IN THE MATTER OF: SR 27 (PINES RD) AND GRACE AVE INTERSECTION SAFETY PROJECT
KNOW ALL MEN BY THESE PRESENTS, that the Grantor(s), John R. Hinkle and Denise M. Hinkle,
husband and wife, for and in consideration of THREE THOUSAND SIX HUNDRED SEVENTY
THREE AND NO/100 ($3,673.00) Dollars, and other valuable consideration, the receipt of which is
hereby acknowledged, grant(s) to the City of Spokane Valley (Grantee), a municipal corporation in the
State of Washington, a Drainage Easement over, under, upon and across the hereinafter described lands
situated in the City of Spokane Valley, County of Spokane, State of Washington:

See Exhibit A attached hereto and made a part hereof.
The Drainage Easement granted to the City of Spokane Valley and its authorized agents is for the sole
purposes of allowing construction, maintenance, and use of the easement area for public roadway
stormwater treatment, storage, conveyance, and infiltration. The Grantor(s) hereby agree to provide
continuous vehicle and truck access to the above-described lands to the Grantee in order to construct,
maintain, clean, repair, and replace drainage appurtenances at the will and pleasure of the Grantee.
The City of Spokane Valley accepts complete and total responsibility for the construction and perpetual
maintenance of the stormwater facilities and landscaping located within said Drainage Easement. The City
of Spokane Valley also agrees to construct the drainage swale five feet west of the permanent drainage
easement boundary to create a buffer zone for future development.

The City shall defend, indemnify, and hold the Grantor (property owner) harmless from any and all
claims, injuries, damages, losses, or suits, including attorney fees, arising out of or in connection with
activities or operations performed by the City relating to the issuance, operation, or maintenance of this
easement, including such claims by any third parties, except for injuries and damages caused by the sole
negligence of the Grantor
The Drainage Easement described herein shall run with the land. No modification of the boundaries of
said Drainage Easement can be made without the prior approval of The City of Spokane Valley.
(Easement is granted under an imminent threat of the exercise of
eminent domain)

being in the Northwest Quarter of Section 10, Township 25 North, Range 44 East, W.M., City of Spokane
Valley, Spokane County, State of Washington, being more particularly described as follows:
The West 35.00 feet of said Lot 3;
EXCEPT that portion of said Lot 3 lying westerly of the following described line:
Commencing at the Northwest Corner of said Lot 3; thence N87°12'42"E, along the northerly line of said
Lot 3, a distance of 15.00 feet to the POINT OF BEGINNING of said Line Description; thence
