Planning Commission Recommendation Approve, subject to the followinq
conditions
A Conditions
1 That the plat be redesigned as indicated on the preliminary plat of
record to increase the lot sizes as shown
2 That a statement be placed in the ded3cation to the effect that no
more than one mobile home unit be placed on any one lot, nor
shall any lot be further subdYVided for the purposes of creating
additional lots or buildfng sites without filing a replat
3 That the plat provide a S 0' -0" rignt of way width for streets, with
a minimum radius at street corners of 20'-0" The plat will also
provide for additional right of way on Tschirley Road and 3rd
Avenue as noted,

Planninq Commission Recommendation Approve for the followinq reasons
A Reasons
1, The Comprehensive Plan indicates low density resfdential use of the
property in question, and the applicant's proposal is in keeping with
the Plan as he proposes to develop the subject 15 acre tract into
63 lots (7,400 sq o ft, each) for mobile homes On the agenda for
thi.s hearing the applicant has filed a prelfminary plat, "Apple
Valley Estates" which delineates a proposed arrangement of lots
and streets, The Planning Commission recommends, however, an
increase in lot size with some redesign of the street system as
noted in the conditions attached to the preliminary plat (PE-694-69)
2. Surrounding land use is predominantly residential with the Chicago,
Niilwaukee, St Paul Railroad forming a portion of the north boundary
to the proposed mobile home plat. To the east three single family
residences are located, with a trailer court located at the southeast
corner of Tschirley Road and the Applewayo To the south one
residence and large open fields are located, and to the west, open
fields are located wftn no development to date
3 Surrounding zoning is as follows to the north and northeast -
Transient Living, to the east - Agricultural, to the south -
Agricultural, and to the west - Agricultural.
4 Property owners and legal counsel appeared before the Planning
Commi s sion in opposition to the proposed mobile home plat becau se
of possible devaluation of their surrounding properties and because,
fn their opinion, the development would tend to change the rural
residential character of the area The Planning Commission finds,
however, that the site in question i s adjacent to an exi sting mobile
home park and to zoning which would permit mobile homes
5. There has been demonstrated a substantxal need for mobile home
sites in recent years which warrants consideration of additional
land being classified to satisfy that needa

1 TERMo These covenants are to run with the land and shall
be binding on all parties and all persons claiming under them for
a period of thirty-five (35) years from the date these covenants ar2
recorded, and after which time said covenants shall be automatically
extended for successivz periads of ten (10) years unless an instru-

single mobile home shall be permitted on each of said lots ana said
mobil homss shall be manufactured by a nationally known manufactur-
ing firm or otherwise approved by the Control Committee As apuur-
tent and incidental to the residential use of any mobil home a paLio,
canopy and one single or double cetached garage or ear port, archi-
tecturally in harmony with and of permanent structure rnay be erected
on said lot, subject to the limitations herein The owner of any lot,
once construction of a patio, canopy or detached garage or car port
is commenced shall, within ninety (90) days thereafter, have the
patio, canopy, garage or car port completed, and in the case of a
garage or car port shall have the exterior completely
finished and all necessary painting or staining completed Only
tjro sizes of garages or car ports shall be permitted on any lot,
namely 24' x 26' or 18' x 26' The roof pitch on any garage or
car port shall be the same pitch as that of the mobile home located
on the lot and shall in no event exceed 2/12 pitch Plans and spe-
cifications for such improvements shall be submitted to the Control
Committee and approved as providzd in paragraph 6 hereof No mobile
home less than 12 feet in width and 50 feet in length shall be per-
mitted on any lot
5 ARCHITECTURAL CONTROL A1o building or structure shall be
erected, placed, permitted or altered on any lot until the construc-
tion plans and epecifications and a plan ahowing the location of the
structure on the lot has been approved by the Control Corlmittee as
to quality and worlQnanship and materials, harmony of exterior aesign

q uired in these covenants shall be in writing In the event the com-
mittee or its designated representative fails to approve or disapprove
within thirty (30) days after plans and specificatians have been
submitted to it or if, in any event, no suit to enjoin the construc-
t ion has been commended prior to the completion thereof, approval
will not be required and the related covenants shall be deemed to
have been fully complied with
7 NUISANCES AND RULES No noxious or offensive activlties
shall be carried on upon any lo t nor shall anything be done therEOn
which may be or may be come an annoyance or nuisance to the ne igh-
borhood All occupants of mobile homes in said addition shall sub-
ject to Yreekly garbage service from a commercial garbage collection
service in the Spokane Valley Area anci shall at no time allow garbage
to accumulate or collect in the area In addition thereto, all own-
ers of property situated within this plat must conform to suCh reason-
able rules and regulations as the Control Committee may fro;n time to
time adopt for the proteetion, comfort and convenience of the re-
sidents therein
8 TEMPORARY STRUCTURES hTo structures of any temparary charao-
ter, basement, tent, shack, garage, barn vr o ~her structure or
building shall be placed or permitted on any lo~ at any time as a
residence, either temporarily or permanently

and to exclude from the remaining portion of the addition owners
and occupants with children and pets Accordingly, owners and oc-
cupants jvith children and pets ahall be permitted only in lots 1
through 5 inclusive in block l, and all of block 3 and 4 0f the sub-
division PROVIDED9 HOWEVER, that petv shall be restricted to one
cat and one dog of miniature breed or conibina vion thereof (not ex-
ceeding 12 pounds in weight) on each lot in the- portion of the sub-
division where pets are permitted PROVIDED FURTHER, HOtiJEVER, Lha t
any dog shall be penned or on leash In the event of a violation
of this re`triction and failure to comply with the same after thirty
(30) days written motice from the Control Committee, the owner of
said dog shall remove the animal from the area
12 SIGNS No signs of any kind shall be displayed to the
public view on any lot without the approval of the Control Comrnittee e
13 CHANGE OF RESTRICTIONS The subdivider reserves the right
to change or cancel any or all of these restrictions, if in 3ts
