Will you please make or cause to be made an appraisal of the
40-foot wide canal right of dvay (referred to as parcel No.2 )
vthich crosses the parcel of land referred to as parcel No. 1
in the enclosed copy of the "Certificate to Plat" issued by
Transamerica Title Insurance Compan,y under order No. 60936-M
pertaining to the proposed plat of De4litt Ileights.
This appraisal is requested pursuant to and in order for us
to comply with RCW 57.90.100, a copy of which is enclosed
for your convenience. The owners of Parcel No. 1 desire to
acquire the right of way in order to complete their plat. The
d i strict i swi 11 i ng to convey the ri ght of way provi ded i t
receives its fair market value. The district paid a cash
consideration a number of years ago for this vrho1e length
of canal right of way and owns the sa►ne in fee simple. If
RCW 57.90,100 did not exist which requires th,e appraisal to
be by the county assessor, the district under these circumstances
would be having a private appraisal made and then calling for
bids, giving the abutting owner the opportunity to bid.
I gather that the owner'is desirous of clearing this up in the
near future and_ it tivould be appreciated if you vrould make your
appraisal as soon as reasonably convenient.
The statute as it now reads doesn't make separate provision for
purchase price of the property to include the district's costs
in making the ronveyance. For example, in this instance in order
to make the conveyance it will be necessary for me as attorney for
the district in dissolution to petition the Superior Caurt and
obtain a court order in order to authorize the conveyance after
we receive the appraisal from you. I mention this so that you
wi11 be aware of the fiact that costs of conveyance are a factor
to take into account in arriving at the fair market value of this
parcel.

PRELIMINARY SUBDIVISION

Planning Commission Recommendation: Approve. sub.iect to the followin.g
conditions:
A. Conditions:
1. That the plat be designed as indicated on the preliminary plat
of record and/or attached sheets as noted.
2. That a statement be placed in the dedicat~on to the effect that
no more than one dwelling structure be placed on ar~y one lot,
nor shall any lot be further subdivided for the nurvoses of
creating additional lots or building sites without filing a
replat.
3. That the Dlat provide for right of way width for streets as
indicated on the preliminary plat of record.
4. That aDpropriate nrovision be made that the following described
property be held in trust until the continuation of the street
be dedicated or deeded: A 1' strip at the ends or edges of all
streets that terminate or border the plat boundary.
5. That appropriate street names be indicated.
6. That appropriate utility easements be indicated on copies of the
approved preliminary plat for distribution to the Planning Depart-
ment and the utility companies. written approval of the easements
by the utility company must be received prior to the submittal
of the f inal plat.
7. That a plan for water facilities adequate for fire Drotection be
approved by the water supplier and the fire protection district.
The water supplier will certify that appropriate contractual
arrangements have been made with the plat sponsor for construction
of the water system prior to filing of the final plat.
8. That a certificate of title be furnished the Planning Commission
prior to the filing of the final olat.
9. That the preliminary plat be given conditional anproval to
June 1, 1973•
10. That streets be improved to standards established by Spokane County,
or a bond to cover the cost of such improvements be furnished
the County Engineer in the amount as determined by the County
Engineer.

11. That profiles of streets, proposed grades, and drainage plan of
the plat be submitted and aDproved by the County Engineer before
the final plat is drawn. The County Engineer may require that
design of drainage improvements for the entire plat be made by
a registered civil engineer.
12. Conditional approval of the plat is given subject to dedication
of the right of way to the public and approval of the road system
in the plat by the County Engineer.
13. That a name be indicated before the final plat is filed; such
name to be approved by the County Assessor.
14. That percolation and/or soil classification tests be submitted
as required by the County Health Officer. Subdivider is not
authorized to have the final plat drawn until the County Health
Officer certifies in writing that lot sizes, soil porosity, and
topograp2~y are such as to reasonably expeet on-site sewage systems
to be workable and not injurious to water strata used for potab].e
water wells or springs.
15. That a statement be vlaced in the dedication to the effect that
a public water system, acceptable to County and State Health
authorities will be made available for the plat and individual
service provided to each lot prior to sale of lots.
B. Reason for Approval:
The Commission felt that in light of their previous actions regard-
ing plats in this area that this proposal was not inconsistent. The
area has been planned for residential development and the lot sizes
are not incompatible with lot sizes apnroved in previous Dlats in
the immediate area.

Beginning 20 feet Worth and 20 feet East of
the W 1/4 corner of Section 13; thence S 89°51'E along the North
line of Broadway a distance of 39130 feet to the true point of

thence SEly along Interstate 90 right of way a distance of 522
feet; thenee S 002VW to the North line of Broadway; thence along
said North line a distance of 518.08 feet to the true point of
