14HEREAS, the LAND DEVELOPriENT ACT, RCW 58.19, provides that no
person not exempt under said Act may offer or dispose of any interest in a
development located in this state, nor offer or dispose of in this state
any interest in a development located without this state prior to the time
the development is registered in accordance with said Act;
WHEREAS, land in the above-nameci development has been offered in
the state of Washington through the use of advertising, promotional literature
or sales activity;
WHEREAS, the above-named development has not been granted registra-
tion or exemption as required by said Act;
[,1HEREAS, the Director makes this finding of fact in writing that in
order to avoid irreparable harm to the public interest it should not delay
issuing a Cease, Desist and Refrain Order prohibiting the continuance of any
and all promotion, sales or offering in the state of Washington of the above-
named development;
WHEREAS, the above-named development has violated the provisions and
is subject to the penalties of the LAND DEVELOPMENT ACT OF 1973, RCW 58.19;
NO[J, THEREFORE, IT IS ORDERED, That each of the develupers, owners,
officers, agents and employees of the above-named development Cease, Desist
and Refrain from any further advertising, sales offering, or promotional
activity of the above-named development in the state of Washington until such
time as there is compliance with the provisions of,RCW 58.19 and its-rules and
regulations.
YOU ARE HEREBY NOTIFIED that you have a right to request a formal
hearing bef~re the Director, State of Washington Department of Motor Vehicles,
and you mayappear at the hearing and defend against the accusations of the
above order, personally and by counsel, and may have the sworn testimony of

The final plat of TimberZane Second Addition has bean filzd incorporatinq
16 suburban lots ranging in size. from 11, 700 square feet (90' X 130')
to 15, 700 square feet (100' X 15 7' PJ1 of the suburban lots ar%:~ of
sufficient size and frontage to allow single,- family dzvelopment.
The Planning Commission is of th` opinion that Timbarlane Second
Piddition is appropriate for Single Family Residential zoning because:

Izast 80' of frontage and 10, 000 Square feet of area,
2. Thc: Planning Commission has be~n routinely upgrading similar

3. Thz adjoining arLa has been pZattad and zoned for singla family
rasidenczs on lots with 80' to 110' feet (A frontage. Timberlanu,

Planning Commission Recommendation; ApDrove. sub.iect to the following
conditions:
A. Conditions
1. That the plat be designed as indicated on the preliminary plat
of record and/or attached sheets as noted to provide for interior
lot frontage and eliminate frontage on Saltese and Sullivan
Roads. This plat should also provide for road access to
Sullivan Road. The Staff will work with the Sponsor to solve
these problems.
2. That a statement be placed in the dedication to the effect
that no more than one dwelling structure be vlaced on any one
lot, nor shall any lot be further subdivided for the purnoses
of creating additional lots or building sites without filing
a replat.
3. That the Alat provide for right of way width for streets as
indicated on the preliminary plat of record.
4. That aoprooriate provision be made that the following described
property be held in trust until the continuation of the street
be dedicated or deeded: A 1' striv at the edge of all roads
that terminate at the plat boundary.
5. That avpropriate street names be indicated.
6. That appropriate utility easements be indicated on copies of
the approved preliminary plat for distribution to the Planning
Department and the utility comAanies. Written approval of the
easements by the utility company must be received prior to
the submittal of the final plat.
7. That a plan for water facilities adequate for fire nrotection
be approved by the water suoplier and the fire protection district.
The water supplier will certify that anprooriate contractual
arrangements have been made with the olat sAOnsor for construc-
tion of the water system prior to filing of the final nlat.
8: That a certificate of title be furnished the Planning Commission
prior to the filing of the final plat.
• 9. That the preliminary plat be given conditional approval to
May 1, 19?3•
10. That streets be improved to standards established by Spokane
County, or a bond to cover the cost of such imvrovements be
furnished the County Engineer in the amount as determined
by the County Engineer.

11. That profiles of streets, nroposed grades, and drainage vlan
of the plat be submitted ancl aporoved by the County Engineer
before the final olat is dratim. mhe County Engineer may require

12. Conditional apvroval of the vl?t is given subject to dedication
of the right of way to the oubl ic and approval of the road
system in the nlat by the County Engineer.
13, That a name be indicated before the final nlat is filed; such
name to be auproved by the County Assessor. •
14. That a statement be nlaced in the dedication to the effect
that a Dublic water system, accentable to County and State
Health authorities will be made available for the plat and
individual service nrovided to each 1ot prior to sale of
lots.
