Dear Mr. Owen:
I am writing in response to your letter dated January 14, 2008 requesting information
about the non -conforming status of a duplex located on the above referenced parcel. I
have reviewed the building file and below you will find details about all building permits
on file for this residence:
8/12/83- Residence w/garage
5/3/89- Patio Cover
10/1/92- Sewer Connection
6/21/95- 28 X 40 2 -story garage
6/21/95- Sewer connection for future bathroom in garage
As you can see, there are no permits on record for the construction of a second dwelling
unit on this lot. Chapter 19.20.060 of the City of Spokane Valley Uniform Development
Code defines a legal non-confolluing use as:
a. Any use, which does not conform with the present regulations of the zoning
district in which it is located shall be deemed a non-confomiing use if it was
in existence and in continuous and lawful operation prior to the adoption of
these regulations;
b. Any permanent structure in existence and lawfully constructed at the time of
any amendment to this Code, which by such amendment is placed in a district
wherein it is not otherwise permitted and has since been in regular and
continuous use;
c. Any permanent structure lawfully used or constructed that was in existence at
the time of annexation into the City and which has since been in regular and
continuous use.....
Because there are no permits on record for the construction of a second dwelling unit, this
structure does not qualify as a legal non -conforming structure. The property is currently
zoned R-3, Single Family Residential. The R-3 zone permits duplexes with a minimum
lot size of 20,000 square feet. In order to make the lot/existing structures conforming, the
owner must obtain permits and land use approval for the second structure and request an
administrative exception for the lot size.
If the current property owner can provide evidence that a building permit was issued for
the second unit, city staff will be happy to review it. In the meantime, the second
residential unit is not legal.

I am in the process of purchasing the above mentioned property. I am purchasing it as a
multi -family unit property. It is my understanding that it is non -conforming as a multi-
family unit. I am requesting verification that I can continue to rent it as two separate
units. This consists of the main house as a 2 bedroom, one bath unit plus a one car
attached garage and the second unit which consists of 3 bedrooms and one bath plus a 3
car attached garage.
It is my understanding that the City of Spokane Valley can provide a Zoning Letter that
will allow me to continue to rent out these two units.
