14-229.01 Michael Terrell: Browns Park Volleyball Courts
CONTRACT AMENDMENT FOR THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND MICHAEL TERRELL LANDSCAPE ARCHITECTURE, PLLC Contract #CO-14-229.01 For good and valuable consideration, the legal sufficiency of which is hereby acknowledged, City and the Michael Terrell Landscape Architecture, PLLC mutually agree as follows: 1. Purpose: This Amendment is for the Contract for Browns Park Volleyball Courts — Phase 1A project by and between the Parties, executed by the Parties on December 4, 2014, and which terminates on June 15, 2015. Total compensation under the Original Contract is not to exceed $7,850.00. Said contract shall be referred to as the "Original Contract" and its terms are hereby incorporated by reference. 2. Original Contract Provisions: The Parties agree to continue to abide by those terms and conditions of the Original Contract, dated December 4, 2014, and any amendments thereto, which are not specifically modified by this Amendment. 3. Amendment Provisions: This Amendment is subject to the following amended provisions. All such amendment provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract, including any previous amendments thereto. (1) Develop construction drawings and specifications and bidding assistance for construction of two additional sand volleyball courts at Browns Park. (2) Develop scope of work and plans for basketball court grade renovations. 4. Compensation Amendment History: This is Amendment#1 of the Original Contract and the history of amendments to the Michael Terrell Landscape Architecture, PLLC compensation is as follows: Date Compensation Original Contract Amount 12/4/14 $ 7,850.00 Amendment#1 4/1/15 $ 3,330.00 Total Amended Compensation $11,180.00 1 The parties have executed this Amendment to the Original Contract this fieild April 2015. Upon receipt of bids on the original scope of work, you directed us to prepare a separate bid package for the construction of two additional sand volleyball courts. The preparation of this bid package required us to prepare complete drawings and specifications that would anticipate the required coordination between two potential general contractors on site. We propose the following modification to our contract: 1. Develop construction drawings and specifications and bidding assistance for the construction of two sand volleyball courts at Browns Park. 2. Deliverables: a. Construction drawings including demolition, construction, staking, grading, planting and irrigation. b. Complete Specifications and bid forms. c. Bidding assistance during bidding.
