Planning Commission Recommendation Approve A11 of Block 2 to the Restncted
Residential Zone Approve All of Blocks 3, 4, 5, 6,p 7, and 8 to the Single Farulv
Residential (R-1) Zone (Lot 1, Block 1 was conditionally approved for Multiple
Family Suburban zorung at the january 29, 1971, hearing - See ZE-5-71 )
Reasons
The final plat of Castle Addition has been filed incorporating 88 residential lots, a
multiple family tract, and a recreation tract All residential lots within Blocks 3- 8
conform to the minimum dimensional requirements of the Single Family Residential
Zone (R-1) for a single farruly residence All lots withun Block 2 can accommodate
either single family or duplex structure s
The Planning Commission is of the opinion that the resiaential lots and the recreation
tract south of 33rd Avenue are appropnate for Single Family Residential (R-1) zorung
because
1) The 74 residential lots have been designed for single family building
site s, i e, most of the lots have 8 0- 90 feet of frontage and 125 to
130 feet of depth
2) Adjoining plats with comparable lot sizes have been upgraded to the
Single Family Residential Zone, i e 1) Al.oha Addition - December 24, 19 70,
2) Joey Mane Addition - June 12, 19 69
3) The Single Farraly ResidentYal Zone prohibits duplexes, animaa keeping other
than household pets, home occupations, and mobile homes
The Planning Commission is of the opiruon that the 14 residential lots to the north of
33rd Avenue are appropnate for Re stncted Residential zoning because
1) The eight residential lots which are grouped around the cul de sac are pie-
shaped and somewhat larger than typical single famuly lots Six of the
eight lots fronting on 33rd Avenue have at least 90' of frontage and
11, 000 square feet of lot area Duplex development may be more
appropnate for these lots because of their size and proximity to the cul
de sac lots

FINDINGS AND ORDER REGARDING FINAL PLAT PE-763-70 CASTLE ADDITION
WHEREAS, Gordon Richardson did request a special hearing before the
Board of County Commissioners to consider a Change In Condition in the final plat
of Castle Addition (File #PE-763-70), and
WHEREAS, the Board of County Commissioners did hold a public hearing on
January 5, 1978 to consider the request of the applicant, the testimony of the
objectors and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described final plat Change In Condition, the Board of County
Commissioners of Spokane County having fully considered the testimony given, the
records and minutes of the Planning Corunission hearings, the environmental review
and all other evidence presented, and having personally acquainted themselves with
the site and vicinity in question, does hereby find that the Change In Condition
should be granted Now, therefore, the Board of County Commissioners does conclude
that the Change in Condition as requested by the applicant should be and hereby is
approved subject to the following conditions
That the owner be responsible for sewer line maintenance from the buildings
of East Village to the eight inch sewer line in the street

That the number of bedrooms in the East Village area not exceed 108
That the drain field design for the West Village area be six gallons per
lineal foot
That the developers sign a sewage management agreement
That the West Village system be considered as an interim system and is to be
connected to a County general sewage system when available

That the developer comply with all applicable Spokane County Environmental

2 Consxderations
a By plat dedication (on final plat map), Lot 1, Block 1 was dedicated
for multifamily structures whereas all other building lota were limited
to single family or duplex dwelling structures The public sewage
system was designed on this basis and its capacity has been fully
allocated according to the Utilities Division of the County Engineering
Department The January 5, 1978 action by the County Commissioners
specif'ying stipulations for Lot 1, Block 1 did not involve a zone
change resulting in an increase of the density to be served
b Our records indicate that some of the lots in question already have
homes built on them which are connected to the sewer system l,Te
believe it is undesirable to create combinations of individual and
public sewage systems serving the same parcel of land iP it ca.n be
avoided
c The topography and soils in the lots are believed to be suitable for
installation of individual drainfields However, lot sizing and
specific development plans for multiple family housing would be critical
to any approvals from this office
d A zoning for multifamily use may create a need for a sewage management
system on each lot

for the 60 unit west village was wized according to a soil absorp-
tion rate of ten (10) gallons per lineal foot of field with the
concurrence 4f Spol.cane County Health District Said absorption
rating would be appropriate for a more gx$velly soil type, however,
the sandy loam soils in the Castle Addition area have given some
problems to Spokane County Engineers in their operation experience
of the existing drainfield syrt-em It will therefore be neceasary

1 A conference in Commisaioner Kopet's off ice today was attended by him, Alvia
Wolff, Vince Seipp, Jesry Neal, Jim Legat, Steve Horobiowski (Planning Com-
misaion) and me Mr Wolff proposes to build apartment units in Block 1 of
Castle Addition However, the total number of bedrooms proposed will result
in sewage flowa greater than the design capability of the exieting treatment
plant and drainfield The dedicatory language on the plat requires a public
sewer syetem
2 Possible alternatives diecussed were
a Limit number of bedroome to design capacity of plant and drainfield
b Expand the drainf ield on the existing aite to maximum plant capacity
limit
c Expand the drainf ield into Block 1 to maximum plant capacity limit
d Connect so much of proposed project to existing treatment plaat and
drainfield as reaches the design capacity of the exiating drainfield
and put the balance of the proposed pro3ect on on-site aewage dis-
posal systema Thss will require a change in the dedicatory language
of the plat If thie course is followed (as Mr Seipp said it would
be), the project sponaor must prepare an environmental checklist and
petition the County Commissioners for a change in the dedicatory lan-
guage This will entail advertising and public hearing by Coimniesionere
I told Mr Seipp that we and the County Engineer would require a line
drawing plot plan showing placement of buildings, drainfielda and
public sewer lines along with numbear of bedrooms in each unit to be
served by each syetem These daill be required for ue to respond to
the environmental checklist and comment, if necessary, at the public
hearing

available to the Board to approve the requested change in condition to
allow both a public sewer system and individual on-site systems, subject
to conditions developed by the Planning Staff, attached hereto and

The Board concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Non-Significance
be issued
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more

Engineer, Healfih District and Planning
It was the consensus of opinion that the language in the dedication of ~
Castle Addition would need to be amended to remove the next to last ~
~ sentence which says, "Domestic sewage disposal service shall be provided ~
each lot prior to sale " '
We are requesting that the Board of Commissioners take action to make
this amendment to the dedication as soon as possible

in sewage flows greater than the design capability of the exieting treatment
plant and drainfield. The dedicatory language on the plat requires a public
sewer system.
2. Passible alternatives diecusaed were:
a. Limit number of bedrooms to design capacity of plant and drainfield.
b. Expand the drainfield on the exiating site to maximum plant capacity
limit.
c. Expand the drainf ield into Block 1 to maximum plant capacity limit.
d. Connect so much of proposed project to existing treatment plant and
drainfield as reaches the design capacity of the exieting drainfield
and put the balance of the proposed project on on-site sewage dis-
posal systems. Thss will require a change in the dedicatory language
of the plat. If this couree is followed (as Mr. Seipp said it Would
be), the project sponsor must prepare an environmental checklist and
petition the County Commissioners for a change in the dedicatory lan-
guage. Thie will entail advertising and public hearing by Comniesionere.
I told Mr. Seipp that we and the County Engineer would require a line
drawing plot plan showing placement of buildings, drainfielda and
public sewer lines along with number of bedrooms in each unit to be
served by each syetem. These j,iill be required for ue to respond to
the environmental checklist and comment, if necessary, at the public
hearing.
3. Mr. Wolff is to decide on'his courBe of action and nake appropriate aubmittals
to us and Countq agencies.

Gentlemen:
As owners of Block 1, Castle Addition, the undersigned desire to develop
an apartment project on this site consisting of 60 two bedroom and 48
one bedroom units for a total of 168 bedrooms.
The site is currently zoned to allow 108 units with no restriction as
to number of bedrooms.
An existing treatment plant serves Aloha and Castle Additions, and is
operated by the County. With all lots in both additions developed
there is presently a capacity to serve 108 bedrooms of a multi-family
project.
Therefore, we are requesting permission to serve 60 bedrooms with septic
tanks and drainfields.
To discuss this proposal, a conference was held in your office on Tuesday,
November 29, Present in addition to the proponents and two comnissioners
were representatives from the offices of the Prosecuting Attorney, County
Engineer, Health District and Planning.
It was the consensus of opinion that the language in the dedication of
Castle Addition would need to be amended to remove the next to last
sentence which saysp "Domestic sewage disposal service shall be provided
each lot prior to sale."
We are requesting that the Board of Commissioners take action to make
this amendment to the dedication as soon as possible.

This being the time set by the Board of County ComiTiissioners of Spokane
County, Washington, to conduct a public hearing on the above entitled
matter, duly noticed and advertised by the Planning Department; and
The Board being fully-advised in the premises did determine, based
upon the testimony submitted at this public hearing and other evidence
available to the Board to approve the requested change in condition to
allow both a public sewer system and individual on-site systems, subject
to conditions developed by the Planning Staff, attached hereto and
incorporated herein by reference. ~

The Board concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of iVon-Significance
be issued. The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

The Utilities Section of the County Engineers Office has reviewed the sewerage proposal for University Village in Castle Addition as revised December 1, 19779
and have the following comments regarding the sewer system:
1. The original design for sewerage contemplated 108 bedrooms in 75 units for all of the multi-family area in Castle Addition.
Sufficient drainfield was installed in the treatment plant and drainfield
easement area for this use. Therefore, as the existing sewerage system
was designed and constructed, it has capacity for only 108 more bedrooms as is
proposed from the East Village portion of the University Village proposal.
For the East Village collection system, the owner will be responsibile.for
sewer line maintenance from the buildings to the eight inch diameter sewer
line in the street which Spokane County maintains.
2. Practically speaking the present drainfield easement area has no room-for

Village portion of the proposal. Additional drainfield easement area,
effluent pumping and transmission facilities would be needed to expand the
existing plant and drainfield capacity to include whole of University
Village into the public sewer system. Drainfield design for any public
sewer addition is to be at 6 gplf instead of 10 gplf as indicated on the
proposal for the West Village.
3. The recreation and pool area does not show any sewer needs. Some capacity
should be included in the West Village system for this. The swimming pool
should not be designed to drain into the sewer collection syste«i.
4. Should West Village be approved with a private on-site septic tank system, it
will n~ot be maintained by Spokane County as a part of the existing operation and
maintenance agreement between the County and the original Castle Addition developer.
5. If approval is granted for the West Village private septic tank system, it should
be considered as an interim system and is to be connected to a County general
sewerage system when available.

Introduction: The State Environmerital Policy Act of 1971, Chapter 43,21C, RC'JV,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. The
purpose of this checklist is to help the agencies involved deterrtiine whether or not a
proposal is such a ma jor action.
Please answer the following questions as completely as you can with the information
presently available to you. Please answer questions as "yes" or "m,3ybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the deQree of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers are required, or where you
believe an explanation would be helpful to government decision-makers, include your
explanation in the space provided, or use additional paqes, if necessary. You should
include references to any reports or studies of which you are aware and which are
relevant to the answers you provide. Complete answers to these questions now will

Dear Mr. Huggins:
Pursuant to our conversation, it is my understanding that approx-
imately 5% of the trees which were planted will probably not sur-
vive on Aloha and Castle additions. Mr. Krause, the landscaper,
says the dead trees will become obvious, and at that time, should
be replaced.
Leavitt brothers, developers of both Aloha and Castle subdivisions,
will replace all ; non-surviving trees on both subdivisions, or in the
case of sale of pertinent lots on which these trees are planted, will
be responsible for their replacement by any subsequent purchaser
up to a period of 12 months following their original planting.
It is our hope that this letter will serve as proper notice by Leavitt
brothers, and further, that all ;rnonies held by the County to insure
compliance with plat conditions can now be released to them.
