SEWAGE SYSTEM. Permits are required in all cases by County Resolutions Nos. 45-133 and 47.235.
SET-BACK FROM PROPERTY LINES. In most zones and under most circumstances, a set-back from the front property line, of at
least 25' is required, a 5' side yard, 15' side yard from a flanking street, and a 25' rear yard are required.
STA1E HIGIiWAYS. Where the strvcture abuts a State Highway, clearaace must be obtained pertaining to set-back and ingress
and egress.
COUNTY ROADS. Work on street right-of-way maY not be performed until staked by County itoad Department and Work must be
performed in accordance with stakes. Points of ingress and egress must be approved by the County Engineer.
MOVING OF BUILDING&. A permit is required to move an ezisting building. When a building is moved on a County or State
Nighway, clearance must be obtained from the County Engineer and/or State Highway Department.
ACCESSORY BUILDINGS. Accessory buildings (garages, sheds, etc.) require a separate permit.
RESTRICTIVE COVENANTS. Builders should check provisions of covenants or dedications and easeaents running With the land
which are enPoroeable throug6 civil action. County Officials can not bring action to enforce covenants or dedications.

Dear Commissioner Kopet:
We have investiqated the matter referced to in Mr. Cooney's lettar of
june 16, 1975, to you. As far as we can determine them, the facts of the matter
are as followe:
1) Mr. Platt is the Durchaser of Lot 13, Block 1 of Geil's Park Eatates.
2) On April 19, 1974, a buildfnq permit waa issued to construct a home
upon the lot. The assigned addreas ie S. 2317 April Court. The
owner wa• listed in the pecmit as William Gartett. The contractor
wa s Robert E. Dixon.
3) The Preliminary Plat of Gail's Park Estates was approved and
recommended to the Board of County Commissionera by the Planning
Commiesion on July 13, 1973. The final Plat was approved by the
Board of County Commiesioners on December 6, 1973, and filed in
the County Auditor's offica thet same day. Tha plat conditions
required the atreeta within the plat to be improved to County standards,
which atandards so noL include pavinq or curbinq requicements. On
July 25, 1974, the graveled street Apcil Court was accepted for main-
tenance by the County by resolutian of the Board.
4) The covenants referred to by Mr. Cooney were decslared by the then
ownere of the plat, Robect E. and Gail M. Dixon and Roger M. and
Pearl D. Bayer and filed April 18, 1974. The covenants are entirely
a private contract not required by the Planninq Commission or Board
of County Coramis8ioners and in fact sxecuted several months after
acceptance of the final plat by 3pokane County. Neither the Planning
Commission noc any County agency hae any euthority, much less
responsibility, to enforce 8uch voluntarily imposad privata covenants .

We can only speculate as to whether Mr. Platt has a valid claim under the
cavenants against Mr.Dixan or intermediate owners of the property. Thls is,
however, entirely a civil matter and we would sugqest that Mr. Platt pursue it as
such and that Mr. Cooney be advised, if he is not elready aware, that the
Planning Commission and Spokane County have no authority or responsibility in
the matter.

Z enclose a copy of a letter written to Dixons, et ul. I realize
that the employees of the Planning Commission are overworked, but
j certainly don't agree that they are underpaid. Here is an example
of wliere the Platts bought from the first purchaser, who purchased
('rom Dixon, and sold to the second purchasers, my clients, the
Platts. And they thought that when Dixon did the rest of the
street, he would do their curbs. But when the contracter got to
their curb, he said unh unh, not unless you Pay. So they -paid .
I think I have a good cause of action.against the signers of the
covenant. And fox years n6w owners slgning plats have agreed not
to sell lots until water and sep -Lic tanks are in. In some
instances, paving and curbing. In this instances, why wasn't
the curb in before the house was sold? There must be somebody
that you could question as to why that was not done. I would
appreciate your checking into it for me at your early convenience.

It is rny understanding that P-1r. Dixon was advised by h1r. Sam Angrove, of
the City Park Department, that the entire paving of 23rd P,venue adjoinina
this addition, would be pa.yable on an R.I.D., and on this basis Mr. Dixon
agreed that he arould so pave the street, to standards, and that all of this
uras in consideration of a small tract of land beinq given over to Mr. Dixon
in ot-der- to straighten out 23rd Avenue with the adjoining streets.
Notiv 11r. Dixon has been advised that that half of 23rd Avenue adjoining the
park cannot be financed under an R.I.D. assessment, which imposes a financial
btirden upon Mr. Dixon which he is not willing nor able to assume. Therefore,
he feels that one of the substantial and material conditions for the entire
agreernent has now fai i ed, to hi s detriment.
Ther2fore, I propose, on behalf of Mr. Dixon, that the prior agreement be
abandoned in favor of the following proposal:
f'ir. Dixon pay to the City Park Uepartment the appraised value -11cor
the tract of iand beinq qiven to the subdivision, which our records
indicate would be the amount of $350.00; that the requirements that 23rd
Avenue be paved be withdrawn, and that the road, which has presently
been finished to arade, be accepted "as is."
