time over the development taking place or proposed in the annexed area lyinq south of 32nd Avenue When these lands were annexed to the district it was indicated to the board that the development would be slow and that only a relatively few houses need be considered Consequently, the only provision made for service to the annexed area was the 6-inch main required to be installed on Bowdish Road and no provision was rrade at that time requiring a loon back to the district's system The annexation order, however, did contain the condition that the annexed lands would be entitled "only to such tivater service in such quantities and pressure of water as may be provided throuqh said 6-inch main and the district shall have no obligation to increase said facilities serving said lands at any time in the future " Extension of pipelines off the 6-inch main, of course, is subject to the control of the d i s t r i c t The platting of your Joey Marie Addition, with the anticipated re- quirement within that small area of 20 services, in addition to the other services already existing off the 6-inch main, lead the district board to ask the district's engineer to study the matter and to re- commend what course of action the district should take in order to avoid a situation in which houses are sold to individual homeoarners and then problem develop as to the adequacy of service After studying the matter, it is the determination of the district's engineer that the houses to be built in Joey Marie Addition will use up the capacity of the 6-tnch main and that no more extensions may be allowed off the 6-inch main until and unless you, or whoever is developing the lands9 provides for a loop back to the district's system on 32nd i b i~~ -0 i1r Joe Michielli United Contractors, Inc Paqe 2 February 2, 1910 It 1s the district's understanding that you have aoplied for the subdivision of an additional 10-acre parcel lyinq immediately south of Joey Plarie Addit7on and the purpose of this letter is to advise vou that you will not be allowed an extension off the 6-inch main to serve the additional area until and unless you, at your expense or with such other arrangements as you are able to work out with other landowners, install an 8-inch main on what will be Pierce Poad, connectinq with the district's system on 32nd and extending all the way south to the most southerly pipeline extension from the Bowdish Road main In addition, you will be required to extend the 6-lnch pipeline in the Joey Marie Addition so that it runs throunh to the end af Joey Marie Addition and connecLs with the 8-inch main Inasmuch as Pierce road is not now dedicated, it tvill be necessary that proner easements be obtained by you from the lanas to be crossed so that the 8-inch main nay be legally in- stalled It is the recommendation of the district's engineer and the deter- mination of the district's board that without this requirement there will be neither adequate pressure or adequate volume of water in the annexed area and that the requi,rement herein established is essenttal This requirement of the district is being called to the attention of the Spokane County Plannlnq there is pending before the Planning Commission an application for the platting of the Sautheast Quarter of Southeast Quarter of the Northwest Quarter of Section 33, Township 25 North, Range 44 EW M The directors are concerned aver the adequacyiof water service from the district in this area and they have requested me to bring this to your attentl on The lands in question are included in an area which was annexed to the Model district by an order entered by the board of directors of the Model district on January 23, 1968 which said order was recorded in the office of the Spohane County Auditor as DocumentiPlo 349519C and recorded in Volume 4, page 1053 These lands are subject to the condition that all of the annexed lands, including this ten-acre parcel hereinabove described, shall be entitled "only to such water service in such quantities and pressure of water as may be provided through said 6-inch main and the district shall have no obligation to increase said facilities serving said lands at any time in the future " The lands lmmediately north of this 10-acre tract recently were elatted as Joey Marie Addition, with provision in that plat for 20 homes The six-inch main serving all of the annexed lands is a d2adend main which extends down Bowdish Road The directors fear that the requirement of the existing services off of that main to- gether with service to the contemDlated homes in the Joey Marie Addit7on arill exhaust the capacity of the six-inch main until and unless the landowners in that area provide a loop of the six-inch main back to the district's
