Dear Owner/Occupant:
Our district inspector reports that a two story play house is being
constructed on your property located at the above-mentioned address,
Spokane County parcel number 26531-0102, without a valid building
permit. In accordance with Section 301 of the Uniform Building Code
as adopted by Spokane County, such work requires that you first
obtain the appropriate permit.
Section 304(d) of the Uniform Building Code requires that a double
fee be charged whenever any work for which a permit is required has
commenced without first obtaining such permit.
The intent of this letter is to waive the double fee, provided, you
take the appropriate action to obtain a permit within ten (10) days
of the date of this letter. I can assure you a double fee will be
assessed should you fail to comply with this request.
A recheck of our files will be conducted immediately following the
time frame specified above. Your compliance with the above will
negate the need for further action on this matter.
Should you have any questions, please contact this office between
the hours of 8:00 a.m. and 4:00 p.m., weekdays.

Dear Mr. Forry:
Pursuant to your letter of 8/8/88, I responded and visited your
office last week to explain my circumstances. When I began work
erecting a platform, about 10' from grade, I envisioned a temporary
structure. In the last couple of years I made a sled run for my
kids in the back yard, and I designed the platform to use as a
secure take off ramp. Previously, I used an 8' wooden step ladder
with built-up sides and snow packed around.
Beyond this use, I contemplated purchasing a boat or other recrea-
tional equipment, and in doing so considered I would need a work
area having sufficient height to carry out repairs or renovations.
After breaking ground, and installing the 6' square posts in 2' deep
concrete footings, I realized much work would be -involved to make
the structure sturdy and to build stairs. In designing the platform,
I decided to spend extra money to put sides and a roof up. As a
result, the roof of sufficient height has exceeded the County code
for structures over 16' from grade, i.e., code requires placement
10' from the property lines.
Presently, the structure is a playhouse and is to be used as the
take off for the sled run. Given my dilemma, I intend to remove the
roof after winter use, and if necessary, to redesign the structure
to comply with code. Also, as I understand it, given the floor
dimensions of 72" x 78", if built on the ground, no permit would even
be required. If I misunderstand the specific code requirements
pertaining to the structure, please advise.
I understand that you have the discretion and have stated that there
should be no problem to permit the use of the structure until the
spring when I can take remedial efforts as to the roof height. In
the event I am not able to satisfy the code requirements from your
perspective as to size or use of the building, I will have to con-
sider the approach of a variance. You have brought to my attention
the 10' from the property line requirement, and frankly when planning
I guaged the distance from the property line (between 3 and 4 feet)
considering the adjacency of a neightbor's fence and foliage, and
from the standpoint that the structure is quite appealing to the eye.
I am not aware given your statements, or your letter, as to obstruc-
tion of vision considering the placement of the structure.

To conclude, I can remove the roof, and actually use the structure
as it was initially contemplated, and as related tome by you, not
be required to obtain any permit. I would greatly appreciate your
deferring any action in this matter based on the above, until the
spring. If there is any other problem you perceive which would not
allow you to permit my use of the structure as is through the winter,
please advise in writing. I am available to meet with you if that
is your preference. My home telephone # is 534-2293.
To make clear, I had intended to be able to disassemble the building,
if but to relocate it at a subsequent residence. I can assure you
that my construction of the platform was not in disregard of County
code requirements, particularly when designed as temporary, and also
as a..work.,area.
