Dear Jim:
There appears to have been some confusion raised in
the last 30 days in regard to the policy of issuance of build-
ing permits in Myron Estates and this letter is issued to clarify
any confusion.
Per John Diffenbacher's letter of Decemb-er 6, 1974
to me which I attach, adequate Pire protection for Myron Estates
No. 2, lst Edition and Myron Estates No. 3 has been provided and
building permits may be issued in those two plats. Following the
execution on Decemb-er 18, 1974 of a Security Agreement which was
acceptable'to the fire district, building permits may be issued
in Myron Estates No. 2. You have a copy of the Security Agree-
ment. According to John Diffenbacher's letter of January 23,
1975 to Mr. Huggins no building permits may be issued in Myron
Estates No. 1 and No. 4. Mr. Diffenbacher's letter mentions,
Myron Estates No. 5 but no approval by the Planning Commission
for Myron Estates No. 5 has been obtained and accordingly no
permits would be issued in any event.

ment.

In talking to John it appears at he will approve

Dear Sir:
We feel t.hat we cannot arprave any f'urther plats in the Myron Estates area
until we have a guarantee that the aystem will be comnleted. The conditions
set down in our letter to Mr. Guthrie on the lst of November, 197h, have only
partially been met ( the installation o£ two fire Y~ydrants and a bond for
Myron Estates # 2).
We feel that there should be a bond agreement for the water system in
Myron Estates # l, !t. and 5 before anything starts taking place as far as building.
The bond will have a c orrcpletion date of not more than one hundred and twenty (120)
days from the time of signing. Or Mr. Guthrie can complete the system in these

Dear Mr. Fergen :
I am in receipt of recent correspondence from tre
Spokane County Fixe Protection District No. 8 in regard
to the failure of Mr. Guthrie to comply with past promises
to install fire hydrants as per Comprehensive Plan No. 3.
a.m also in receipt of a letter of November 12th
from John H. Diffenbaeher, Fire Marshal, that as-of 10:00
a.n1., Saturday, November 9,. 1974, Mr. Guthrie has installed
none of the fire hydrants as per the plan for the fire
protection.
In view of this and what I deem a threat to the
health, safety and welfare Qf the residents in those areas,
I am requesting that your office issue no further building
permits in these plats until the matter of fire safety and
fire protection can be m.ore adequately determined. There-
fore, will you please not issue any more building perriits
to any person in any of the Myron Estates Addition until
further notice from this office.

main in the Myron Estates area, and seeing that the water main is in and is in
the process of being pressure tested, we are willing to release the building per-
mits for ttie Myron Estates area with the following stipulati.ons:
1. That tha fire hydrants (7 of them) shall be placed as per Comprehensive
Plan No. 3, and shall be ready to be tested not later than May 319 1974.
2. That the 6 inch, 8 inch, 10 inch, anci 12 inch water mains, if not
already in, shall be ready to be tested by no later than May 31, 1974.
Followitig is a list of the required hydrant and water main locations triat are to
be in service and ready to be tested by this Fire Department on or before May 31,

Pursuant to our review of your agreement dated February 26, 1974 and also
to our conversation with Mr. Larry Guthrie on February 28, I believe we are
able to state that your agreement satisfies Condition #4 of Mr. Neal's letter
of December 28.
That letter does, however, refer to operational water facilities not just a
portion of the water line. Our concern, of course, is an adequate supply of
water to Myron E state s plats.
If at this time you have completed addiiional work, then please contact the
proper water purveyor and the Health and Fire district authorities so that they
may :elay to us your demonstrated compliance with that part of the work already
completed.

as the first step in our negotiations on the proposed school
site in the Nicholes Estate area, an exact legal descriptier_ ef

Af ter discussing this, we f eel thzt you should have your engir_eEr
designing the area properly define exactly the roads serving tne
area, and submit those plans to Mr. Charles Huggins, Director of
the Spokane County Planning Commission, for approval.
Of course, we.expect to have to make some dedication for roads
and streets surrounding the site, but we would like to have a
net_of ten acxes remaining af ter such dedications. This is re-
quired by the State School Building Department. Requirements are
five acres plus one acre for each 500 children to be housed, thLs
a minimum site will require ten acres net.
