entirety, sublect to the follovring conditions
A C ondition s
1 That the plat be redesigned substantially as fndicated on fhe
preliminary plat of record to provide for a private recreation area
as noted and to adjust the alignment of Fourth Avenue to match
with Fourth Avenue existing and also to relocate a north-south
street in the plat to provide for an adjusted lot arrangement on
Flora
A) The sponsor shall submit the proposed farm of the legal
documents for continued retention, development, and maxn-
tenance of all common open space land prior to the filing of
the final plat, which documents shall provide, anong other
things, for a minimum assessment of inembers of a honze
owners' association for such open space development and
maintenance Said documents to be approved by the Planning
Dfrector prior to filing of the final plat
B) fhe areas shown as recreation area and sewer treatment site
must be accurately defined and given lot and block numbers
rhe final plat will show the future ownership status of
parcels to be sold, parcels to remain public (i e, sewer
treatment site) and parcels to remain in common ownership
C) That the sponsor, prior to filing of the final plat, provlde for
minimum improvement of the common open space 13nd, such
improvements will be accomplished at the sponsor's expense
and shall include proper guarantee of minimum standards of
improvement (i e turfing and adequate sprinkling system)
which sha11 be approved by the Planning Director
D) If a final plat is to be filed that does not include the entire
area proposed for piatting on the preliminary plat of record,
then the first final plat filed will include the sewer treatment
site,
2 That a statement be placed in the dedication to the effect that no
more than one mobile home unat be placed on any one lot, nor
shall any lot be further subdivided for the purposes of creating
additional lots or building sites wxthout filing a replat

approved preliminary plat for distribution to the Planning Depart-

7 That a certificate of title be furnisned the Planning Commission
prior to the filing of the final plat
s That the preliminary plat be given conditional approval to

9 That streets be fmproved to standards established by Spokane
County, or a bond to cover the cost of such improvements be
fumished the County Engineer in the amount as determined by t~_e
County Engineer
10 That profile s of streets, proposed grade s, and drainage pl an of
the plat be submitted and approved by the County Engineer before
the final plat is drawn. The County Engineer may require that
design of drainage improvements for the entire plat be made by a
registered civil engineer

Apple Valley Estates, dated June 6, 1969, recorded June 13, 1969
under auditor' s f ile No 431871C 9 as fo llovrs
1 TERMo These covenants are to run with the land and shall
be binding on all parties and all persons claiming under them for
a period of thirty-five (35) years from the date these covenants are
recorded, and after which time said covenants shall be automatically
extended for successive periods of ten (10) years unless an instiru-
ment signed by a majority of the then oimers of the lots has been
recorded, agreeing to change vaid covenants in whole or in part
2 ENFORCEMENT Enforcement shall be by proceedings at law
or in equity against any parson or persons violating or attempting
to violate any covenants, either to restrain violation or to recover
daMages
3 SE'VERABIT.,ITY Invalidation of any one of these covenants
by judgment or court order shall in no wise affect any of the other
provisions which shall remain in full force and effect
4 LANA USE AND BUILDING TYPE All lots shall be used for
residential mobil homes No structure or building other than a
single moblle home shall be permitted on each of said lots and said
mobil hom4s shall be manufactured by a nationally known manufactur-
ing firm or otherwise approved by the Control Committee As appur-
tenfi and incidental to the residential use of any mobil home a patio,
canopy and one single or double detached garage or ear port, archi-
tecturally in harmony with and of permanent structure may be erected
on sa3.d lot, subject to the limitations herein The owner of any lot,
once construetion of a patio, canopy or detached garage or car port
is commenced shall, within nine ty (90) days thereafter, have the
patio, canopy, garage or car port completed, and in the case of a
garage or car port shall have the exterior completely
finished and all necessary painting or staining completed Only
two sizes of garages or car ports shall be permitted on any lot,
narnely 24' x 26' or 18' x 261. The roof pitch on any garage or
car port shall be the same pitch av that of the mobile home located
on the lot and shall in no event exceed 2/12 pftche Plans and vpe-
cifications for such improvements shall be submitted to the Control
Committee and approved as provided in paragraph 6 hereof No mobile
home less than 12 feet in width and 50 feet in length shall be per-
mitted on any lot
5 ARCHITECTURAL CONTROL A1o building or structure shall be
erected, placed, permitited or altered on any lot untll the construc-
tion plans and specifications and a plan showing the location of the
stiructure on the lot has been approved by the Control Committee as
to quality and workmmanship and materials, harmony of eacterior design

with tihe existing stiructures and as to location with respect to topo-
graphy and finished grade elevation No fence, hedge or bourdary
Vaall abutting on a street shall exceed three (3) feet in elevation
above the finished grade surface of the ground upon which such fence,
hedge or boundary wall is situated unless similarly approved by the
Control Committee Approval shall be as provided in paragraph 6
hereof o
6 CONTROL COMMITTEE The Control Committee is composed of
MIKE BASCETTA9 JOSEPH BASCETTA and LLOYD K. MILLERo A majority
of the committee may designate a representative to act for it In
the event of the death or resignation of any member of the commit-
tee the remaining members shall have full authority to designate a
successor Neither the members of the committee nor its designated
representative shall be entitled to any compensation for service
performed pursuant to this covenant At any time the then record
owners of a majority of the lotis shall have the power with a duly
recorded written instrument, to change the membership of the committee
or to withdraw from the committee or to restore to it any of its
poVrers and duties The committee's approval or disapproval as re-
quired in these covenants shall be in writing In the event the com-
mittee or its designated representative fails to approve or disapprove
within thirty (30) days after plans and specifications have been
submitted to it or if, in any event, no suit to enjoin the construc-
tion has been commended prior to the completion thereof, approval
will not be required and the related covenants shall be deemed to
have been fully complied with
7 NUISANCES AND RULES No noxious or offensive activ.Ities
shall be carried on upon any lot nor shall anything be d.one therEOn
which may be or may become an annoyance or nuisance to the neigh-
borhood All occupants of mobile homes in said addition shall sub-
ject to weekly garbage service from a commercfal garbage colleCtion
service in the Spokane Valley Area and shall at no time allow garbage
to accumulate or collect in the area In addition thereto, all own-
ers of property situated within this plat muat conform to such reason-
able rules and regulations as the Control Committee anay from time to
time adopt for the protection, comfort and convenierace of the re-
sidents therein
8 TEMPORARY STRUCTURES ATo structures of any temporary charaam
ter, basement9 tent, shack, garage, barn or other structure or
building shall be placed or permitted on any lot at any time as a
residence, either temporarily or permanently
9 VEHICLES No ma jo r repa ir o f any mo to r vehic le o r o ther
equipment shall be permitted on any lot in the addition No storage
of any motor vehicle or other equipment, either temporary or perman-
ently shall be permitted on any lot in the additiono EXCEPT that
