(Madden's Subdivision)
Planning Commission Recommendation: Approve to Sinale Familv Residential
Zone ( R-1) .
A. Reasons:
The final plat of Madden's Subdivision has been filed incorporating 5 lots
averaging 11,900 sq.ft. (79'x132'). All lots within the subdivision con-
form to the area requirements of the Single Family Residential Zone for
the establishment of a single family residence; however, 3 of the lots
have 79' of frontage rather than the required 80'. Administrative variances
could be proce s sed for the substandard lots.
The Planning Commission is of the opinion that Madden's Addition is
appropriate for Single Family Residential zoning because:
1) The lots have been designed for and can physically accommodate
single f amily re sidence s. The lots have only 79' of frontage but
retain almost 12, 000 sq.ft, of lot area. The Planning Commission
is of the opinion that the platted lots do not have sufficient frontage
to adequately accommodate duplex development.
2) The Planning Commission has been upgrading similar residential
plats in the Vera and Opportunity communities to the Single Family
Residential classification (R-1).
3) The Single Family Re sidential Zone prohibits duplexe s, animal
keeping other than household pets, and home occupations. The
Planning Commission notes that no duplexes have been established
in the immediate vicinity of Madden's Addition.

Planni.ng Commission Recommendation: Approve, subiect fio the followina
conditions:
A. Conditions:
1. That the plat be redesigned as indicated on the preliminary plat of
record to provide for an east-west stub street for access to the
interior of the block, and also to make provision for increasing the
lot frontages to approximately 80'. A 32' easement is shown across
~ the front of the lots which will provide an area to accommodate the
~
public sewer system for the plat.
2. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shali any
lot be further subdivided for the purposes of creating additional lots
or building site s without filing a replat.
3. That the plat provide for additional right of way as indicated,
4. That appropriate provision be made that the foliowing described
property be held in trust until the continuation of the street be
dedicated or deeded: A 1' strip at the west end of the east-west
stub street a s shown.
5. That appropriate utility easements be indicated on copies of the
approved preliminary plat for distribution to the Planning Department
and the utility companies. Written approval of the easements by the
utiiity company must be received prior to the submittal of the firial
plat.
6. That a certificate of title be furnished the Planning Commission prior
to the filing of the final plat.
7. That the preliminary plat be given conditional approval to April 1, 19 72.
8. That a plan for water facilities adequate for fire protection be
approved by the water supplier and the fire protection district. The
water suppiier will certify that appropriate contractuai arrangements
have been made with the plat sponsor for construction of the water
system prior to filing of the final plat.
