ZE-39-92 No. 93 0432 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF SPOKANE COUNTY, WASHINGTUN IN1'HE MATi'ER OF REZANE ZE-39-92 FINDINGS OF URBAN RESIDENTIAL 3.5 (LTR-3.5) TO ) FACT, URBAN RESIDENTIAL 7(LTR-7) ) DECISION AND ) CONDITIONS SPONSOR: Verona Southern THIS MATTER, being the consideradon by the Board of County Commissioners of Spokane County, hereinafter referred to as the "Board", of an appeal of the Spokane County Hearing Examiner Committee decision of November 20, 1992 approving Zone Reclassificarion File No. ZE-39-92 for the purpose of developing a single family residence and a five unit multifamily complex on approximately 1.06 acres of land, hereinafter referred to as the "Proposal"; and the Board of County Commissioners having held a de novo public hearing on January 5, 1993, and having fully considered all testimony and documents presented thereat and having considered the Planning Department's file; and further having individually visited or being familiar with the site and vicinity in question and having rendered an oral decision on the 26th day of January, 1993, approving the appeal and denying said proposal, does hereby enter the following: FINDINGS OF FACT 1. The proposal is generally located north of and adjacent to Sprague Avenue and approxunately 650 feet west of Barker Road in Section 18, Township 25 North, Range 45 EWM, Spokane County, Washington. 2. The proposal consists of an existing single family dwelling and a proposed five unit multifamily dwelling on 1.06 acres of land. The sponsor requests a rezone from Urban Residential-3.5 (UR•3.5) to Urban Residential-7 (UR-7). The site earlier received preliminary plat approval for a two lot short plat, File No. SP-784-92. 3. The Hearing Examiner Committee held a public hearing on November 19, 1992 subsequent to which by the Findings of Fact, Conclusion and Decision dated November 20, 1992 they approved the proposal. 4. Lee Nilson and the Micaview Landowners Association filed an appeal on November 24, 1992 and listed the following as a basis for the appeal of the Hearing Examiner Committee decision: (a) Inadequate access, including too narrow of a road and lack of fire and safety vehicle turn arounds, (b) The density of the development is inconsistent with the single family nature of the neighborhood and the Urban Residential-3.5 (UR-3.5) intended uses. 5. The legal requirements for public norice have been fulfilled. 6. The Board adopts the Planning Department Report and file ZE-39-92 as part of this record, as may be modified by this action. 7. The adopted Spokane County Generalized Comprehensive Land Use plan designates the area encompassed by the proposal as Urban. 8. The Board takes notice of the provisions of the Spokane County 1990 Generalized Comprehensive Plan (1990 printing, as amended), and the Spokane County Zoning Code (1992 printing, as amended). 9. The original zoning of the property was established in 1958 as Agriculture. The zoning was redesignated by Spokane County on January 1, 1991 to Urban Residenrial-3.5 (UR-3.5) pursuant to the program to implement the Spokane County Zoning Code. • ~ . The proposed densiry of approxirnately 5.7 units per acre is consistent with the residential net densiries recommended by the Urban category of the Comprehensive Plan. 11. The proposal is surrounded by single family residential lots and large tracts of 2-5 acres which are undeveloped or used for pasture/animal keeping. The surrounding properties are zoned primarily Urban Residendal-3.5 (UR-3.5). The proposal is generally inconsistent with the density and zoning of the surrounding land uses and the uses allowed in the Urban Residenrial-3.5 (UR-3.5) zone. 12. The multifamily structure proposed for the site does not provide transition between surrounding single family residendal uses and more intensive uses, as contemplated by the Urban category of the Comprehensive Plan. The industrial/commercial uses located to the northwest near Appleway Road are not adjacent to the site and are too remote to play a part in such a transition. 13. The five unit multifamily structure proposed does not enhance the residential character or aestheacs of the area and the proposal is therefore inconsistent wic11 decision guidelines of the Urban category of the Comprehensive Plar:. 14. The Comprehensive Plan dces not per se encourage multifamily development along arterial streets as recited in the Planning Department's report, but states that multifamily development should be located adjacent to arterials as opposed to interior neighborhood streets, and should improve or maintain the consistency of adjacent single-family area amenities. ~ 15. The owners of the surrounding properties generally opposed the proposal and the proposed rezone to Urban Residential-7 (UR-7). While not controlling, the views expressed provide an ind.ication that the proposed rezone does not bear a substantial relation to the general welfare of the community. 16. Neighborhood concerns over potential traffic impacts to surrounding single family properties from the proposal and density and potential land use conflicts with large tracts used for animal keeping/pasture located south and east of the proposal are particularly valid. 17. The character of the neighborhood has remained single family residential and larger tract animal keeping/pasture for some time. No multifamily development has been approved adjacent to Sprague Avenue in the neighborhood of the proposal (other than duplexes). The more dense zoning in the area referenced on page 6 of the Planning Department's report is simply too remote to support a conclusion that condirions in the neighborhood of the proposal have changed sufficiently to warrant a rezone. 18. The applicant has not demonstrated that conditions have substantially changed since the original zoning of the site to warrant a rezone to Urban Residential-7 (UR-7 ) and approval of the proposal. 19. The requested rezone action does not bear a substantial relationship to the public health, safety and welfare. DECISION The Board dces hereby approve the appeal and therehy denies ,nproval of the pro~o-.,,il an;' the requested rezone. to implement the Artenal Road Plan, in addiaon to the required nght-of-way dechcation, a smp of property 8 feet in width along the Sprague Avenue frontage shall be set aside in reserve This property may be acquued by Spokane County at the time when artenal improvements are made to Sprague Avenue 16 There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisihon Spokane County assumes no financial obhgation for adjustments or relocanon regarding these utilities Applicant(s) should check with the applicable utility purveyor and the Spokane County Englneer to determine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work SPOKANE COiJN'TY DIVISION OF LITILI'I'IES 1 Pursuant to the Board of County Commissioners Resolutlon No 80-0418, the use of on-site sewer disposal systems is hereby authonzed This authonzaaon is conditioned on compliance with all rules and regulations of the Spokane County Health Dismct and is further condlnoned and subject to specific applicanon approval and issuance of permits by the Health Dismct 2 The owner(s) or successor(s) in interest agree to authonze the County to place their name(s) on a pehhon for the formahon of ULID by petition method pursuant to RCW 36 94, which petition includes the owner(s)' property, and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36 94 which includes the owner(s)' property PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjuncnon with the formanon of a ULID by either petition or resolution method under RCW Chapter 36 94 3 Any water service for ttus project shall be provided in accordance with the Coordinated on-site sewage d.isposal pernut or building permit for this project 2 Sewage clisposal method shall be as authonzed by the Duector of Utilines, Spokane County 3 Water service shall be coordinated through the Director of Utilines, Spokane County 4 Water service shall be by an existing public water supply when approved by the Reglonal Engineer (Spokane), State Department of Health 5 Disposal of sewage effluent beneath paved surfaces is currently prohibited 6 Subject to specific applicaaon approval and issuance of pernuts by the health officer, the use of indlvidual on-site sewage disposal system may be authonzed 7 Use of pnvate wells and water systems is prohibited SPOKANE COUNTY DIVISION OF BUILDINGS 1 The appllcant shall contact the Department of Build.ing and Safety at the earliest possible stage of design/development in order to be informed of code requirements admirustered/enforced by the department, e g, State Building Code Act regulatlons, such as requuements for fire hydrantJflow, fire apparatus access roads, street address assignment, bamer-free regulations, energy code regulahons and general coordination with other aspects of project implementaaon 2 Requirements of Fire Distnct No 1 need to be sahsfied dunng the buildmg permit process SPOKANE COUNTY AIR POLLUTION COIVTROL AUTHOItITY 1 All au pollunon regulatlons must be met This includes but is not limited to the following 2 Air pollution regulations require that dust emissions dunng demolition, construction and excavation projects be controlled This may requv-e use of water sprays, tarps, spnnklers or suspension of activxty dunng certain weather conditions Haul roads should be treated, and emissions from the transfer of earthen matenal muSt be controlled, as well as errussions from all other
