Planning Commi s sion Recommendation: Approve to Sinqle Familv
Residential (R-1) Zone.
A. Reasons;
The final plat of Craig Subdivision has been filed incorporating
22 suburban lots ranging in size from 10, 600 square feet
(81' X 132') to 11,250 square feet (90` y. 125'). All of the
suburban lots are of sufficient size and frontage to allow single
family development,
The Planning Commission is of the opinion that Craig Subdivision
is appropriata for Single Family Residential zoning because;
1. The 27 lots in the plat have been designed to accommodate
single family re sidence s; i. e., all of the lots have at laaasfi
80' of frontagE and 125' of eiepth.
2. The Planning Commission has been routinely upgrading
similar re sidential plats in the Vera and Opportunity
communitie s to the Singls Family Re sidential Zonc:.
3. The Planning Commission is of the opinion that none of the
lots within the subdivision have disadvantaged relationahips
wnich would warrant duplex zoning.
4. The Single Family Re sf dential Zone prohibits duplexe s, animal
keeping other than hous,3hold pets, mobile homes, and home
occupations.

Frogress on 12th, - north of 12th. It would be right here. It is = as you can see

east. Sullfvan is approximately 1/4 mile,to the east of it. There are higher
derisity plats approaching it. We did have some minor problems with i-t when we -

HERMAN: I would first like to apologize~ to the Planning Commission that T sent
my people fio the wrong room. I was - they were aware that I would not be able

to be here on, time because I was'ri't brought into tliis,until yesterday and other
commitments, and as a result when there was asked i•f there was any objection,
of course, fihere wasn''t any because they were in the wrong pla'ce w.aitfng for me;
so I apologize to, the Planning Commission and 'to Mr. Tupper for the appearance
of no, one being here in opposition, but there is a great deal of opposition and the
oppositibn basically revolve's around the current quality of life in the area and the
current existing zoning, that of being agricultural area. You can tell from the map
down here betweeri Sullivan and 12th Avenue - this en#ire area here i,s all
Agriculture. Now the land "already- in the- area there = in fact people w'ho ~are
makfng use of such a zone . People that T repre'sent live on a, minimum of, a half-
acre tract and most of them are an acre and orie -half to 5 to ~ 10 acre s, and two of
the people that are directly affected live here and here. Between the two of them
they have 3 acres tog,ether. Locafied on that particular- 3 acre tract right here
in tliis corner is a barn. Located on this tract is a barn. Now on this particular
tract across the -stree,fi we h'ave another large barn and feeding lot. These people
u'se this for pasture. They have cows and other livestock, the same as this piece
of proper.ty. This property- has several livestock and they use this as a feeding
area and thep have a very medium-sized bar•n,'. This ,area is, all used for pasture
and hay. Therer fs some 12 cattle here. This per-son who,lives here uses. this as
grazing land, and he has animals also.
So with the direct and immediate stretch to the present zoning and the
pre`sent use of the property as we- are going to see is a real serious conflict with
a high density residential area being placed right in the middle of, a now very
large, of an area that is very largely agricultural that uses extensive, that is

extensively used a's agricultural, as, an, agricultural area. I can see a problem with'
the uses permitted in an Agricultural area wherein under 4. 05.080 of the code,
Zoning Ordinance of Spokane County, wherein, it state's that an occupant or resident
may keep or maintain primarily lor his own personal use, and tYiis is on Agricultural
la'nd, animals and fowl on-premises of his dwelling as, follows: (except.tYiat any
building housing animals or fowl, yard's, or,runway, s, shall not be le s s than 50
feet from,any dwelling other -th'an the dwelling of the owner). Now, if we are not
within 50 feet, we are, very, very close. The proposed site here would have homes
facing on l lth, the proposed l lth,Avenue , They would be' looking straight at a
barn located in this corner of the property and pasture -that has animals on it. This
proposed site would be within 50 fee"t of this barn. These houses here. A barn
here and a barn here. This proposed,, I would imagine the plat shows the homes -
as indicated across here and across here, right across the street,from these
particular home s is another very large barn and feeding yard.
So,we have at once a p'otential and serious threat to the use that exists
there now, has exaisted for a long period of time - in that I can see on a nice
warm Valley,evening the, aroma from. the feeding,yard and from the different barns
that trailing off into the adjacent residential area., and I tcan see plenty of problems
that are being created- a.nd these problems are threatening the existing uses there
and, people that have been there for a great deal of time And are using the present
zone.
So what we have here by leapfrog afitempt to, rezone or spot zone an
already Agricultural area, whfch I am f,ully,awar,e on the Comprehensive Plan of the
County is projected to be residential, we are taking and putting a 22, unit subdivision

adjacent to pastures, barns, and farming areas that are~ going to cause serious
conflicts . it might even cause an existing, well might, I am sure that 'this barn
will then, become in violation, this barn will then. become fn viola'tion of the code
or at least there is, an argument tliere for it to happeri. Sure it is a non-conforming
use but we are still going "to have. the difficulty. Thi,s is, you know, & real thre.at
-fo the people and those people that I named as to their qualify of life and the
reason that they bought.3n thi,s area and the reason they, are using their land that
way because -they want those animals and they want to live that~ way, and now we
have a residential site that is going to be directly in conflict with that .particular
use that is in, existence there now.
So-we are _basically coricerned with the quality of life of those people that
are alreadg living in,the area and they appreciafe the fact that that area is ;going
to be developed, they appreciate the fact that depending on the type of develop-
merit in the area thafi their property is efther going, to increase or decrease in
,evaluation. More than ;the gr.eat objections to this particular plat is the fact that
the lot size is small. It is placing a-re sidential development in an, otherwise 1'ow
density area, changing the complete character of the area without any hesitation.

I can see that. You can see that from• the picture om your left, and they object to
the residents there, object to such, high density. They think that the lots should
be larger because of the,fact that whenever you put this type of development in
surrounding their property that you are necessarily forcing a certain type of standard
upon their property. Their proj'ected use,s and thefr projected futur"e development
is going to be directly,concerned with the size of the lots in fihe area, and they
feel that such a development would actually devalue their property,in these areas

because they are forcing a type of a residential area-that they are not in favor of,
that is contrary to the area; it is very, very Yli.gh density in an otherwise low
demsity area. I might point out that, one of the persons I repre sent owns large
tracts of land -in here, and he has subdivided it into 5 acre tracts, trying to main-
tain the, you, know, trying to maintain the ekisting uses and trying not to violate
the condition and the life particularl-y in this particular area.
O. K. , now as far as that being the best and highest use of thi's property,
one of Ahe things, I would like to p_oint out to, the Planning C.ommission is on the
edge of the property is. a very high ridge that runs all the l,ength, of the Valley.
Theze particular- lots, -right here are actually view lots. They oversee the re st- of
the Valley. The proposed plat;doe,sn't even take advantage of the view that's
there. The have the lofis there fronting, on the street with the beatufil view of the
entire Valley arid the mountains across the Valley nofi even being taken• adv.antage
of. It's, no't a real advantageous use. of that particular property because it all drops _right straight out below it and could be platted reasonably on a larger area, and the
hornes could be turned in such-a way as to take advantage of it. But this doesn't
even, take advantage of the guide to the land that's there. It 'is very valuable land,
-it could be used ,properly, it could be developed properiy. . The people in the area
feel that this partiour,ar developmerit and i feel myself this doe,sn't ~make use of the
value of the land there and its attribute s on the fine st part of the property as far
as frorri residential purposes we haYe got to put a road. The County needs', a road
in -there to continue the development.
Now all through the Valley this particular ridge,has had developed homes
built on, it, they are large home s, they are spiit level horrie s, taking advantage of
thi s particul ar ridge.. That i s not going to 'be- done in,thi s area. You have a; road

on the ridge naw. It is afteeting the quality ofi i:he land. The person that lives
here nsi.ghbaaring this property, this property runs a.2I the way to the back a.nd this
parti.cular proposed plat woulri enforce a road on the most valuable piece of his
property, %f he wanted to pYace his home there an the view edge af the property.
It is r~ally affecting his property to a very large degree i.n that he has a praposed
right of way right where he would put Iis house, and that is the reason he bought
out there so he could have the acreage, he could put a ruce home on the progerty
and now next to hi.m in the area in which he ,uvouid most 1ikely put hi.s home, he
wauld have a road runnirig thraugh it.
So there is a l.ot of things to be said abaut that particular plat, but I dan.'t
think that thts particulac' design makes the hiJhf:5t 115E: of the property. It pre -
conditions a road in an area where the homes should be lacated. It locks in the
nefghbaring 3and owner who owns that whole strip from 12th Avenue to the back o€ tliis
property i.nto a condi ti4n that he doesn`t want to build hi.s house here and have a
raad zight in frant of it. He wants to take advantage af that hiliside and have the
vievv,
"There are a lat of ather objecions of this type. The praperty all araund
there now h.as a view of the mountains. On thase srnall plats of Iand, on those
sma21 lats, are necessarfly probably going to be, I ann not sure of this, but this
would be my argument, are going to be those 2 stary hauses because of the zoning
required 65°l0 of the property to be open, they are going to cut the view of the
peaple surroundi ng that property off frflm the view fihat they already have of the
mauntains acrass the Valley, whereas if the plats were larger they could bujild
ranch type homes and they would not reduce the view of the property. So the

to know tlieir -feelings, about it, arid shortly that -is all I have to 'say. There are

There was a meeting, last night of all the people of the name's I have read-
off. . Included, in that meeting ~was ,the present owner of the property who told, the
people at the meeting, and I have been told this, this is more or less heresay,
there are other people to confirm that, ttiat he did not intend this to be the use
of the property when he sold it ,and Yie himself felt that the small lots was not the
proper use of the property. He was here earlfer. He has gone home riow. . I.
don't know whether he has returned as of yet, but that i"s h'is general feeling of
the area,, and he was here this morning earlier prepared, I have 'been, told, to make
that statement. That is the only statement I have now at this time. Maybe some-
body else would like to -s,ay more.

BATES: My name,is Silas Bates. I live on~ East 15306 - 12th Avenue. Our main
objection to, the plat is that it doesn't take into,consideration the surrounding
area. It's a plat that's being proposed by someone who live,s outside the area and

who could care les s about what's happening to us. We have no doubt in our minds

after talking this over last, night that the plat-is legal. Our question-f,or the
Planning Coznmission is wliether ar -not it is a moral thing, to do,. Russ Adams, the
fellow who owns that land graciously came to our meeting last night, a prote st
meEti.ng, and spent quite a little tirtie with us. He ~,is a neighbor. He is a friend.
He never intended to sell this land in this manner. We h:ave two rrleinbers of our
group now who have gone back to get Rus s. If he had been here when earlier this
morni.ng, we had asked hfm to come to the meeting to collaborate this feeling, this
thought. Not only him but ourselves were. being used by an outsider to come in and
put in ZOning that is not -needed in the are'a. It is zoning that is detrimental to
us and it i's Zoning thafi the seller, clid not infiend, and -we are all at pretty much at
a los`s to know what to do about it really. We are placing ourselves in I suppose,
your mercy to see that this thi.ng is handled in a manner that is moral and not
strictly handled on a legal basis. We realize that the plat is legal.
We also realize that this same builder has put up, a row of 2 story houses
on very small lots, minirrium size lots ~in this area, which again are on the rise of
,the hfll and overshadow, the en'tire area. They, stick up like"sore thumbs"out there.
'They bought this piece of ground and -zoned this. He has also buflt a subdivision
over here - they happen to be Gover-nment subsidized homes with the backs of the
lots all out to the street. 1Vone of the lawns, have e,ver been put in. I suppose
.from my o,wn feeiing I arn protesting the reputation of the subdivider as much as
anything. There is no. need i-n this area to build homes to a minimum standard.
The homes we fiave out there are not to a minimum standard. We live on acreages.
Van Hees, the `fellow that owns tract 167, sold off a good' shae,of hfs property
,around there and he sold in acre tracts, 5 acres primarily, and he did this at t-he urging

of his neighbors. Russ Adams recently is, about 8' months ago, h'ad promised
Mr. Yancy who lives now on Main, who bought this piece of property from Irene
Toll that he would never subdivide this~ property. On the basis' of this statement
Yancy bought this land. Now Irene Toll had two offers - one from Atvin j., Wolff
fio, subdivide this property shich she ,refus.ed, she refused the offer. Don Friske
who Iive s on thi s tracfi af ground wanted to buy it. He i s aI s o a builder and he
wanted to subdivide it, and again Irene Toll refused and it was with the under-
standing that Adams would not break up his Iand. But yet last night he told us a
story of a'bout haw he was approached by this buflder who wanted some .land for
his• Father to raise - initially,it started out to raise some onions and then he said
he might build some 4 or 5 homes on ~the corner 3nd then he was told that the homes
would be in the $24, 000 to $25, 000 cla's's'. Now it is, quite obvious to us that you
aren't going to build homes like that on lots that are in the size of 70 feet, 85;
'shaliow, lots oniy 125 feet in depth. Thfs doesn't command $2'5, 000 home. Yet everyone in, the area ha& been there for years. Legally I'don't know th'at we hava
any- ground, but we have a situat3on here that we -feel must be brought before you

BATES (cont'd. then Adams would be relfeved from his responsibility to the
bui.ider, and it was agreed among the group that we would buy this property, at the
-same iprice that Adams has offered ifi .for sale to the builder. A,nd we want to ma'ke
that a matter of public record that we will buy thi.s property at the same price that
the, builder is offering now and if - we had hoped that Mr. Adams would make his
statement here today that he -would concur with us, thafi he is not in favor of selling,
his propert.y under this scheme. And, of course, if he did, this would, add
substance to our clai-m,,and we would hope that the Planning Commission would

the zone change., and hence release Adams ha.s obligation to sell because there is

SCHADEGG: From the point I thought `that the representative wa's trying to make,
that while as far as the subdivision and zoning is, concerned, they don't have much to stand on as he saw it at-least. What this wouid do would be to subject
the neighibors to nuisances ff"nothfng else eventually because as it got filled up.
Either that or you would have people who wouldn't take care of anything but it
bofihers me a little bifi in an area so clasely surrounded and especially when it
,appears as so you wouldn'fi have a,man to certify it that getting out of the agree-
ment, although they did say they would buy the land and mzintain it. It is one
#hing we come up against' in the Agricultural Zone all of the time.
QUAGKENBUSH: It is the typical example of moving.
SCHADEGG: It is a minor leapfrogging. There are two or three,other places in
the general vicfnit'y that have high,,densifiy development but the substantial amount
of ifi is a radius of a half mile to the ,east .
QUACKENBUSH: Isn''t there a Iarqer scale,land use map?
HtTGGINS: john,,could you go get the north and south half sections then of the
regular land use map.

STFtAVENS: It f s located right here, Bud. It 'is immediately on the edge,of a high
density. As you can see from the land use map, the plats are approaching this
area. We have approved .plats within, well this i's one+ialf mile from here. You
know, we are talking about between this plat and the nearest, you might say high
density subdivision -these are building site lots, it is anather 1/4 mi].'e, 1/2 mile.
SCHADEGG: It f s the same situation,that you've got in California and over this
general drea and other Iocations~ where~ the subdivisions are creeping in on them,
and you,are going to be forced out because of the objections of the nefghboirs to
this activity to.,be considered first but there were more,of them. It is the same
thing taking place again. When. they control the land, why Actually the
deyeloper doesn't have anything signi-ficantly committed apparently. If the thing
doesn't go, lets him out of his ,contract. T-his we don'fi know -for sure except by
mere s ay- s,o .
HUGGINS: Frank, it is kind of nice for the seller to both be able to sell the
ground and then also maintain tha't thafi wasn't really what he had -in mind.

MRS. RAWLINGS: But.this sounded rather logical when the buyer said he wanted
to have his' Fa'ther raise something or other, didn't it?,

purpose, he could have sold it conditional upon a certain density of ,s,ubdivisi,on.

different metes' and bounds propertie's and they vary from 1 to 3 acres.

HUGGINS: These are 80 and 85 foot lots. This is a small subdivision in the area.
These are =78, foot lots; the,se are 98.'5 foot lot s; Down here we have 100 foot lots.
Over here we have_ 76 foot lots. One thing that disturbs me a little bit is, your
inclination, is to.deny the plat, is that I w,onder if it fsn't in reaction "to the
particular presentatiori. The reason I say this is that_there was no such re'action
and, consequently, no such decline to approve on the other plats, of a smilar nature.
'CO.OK: When w,ere these done ?
HUGGINS j Well, various time.s.
MRS. RAWLINGS: Is that the AdaYns School there?
HU'GGINS: Yes, this is 'the Adams School. Thi.s particula~r squar,e mile has been
id'entiffed in the Comprehensive Plan as a Neighborhood and very early required
thf,s 10 acres for the el'ementary s_chool in the center of it.
COOK: Wa'sn,'t it.-though just in the last 4 or- 5 mon'ths before we became concerned
about,high density development out i-n farm areas

HUGGINS': No. But every month, if you will recall., we are getting from 5 to 8 just
such plats as, this in the center ,part of the Valley.
COOK: Haven't we turned down several lately?
HUGGINS: No,.

CO'OK: Because of high density lot size. I think we have in the last 2 or 3 in tlie
last three months.
MRS. RAWLINGS: I fihink he is: reterring to the area -around Barker Road Where we
,asked the plot si ze s be made larger.
HUGGINS: I would not be at all concerned if what you are saying is we ought-to
- a'gain review the proposed densities that the prese'nt plan calls for in this central
part-of the Valley, but what bothers me is, frankly, is that your reaction is
selective. There is no reaction unless there is an objection. :And the objecfiions
are often,more emotional than realistic, I frankly think.
COOK; The 235 appears too.
H`UGGTNS: Yes, that is right a'nd that is a side issue,as far as your ability to
respond.
COOK: O'f course, our lot size dictates what goes on the property. If we req•uire
one acre lots, you aren't going to, see 2 35's going in.
HUGGINS: Then you see F. H.A, subsidized hou'sing in the same value class.
COOK: You just see different ibuyers.
HUGGINS: But you know you see.
COOK: I have been through the 235 houses and they aren't all fihat way. A Iot

Also T think perhaps it is wise for you to take a look at the densifiy consideratfons.

have a complete solid density and then break into some less density and alternate

QUACKENBUSH; It seems to me this is a natural progression though of a neighbar-
hood.
SC HADEGG:- Well one point of view it i s, Bud.
HU,GG INS : It i s a s far as thi s s quare mile i s concerned. It i s an area that had
been, planned as an urban neighborhood wfth density, now I am recalling, you
know, and,this is a long time ago, but I would guess thaf the density called for
in the Plan for this neighborhood range's betw,een 2 and 2. 5, homes `to the acre.
Now I am not saying that is' right or appropriate. All 'I am sayfng is thafi is the
Plain we do currently have. There has n'ot been refusal,upon perhaps a dozen,pla'ts
in this neighborhood and I would hate to see a refusal based simply,on the, occasions
where objections materializ,e.
_QUACKENBUSH: You are going to have the same objections in alI future plats
because the only'place they can go is into the Agricultural area. The surrounding.
Iand use has to be agricultural.

HUGGINS: The zoning is,sue,is a misnomer all to#ether. We talked about spot
zoning. Heavens~, if this is zoned Single Family Residential, as we would
recommend, I pres,ume, the density, the lot si-zes would be required to be considerably
larger than they are in 'the Agricultural Zone,as far as that is concerned.
MRS. RAWLINGS: We have maved into -sort of- a fuzzy area where we see that we
want to reta3n some kind of afimdspliere tliere, but yet `we are not looking at it as
a total pictur,e and making our decisions under some established criteria.
HUGGINS: Right. It is just not fair because a group of immediately surrounding
re,sidents say that we have a certain atmosphere here because we bought metes
and bounds parcels of from 1-to. 3 acres , to say "no" to someone who wants to
subd'ivide, when within 1, 040 feet in most,directions subdivisions have been
approved at a similar density.
