Dear Mr, Austin;
In regards to your caretakers residence, permit #CUE -62-77A, the
permit has expired and will need to be renewed. In order to renew the
permit, please submit a detailed explanation of the continued need for
the temporary use and please submit a $10.00 renewal fee.
Following receipt of these items and an on-site inspection a
determination will be made as to whether the temporary use should be
extended an additional year.

ZONING ADJUSTOR DECISION: To approve, for the following reasons end subject to
the following conditions:
A. REASONS:
1. The applicant was able to demonstrete to the saisE3ction of the Zoning
Adlustoc the need for a mobile home as residence for a careta:-.er of the
property for security purposes.
2. The proposed mobile home is for a 5 yeer period of time and shell no;: be
construed as a permanent residence.
8. CuNDITIONS-
1. The trallez- be located on the seteject property- in substantial coeioanance
with the "app?.-overi" plot plan on file with this apeflication, n d in any case,
shall obsecve the yarri (setback) requirements for a single family dwelling as
prescribed in Section 4.05.110 (a) of the Zoning Ordinance of Spokane Coenty.
2. This approved is granted to Augest 1, 192, at which time any permit issuticl
pursuant to this approval shall become null and void.
3. The trailer shall be skirted with a fire resistant material.
4. The trailer shall not be mounted on a permanent foundation in such a manner
as to constitute a permanent residence.
5.111e The trailer shall not be attached to other residential or accessory structures.
Metal canopies, tip outs and awnings may be attached to the trailer; however,
all wooden structures and accessory buildings, except open porches, must be
detached and placed at least three (3) feet from the trailer.
6. The trailer shall have an ownership title and be listed as personal property
with the County Assessor.

Expired Conditional Use Permits
A review of our files has revealed the following three expired conditional
use permits as trailers for caretaker residences.
CUE -101-75 - Lovell,
CUE -62-77A - Austin, and
CUW-74-77 - Brown.

The pertinent documents for each case are included herewith.
The permit for CUE -101-75 apparently expired in August of 1982 or June of
1983. In June of 1983, Mr. Adams solicited a renewal of the permit and
apparently there was no action taken on the part of the clients. Thus,
a potentially illegal situation exists.
In the case of CUW-74-77, Mr. Adams sent a letter on August 14, 1984
stating that the permit for the caretakers residence had expired. He urged
.the client to consider creating two parcels of land, which would then allow
the two residencPs to continue to exist. It would appear that no such action
has occurred and a potentially illegal situation exists.
In the case of CUE -62-77A, Mr. Adams sent a letter on August 9, 1984 stating
that renewal was needed. The file indicates no response on the part of the
applicant and the manufactured home as a caretaker's residence is now an
expired permit and it is an illegal use if it still exists.
Would you please investigate the above circumstances and take whatever
enforCement action is needed with regard to these expired permits and
potentially illegal uses.
It is our position that these permits have expired and there are no remaining
grandfather or non -conforming rights afforded to these clients. If there is
an unauthorized use at any of the sites which can be made legal under the
current provisions of the Zoning Ordinance through applications for new permits,
we would entertain those applications and at your discretion, hold enforcement
actions in abeyance until those applications have been considered.
