrading simflar sized lot developments in the area to the Single Family Residenttal (R--1) classification. 3.
