PE-799-71 . w a MINUTES February 18, 1972 ZONE CHANGE Zt-19-72 - AGRICULTURAL SUBURBAN TO RESTRICTED RESIDENTIAL OR SIIVGLE, FAMILY RESIDENTIAL: PLANNING COMMISSION (Marisol Addition) Planning Commission Recommendation: Approve to Sinctle Fami ly Residential (R-1) Zone. A. Reasons: The final plat of Marisol Addition has been filed incorporating 6 suburban lots ranging in size from 8,900 sq.ft. (84'x107') to 10,600 sq.ft. (100'x108'). All of the lots conform to the minimum frontage requiremenfis of the Single Family Residential Zone (R-1) for the establishment of a single family residence. Lots 1 and 2, Block 1, and Lots 1 and 2, Block 4, do nofi meet the area standards of the Single Family Residential Zone; however, the lots would be non-conforming and have enough area to physically accommodate a single family residence. The Planning Commission is of the opfnion that Marisol Addition is appropriate for Single Famiiy Residential zoning because: 1. The lots can physically accommodate a single family residence. The lots have at least 84' of frontage and 107' of depth. The Planning Commission is of tYm e opinion that the lots would be too small to adequately accommodate duplex development. The Planning Commission has been routinely upgrading similar residential plats in the Opportunity Community to the Single Family Residential (R-1) classification. 3. The Single Family Residentfal Zone prohibits duplexes, animal keeping other than household pets, and home occupations. B. General Data: 1. Location: Section 22, Township 25 N. , Range 44,E.W. M. C onditions : 1. That the plat be designed as indicated on the preliminary plat of record and/or attached sheets as noted. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes cf creating additional lots or building site s without filing a replat. 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. That appropriate provision be made that the following described property be held in trust until the continuation of the street be ' dedicated or deeded: A 1' strip at the stub ends of 6th Avenue as proposed. S. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final plat. 6. That a plan for water facilifiies adequate for fire protection be approved by the water supplier and the fire protection district. The water supplier will certify that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system prior to filing of the final plat. 7. That a certificate of title be furnished the Planning Commission prior to the filing of the final plat o 8. That the preliminary plat be given conditional approval to October 1, 1972. 9.
