14-192.01 Van Ness Feldman: Comp Plan Updates Ph 1 CONTRACT AMENDMENT FOR THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND VAN NESS FELDMAN Contract#C014-192.01 For good and valuable consideration, the legal sufficiency of which is hereby acknowledged, City and the Consultant mutually agree as follows: 1. Purpose: This Amendment is for the Contract for professional services for updating the Comprehensive Plan — Phase I by and between the Parties, executed by the Parties on October 29th, 2014 and which terminates on December 31st, 2015. Total compensation under the Original Contract is not to exceed $77,000.00. Said contract shall be referred to as the "Original Contract" and its terms are hereby incorporated by reference. 2. Original Contract Provisions: The Parties agree to continue to abide by those terms and conditions of the Original Contract, dated October 29th, 2014, and any amendments thereto, which are not specifically modified by this Amendment. 3. Amendment Provisions: This Amendment is subject to the following amended provisions, which are either: ❑ as follows, or ® attached hereto as Appendix"A". All such amendment provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract, including any previous amendments thereto. 4. Paragraph 3 (Compensation) of the Original Contract is hereby amended to increase the total compensation paid by $31,000. Paragraph 3 of the Original Contract is amended to read as follows: "3. The City agrees to pay up to $108,000 as full compensation for everything furnished and done under this contract, in accordance with the provisions outlined in the scope of work, as previously and/or presently amended. 2. The Scope of Work, (Exhibit 1)of the Original Contract,is hereby amended as specified in Exhibit B. EXHIBIT—B AMEDED SCOPE OF SERVICES 1.0 ADOPTION SCHEDULE The City of Spokane Valley is updating its Comprehensive Plan. RCW 36.70A.130(5) requires the City to update its plan consistent with applicable regulations by June 30, 2017. The Comprehensive Plan update will consist of three phases: Phase I (2014): In this phase, the Consultant will compile and analyze existing conditions and documents, develop the Public Participation Program, and complete the community visioning. The scope of work for Phase I is detailed in the Section 2 below. The timeframe for Phase 1 is approximately November 2014 to March 2015. Phase II (2015). In this phase, the Consultant will prepare the draft Comprehensive Plan elements, any related required draft regulations, and initiate the State Environmental Policy Act (SEPA) environmental review process. Phase III (2015-2016). In this phase, the Consultant will prepare the Final Comprehensive Plan, regulations to implement the Comprehensive Plan, and final SEPA documents. 2.0 PHASE I SCOPE OF WORK The City completed the Department of Commerce — Periodic Update Checklist for Cities and has preliminarily determined what sections of the Comprehensive Plan are required by the Growth Management Act (GMA). The City identified the following components and/or elements that will require an extensive evaluation and detailed update: • The Land Use element, which includes an extensive review and assessment of the current land use designations based on existing conditions, planned City Hall, land use patterns, population and employment projections, community visions, and goals and policies. • The Economic Development element, which will articulate the direction and the process for the City to achieve greater economic vitality. • The Transportation element, including identification of specific actions to bring locally- owned transportation facilities and services to established levels of service. • Evaluation of the Urban Growth Area (UGA) necessary to accommodate population and employment goals. • Ensure internal consistency of Comprehensive Plan elements and external consistency with State plans and regulations and Spokane County Countywide Planning Policies (CWPP). 2.1 Document Review and Data Collection The Consultant shall conduct document review and data collection tasks including: 1. Compile data. 2. Review and analyze documents. 2.3 Land Quantity Analysis The Consultant shall provide technical assistance for data interpretation, including: 1. A memo summarizing the current methods and identification of possible improvements to the process. 2. A memo containing suggested improvements to the Land Quantity Analysis (LQA) methodology. 2.4 Prepare Public Participation Program Prepare a new Public Participation Program (PPP) to define programs and methods for engaging the public that includes at least the following: 1. Schedule showing key points in the process for public input, including all legislative actions. 2. Identification of opportunities for public input, such as comment cards, web-based comments, and public workshops. 3. Process for managing and incorporating input from public comments 4. Methods to relate public input regarding the Comprehensive Plan Update to City Council, Planning Commission, City staff and other stakeholders. 5. Consultant shall prepare a presentation of the PPP and the anticipated project schedule for City staff to present to the City Council. 2.5 Implementation of Public Participation Program 1. Consultant shall develop a Public Notice Plan identifying anticipated notice methods for each type of public meeting and milestone in the project to broadly and effectively engage the public. 2. Consultant shall develop project newsletters, as needed, for public circulation. 3. Consultant shall develop meeting notice flyers announcing time, date, and location of public meetings. 4. Consultant shall provide recommended edits to the City website. 5. Consultant shall draft email alerts for public meetings and project milestones. 2.6 Community Visioning 1. The Consultant shall conduct a visioning process to identify community proposed changes to the Comprehensive Plan. The visioning process will be inclusive of all elements to be updated but will specifically focus on changes to the Land Use element, Economic Development element, Transportation element, and Housing element. 5 2. Consultant shall prepare public visioning materials 3. Consultant shall facilitate public meetings in January and March which will include presentations and topical exercises. 4. Consultant shall prepare a community vision report. 5. The Consultant shall discuss the report with City staff regarding the extent of the changes to the Comprehensive Plan. 2.7 Citizen-Initiated Amendment Request Process 1. Consultant shall advise the City on the establishment of a citizen-initiated amendment request (CAR) process, including the development of a CAR application. 3.0 CONSULTANT RESPONSIBILITIES The consultant will work under the direction of the Community and Economic Development Department and shall be responsible for the following items: 1. Drafting revisions and preparing plan documents, graphics and other support services consistent with the Scope of Work. 2. Collecting and analyzing required technical data. 3. Presenting the technical data to City staff, City Council, and at all public workshops. 4. Organizing and facilitating public meetings and workshops, and addressing community issues and concerns. 5. Presenting to major stakeholder organizations, citizen boards and the public. 6. Coordinating and making regular presentations as required. 7. All documents and final reports shall be presented in digital format for archiving and reproductions. 4.0 CITY RESPONSIBILITIES 1. City staff shall create the required Geographic Information System (GIS) datasets for the LQA methodology, zoning, and land use. The City will create and print all maps associated with the update. 2. The City shall provide the following documents to the Consultant: • The adopted 2003 COSV Comprehensive Plan Public Participation Program. • The adopted 2007 Comprehensive Plan. • Land Capacity Analysis prepared for the 2007 Comprehensive Plan update. 3. The City shall maintain the project record and provide a copy of the index to the Consultant team on a quarterly basis. 4. The City shall maintain a public comment matrix to track all input received and shall provide a copy of the matrix to the Consultant team on a quarterly basis. 5.
