The record in thi.s case ref lects that the Board held an initial hearing on August 8, 1989 to consider a request by Mr. Huber to zezone approximately 2.5 acres f rom Agricultural to the 1-2 zone. The purpQSe of the rezone request was to continue an agricultura3, truck hauling facility, office/storage facility, and qarage use. an August 29, 1989, the Board of County Commissioners, in a 2-to-1 vote, approved the rezone request. The decisian of the majority axtiGUlatied in detail the basis for the approval. The 13oazd of Gounty Commissioners imposed certain conditions on the appxaval which, i.n our opinian, mitigated or addxessed conct --is raised at the public hearxng. The pmperty is gentrally located Generdlly located between Broadway Avenue and Alki Avenue approximately 300' fL west of the inte,rsection of Barker and Broadway in the vicinity of Interstate Highway 90 and Barker Road interchange in Section 18, Township 25 North, Range 45 E.W.M., Spokane County, Washington. 3. The oommittee adapts the Planning Department Report as a part of this rocord. 4. The existing land use(s) in the area are general single family residential. 5. The Comprehensive Plan designates thi.s site as Urban. The Urban category is for the primary purpose of residential uses with limited local serving business, including residential densities of one acre t0 22 units per acre. 6. The Arterial Road Plan designatc.s Broadway as a Minor Arterial, with a recommended right of way width of 80 feet and a structural setback of 35' ft. from the future right of way. 7. The existing zoning of the property described in the application is Agricultural, previously established in 1959. 8. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Deterniination of Nonsignificance was issued. 9. The proper legal requirements for advertisement and notice have been fulfilled. 10. The owners of adjacent lands expressed both approval and disapproval of the proposed use. 11. The proposal is located in the Urban designation of the Comprehensive Plan which does not support Indastrial uses in residential areas as stated in its goals and objectives. The proposal will not further the objectives and goals of the Comprehensive Plan. b. The existing land use in the area is residential and the proposed use is neither consistent nor compatible with residential use. c. There has been no changes in zoning in the vicinity that would support Industrial z,oing. No substantial changes in conditions in the area has occurred sincc the original zoning, cxcept the applicant's zoning violation. d. There is Industrial zoning and areas designated for industrial use throughout the Valley and a substandal qoanity of such land is vacant and available far use by the applicant, e. The proposed zone reclassification bears no substantial relationship to the public health, safety, and welfanc in so far as the proposed (existing) use has been shown to have several undesirable impacts to neighboring properties (zoning complaint files). f. The purpose and intent of the I-2 zone is clearly to implement the Industrial category of the Comprehcnsive Plan (Section 14.632.100 of the Code). g. The Hearing Fxaminer Committee considered limiting the use of the property to only that pmposed; agricultural truck hauling operation shop and office. Howevcr, the proposed zaning in itself is neither consistent with the Camprehensive Plan, adjacent uses nor lifestyles of the area and therefore should be denied. h. The sponsorss representative was in favor of limiting the I-2 zone change request to only the uses proposed.. i. The Hearing Examiner felt that the I-2 zone would set preoedent for other I-2 zone changes in the irnmediate area. Even if such zone reclassifications limited uses. The Hearing Examincr Conlmittoe finds that the impacts on the exi.sting residential uses would be adverse and not compatible regardless of the type of materials being hauled. 12. The applicant has not demonstrated that cond.itions have substantially changed since the original zoning of this area and accor+dingly, the proposed zone reclassification is not justified. 13. The proposed use will be detrirnental to the public health, safety, or welfare. HISTORY The proposed rezone site has a long history of zoning complaints Complasnts were received by the Planning Department in July of 1986 and inspections on numerous occasions in July of 1986 to the present the property has been found to be in violation of the existing zoning on the property. The existing structure on site was approved by the Building and Safety Department in June of 1986 as a garage for pnvate storage, no commercial use was allowed. VII.
