community size shoppinq center site for the northwest corner of East 32nd
Avenue and Secondary State Highway No 27 Said shopping center site
is proposed to be incorporated in the "Hill View Estates" preliminary sub-
division as contained in the Planning Commission's March 27, 1969

accordance with the Spokane County Enqineer's propasal for the wideninq of
Mansfield Avenue
A Reasons
The Planning Commission formerly approved the subject zone change
proposal, ZE-27-69, subject to the dedication of a fiftaen foot strip
of land along the northern portion of the applicant's property adjacent
to Mansfield Avenue at their May 29 , 19 69 , hearing o
The applicant has sfnce submitted a letter stattng his reque st to
provide additional road rlght of way along the north side of Ufansfield
1lvenue in lieu of tha fifteen feet off of his property He apparently
has the consent of the property owners along the north side of Mans-
ffeld and wishes to make this arrangement in order to protect existing
buildings along the south side of Mansfield Avenue
The Planning Commis sion concurs with the applicant's reque st provided
that such road right of way realignment be approved by the Spokane
County Engineer's Office,

1, Conditional approval is given subject to a change in the
Comprehensive Plan that would permit the commercial and high
density residential uses anta,cipated in this proposal and remove ,
from the Plan the establishment of such uses in an area zoned

2. That the s-Laff of the Pl.anning Commission and Engineer's Office
be allowed to work with the sponsor to solve minor design changes
indicated on the preliminary plat of record and if neces sary, to
adjust road alignments to achieve adequate drainage required for
installatton of a gravity sewer system, and also to determine what
separate portions of the preliminary will be accepted as final plats

On August 28, 1969, in a meeting at the court house, you requested
that we write you a reply to what perhaps seems to you to be a simple
question The inquiry was, raill the State Department of Health, which
has indicated that it could not approve a developer as an operating
entity for a sewerage system, approve the same developer as an operating
entity for a public water system?

The simplest answer which we can give is to say that the State
Department of Health has done so in the past This very simple answer
probably fails completely to illustrate the complexities of the question
as we see it
We would be greatly interested in details of the proposal as it
concerns the permanence of the organization, and the assurances of
permanence, the type of an operating entity which would be set up,
whether or not it would be under the jurisdiction of the State Department
~ of Utilities and Transportation, whether service is already available to
, the area from established entities, and a host of similar items These
could a11 be better provided by you than guessed by me If we realized
that the entire effort is directed toward the protection of the potential
purchasers, of lots in your subdivision and their neighbors, and not toward
either you or our department, you could perhaps almost answer your own
question
~ You should also realize that should you, following the approval of
a water utility, attempt to organize also as a sewer utility, all facets
of your proposal would have to be re-examined in this light SLnce the
effect of inadequate operation of a sewer utility could presumably have a
~
' greater effect on neighboring developments than could the inadequate oper-
ation of a water utility9 the review couldl be even more stringent

with this in mind, we have no objections to the zono change. .
Zone Change ZN-13-69 is located on the east side of SR 395, just north of Graves ,
Rogd. With the buildup of traffic on this highway, it would be in the interest '
of safety if there were one epproach to the highway f rom this property and an •
approach to the County Road on the south f or access. The current residential use
has two appraechea to the Stete Highway. We would have no objection to zone
change if this were reduced to one approach.
