II. FINDINGS OF FACT AND CONCLUSIONS
The Hearing Examiner has reviewed the zone reclassification application and the
evidence of record, and hereby adopts the following findings of fact and conclusions:
A. GENERAL INFORMATION:

Location: Generally located north of Appleway Avenue, approximately 700 feet east of the
intersection of Appleway and Sprague Avenue, in Section 18, Township 25 North, Range 45
EWM, Spokane County, Washington.
Legal Description: Lot 21, Block 18 of Corbin Addition to Greenacres, Except highway, situate
in the County of Spokane, State of Washington.
Zoning: Neighborhood Business (B-1). The site is also located in the Aquifer Sensitive
Overlay zone and the Public Transit Benefit Area designated by the County Zoning Code.
Comprebensive Plan Category: The property is designated in the Major Commercial
category of the Spokane County Generalized Comprehensive Plan. The site is also designated
within the Priority Sewer Service Area, Urban Impact Area and Aquifer Sensitive Area
designated in the Plan.
Environmental Review: The Division of Building and Planning issued a Determination

Site Description: The site is approximately .9 acres in size. The site is flat and has three
existing buildings, including a residence and two detached buildings. A cyclone fence surrounds
the subject property. Access to the site is from Appleway Avenue. The property is within the
Interim Urban Growth Area (NGA) boundaries designated by Spokane County under the
Washington State Growth Management Act.
Surrounding Conditions: The site lies adjacent to Appleway Avenue, which the Spokane
County Arterial Road Plan identifies as a Principal Arterial. Appleway Avenue intersects
Sprague Avenue, which is desi,gnated as a Principal Arterial west of Appleway Avenue, to the
southwest. Interstate 90 is located at some distance north of the site. Typical strip commercial
development can be found along Appleway Avenue. Surrounding uses include a motorcycle
shop, manufactured home park and vacant land. The land lying immediately south of the site is
zoned Light Industrial (I-2) and is undeveloped. Residential uses are also located south of the site
along Cowley Avenue, which is designated as a Local Access road.
Project Description: The site development plan submitted on June 4, 1997 shows the existing
structures on the site, indicating they are to remain on site, with no new buildings planned at the
current time. The site is currently served by on-site sewage disposal.

C. ZONE RECLASSIFICATION ANALYSIS:
1 Approval cntena
In considenng a rezone application, Washington case law generally provides that (1) there is
no presumption in favor of the rezone, (2) the applicant for the rezone must prove that condihons
have substantially changed in the area since the last zoning of the property, and (3) the rezone
proposal must bear a substantial relationship to the public health, safety or welfare Parkridge v
Seattle, 98 Wn 2d 454, 462 (1978), and Bjarrison v Kitsap County, 78 Wn App 840 (1995)
Deviation from a comprehensive plan does not necessanly render a rezone illegal The
plan is considered as a general bluepnnt and only general conformance with such plan is required
to approve a rezone Citizens for Mount Vernon v Ccty of Mount Vernon, 133 Wn 2d 861, 873
(1997), Cathcart v Snohonttsh County, 96 Wn 2d 201, 211-12 (1981), and Bassanc v County
Comnzrssioners, 70 Wn App 389 (1993) Also see RCW 36 70 340 and RCW 36 70 020 (11)
Some Washington cases have dispensed with the changed circumstances requirement where the
proposed rezone closely implemented the policies of a comprehensive plan Bjarrrson v Kitsap
County, 78 Wn App 840, 846 (1995), and Save Oiir Rarral Envcronment v Snohomzsh Cozrnty,
99 Wn 2d 363, 370-371 (1983) Where a comprehensive plan conflicts with zoning regulations,
the provisions of the zoning code will normally be construed to prevail See Weyerhaeuser v
Pierce Cotcnty, 124 tiVn 2d 26, 43 (1994), Cougar Mt Assocs v Kcng County, 111 Wn 2d 742,
755-57 (1988), and Nagatani Bros v Commissioners, 108 Wn Zd 477,480 (1987)
The County Heanng Examiner Ordinance authorizes the Heanng Exarruner to hear and
decide rezone applications The Examiner is authonzed to grant, deny or grant with such
conditions, modifications and restnctions as the Examiner finds necessary to make the
application compatible with the Spokane County Generalized Comprehensive Plan and
development regulations See County Resolution No 96-0171, Attachment "A", paragraphs 7
(d) and section 11, and RCW 36 70 970 Applicable development regulations include without
limitation the Spokane County Zoning Code, the State Environmental Policy Act (SEPA) and the
County's Local Environmental Ordinance (chapter 11 10 of the Spokane County Code)
Section 14 402 020 of the Zoning Code authonzes amendments to the Code based on any
one of six (6) grounds, without differentiating between amendments to the zoning text of the
code and amendments to the official zoning map Zoning Code 14 402 020 (1) authonzes the
Code to be amended if it is " consistent with the Comprehensive Plan and is not detnmental to
the public welfare " Zoning Code 14 402 020 (2) authonzes a Code amendment where "
[c]hange in economic, technological, or land use conditions has occurred to warrant modification
of this Code " These are the most relevant cntena for consideration of the current rezone
applicahon
Spokane County Zoning Code 14 100 104 indicates that the Zoning Code shall be
interpreted to carry out and implement the purpose and intent of the Comprehensive Plan, and the
general plans for physical development adopted by the Board of County Commissioners Zoning
Code 14 100 106 states that when the Zoning Code conflicts with the Comprehensive Plan, or
other adopted plans and regulations of the County or other regulatory agencies, the more
restnctive provisions shall govern to the extent legally permissible and the Zoning Code
provisions will be met as a minimum The Comprehensive Plan itself indicates that it should be

used as a reference source and guide for making land use decisions eomprehensive Plan, p 2
The relevant "decision guidelines" set forth in the Plan are to be used as a guide to determine
whether a particular proposal should be approved, conditioned or denied

health, safetv and general welfare. and complies with the Spokane County Zoning Code and

The Staff Report finds the project to be consistent with the Major Commercial category in
which the site is located The Examiner agrees with the analysis of the Comprehensive Plan
contained in the Staff Report and adopts the same herein as findings and conclusions
There was no public opposition to the project The proJect is compatible with other
commercial uses in the area and other surrounding land uses The proJect is conditioned for
compliance with the B-3 zone and the County Zorung Code
The procedural requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane
County Code have been met The Heanng Examiner concurs with the Determination of
NonSignificance issued by the Division of Building and Planlung No adverse comments were
received from the reviewing public agencies which cannot be resolved through the conditions of
approval As conditioned, the proposal will not have more than a moderate effect on the quality
of the environment
3 Conditions in the area in which the oroperty is located have changed substantiallv since
the vropertv was last zoned
In applying the changed circumstances test, courts have looked at a vanety of factors,
including changed public opinion, changes in land use patterns in the area of the rezone proposal,
and changes on the property itself The Zoning Code references changes in "economic,
technological or land use conditions" as factors that will support a rezone Spokane County
Zoning Code 14 402 020 (2) Washington courts have not required a"strong" showing of
change The rule is flexible, and each case is to be judged on its own facts Bassani v Countv
Commissioners, 70 Wn App 389, 394 (1993) Recent cases have held that changed
circumstances are not required for a rezone if the proposed rezone implements policies of a
comprehensive plan Biarnson at 846, Save Our Rural Environment v Snohomish Countv, 99
Wn 2d 363, 370-371 (1983)
As indicated above, the proposal generally conforms with the Comprehensive Plan
Changed conditions since the property was last zoned include population growth in the area and
increased traffic along Appleway Avenue

III. DECISIOIV
Based on the Findings and Conclusion above, the above zone reclassification application is
approved, subject to the conditions of the vanous public agencies specified below Any
conditions added or significantly altered by the Heanng Examuier are rtalccrzed
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Heanng Examiner This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies withjunsdiction over land development
Conditions added or substantially modified by the Heanng Examiner are italccazed
SPOKANE COUNTY DIVISION OF BiJILDING AND PLANNING
1 The proposal shall comply with the Regional Business (B-3) zone and other applicable
proviscons of the Spokane County Zoning Code as amended
2 The applicant shall develop the subject property generally in accordance within the concept
presented to the Heanng Examiner Vanations, when approved by the Director of the Division
of Building and Planrung/designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the permltted zone All vanations must
conform to regulations set forth in the Spokane County Zoning Code, and the onglnal intent of
the development plans shall be maintained
3 A specific landscape plan, planting schedule and provisions for maintenance acceptable to
the Director of the Division of Building and Planiung/designee shall be submitted with a
performance bond for the project or other suitable guarantee pnor to release of building permits
Landscaping shall be installed and maintained so that slght distance at access points is not
obscured or impaired
4 Direct light from any extenor area lighting fixture shall not extend over the property
boundary
5 Approval is required by the Director of the Divlsion of Building and Plaiumng/designee of a
specific lighting and sigrung plan for the descnbed property pnor to the release of any building
permits
6 The Division of Building and Planning shall prepare and record with the Spokane County
Auditor a Title Notice, noting that the property in question is subject to a vanety of special
conditions imposed as a result of approval of a land use achon This Title Notice shall serve as
public notice of the conditions of approval affecting the property in question The Title Notice
should be recorded within the same time frame as allowed for an appeal and shall only be
released, in full or in part, by the Division of Building and Planrung The Title Notice shall
generally provide as follows

7 The Division of Building and Planning shall file with the Spokane Counry Auditor, witlun
the same time frame as allowed for an appeal from the final disposition, including lapsing of
appeal penod, a Title Notice, which shall generally provide as follows
"Prior to the issuance of any building permit for any building or any use on the property
descnbed herein, the applicant shall be responsible for complying with the provisions of the
Spokane County Zoning Code, Section 14 706 (Aquifer Sensitive Area Overlay Zone) The
property which is the subject of this notice is more particularly descnbed as follows "

Pr1or to release of a building permit or use of property as proposed:
1 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
2 The applicant shall submit for approval by the Spokane County Engineer and the
Spokane Regional Health Distnct a detailed combined on-site sewage system plan and surface
water disposal plan for the entire project or portion thereof if the development is phased
3 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer The design, location and arrangement of parking stalls shall be in
accordance with standard engineenng practices Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be occupied or traveled-by
vehicles
4 To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be wiliing to participate in any petition or resolution
which purpose is the formation of a Road Impravement Distnct (RID) for said improvement
pursuant to RCW 36 88, as amended Spokane County will not participate in the cost of these
improvements This provision is applicable to Apple Way Avenue
5 As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road improvements
stated herein by jotning and participating in a County Road Project (CRP) to the extent of the
required improvement Spokane County will not participate in the cost of these improvements
This provision is applicable to Apple Way
6 The County Engineer has designated a 5 Lane Pnncipal Artenal Roadway Section for the
improvement of Apple Way which is adjacent to the proposed development This will require the
addition of approximately 13-15 feet of asphalt along the frontage of the development Curbing
and sidewalk must also be constructed

7 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bndge construction and other applicable county standards and/or
adopted resolutions pertalning to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer
8 The applicant shall construct a paved and delineated approach(s) to meet the existing
pavement on Apple Way
9 No construction work is to be performed within the existing or proposed ncyht of way
until a permlt has been issued by the County Engineer All work within the public road nght of
way is subject to inspecrion and approval by the County Engineer
10 All required construction within the existing or proposed public nght of way is to be
completed pnor to the release of a building permit or a bond in an amount estimated by the
County Engineer to cover the cost of construction or improvements shall be filed with the
County Engineer
11 Applicant shall sign "Spokane County Notice to the Public Number 6" whlch specifies
the following
The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits
now or to be hereafter denved, do for themselves, their heirs, grantees, assigns and successor(s)
in interest hereby request and authonze Spokane County to include the above descnbed property
in a Road Improvement Distnct (RID) and to support the formation of a Road Improvement
Dismct for improvement of the road(s) descnbed below by requesting and authonzing Spokane
County to place their name(s) on a pehtion for the formation of a Road Improvement Distnct
pursuant to RCW 36 88 050, or by requeshng and authonzing Spokane County to cast their
ballot in favor of a RID being formed under the resolution method pursuant to RCW 36 88 030,
and/or by not filing a protest against the formation of a RID being formed under the alternative
resolution method provided for in RCW 36 88 065 and Chapter 35 43 RCW
If a RID is proposed for improvement of the road(s) descnbed below, said owner(s) and
successor(s) further agree (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be denved from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property wlthin the proposed RID
is sufficiently developed, provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the nght, as authonzed under RCW 36 88 090, to object to any assessment(s) on the
property as a result of the improvements called for in con~unction with the formation of a RID by
either the petition or resolution method under Chapter 36 88 RCW and to appeal to the Superior
Court the decision of the Board of County Commissioners confirming the final assessment roll,
provided further, it is recognized that actual assessments may vary from assessment estimate so
long as they do not exceed a figure equal to the increased true and fair value improvement(s)
add(s) to the property
It is further acknowledged and agreed that at such time as a RID is created or any County
Road Impro-vement project is authonzed by Spokane County, the improvements required shall be

at the sole expense of the owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County
The RID waiver contained in this agreement shall expire after ten (10) years from the

County
3 Water service shall be coordinated through the Director of Utilities, Spokane County

5 Disposal of sewage effluent beneath paved surfaces is currently prohlbited

Description of the Site:
The site is approximately .9 acres in size. The site is flat and has three existing buildings; a residence and
finro detached buildings. Access to the site is from Appleway Avenue. The Spokane County Arterial Road
Plan identifies Appleway Avenue as a Principal Arterial. Typical strip commercial development can be found
along Appleway Avenue. Surrounding uses include a motorcycle shop, manufactured home park and
vacant land. Residential uses are also located to the south of the site along Cowley Avenue.
Background:
The applicant submitted the rezone proposal to the Division of Building and Planning on May 8, 1997. The
proposal is a request to change the zoning on .9 acres from Neighborhood Business (B-1) to Regional
Business (B-3), for those uses allowed in the Regional Business (B-3) zone. The subject property consists
of Lot 21 of Corbin Addition to Greenacres. The current use of the property is residential. The applicant has
not proposed a new use with the rezone request and no site plan has been submitted. The subject property
was previously zoned Local Business (LB) and crossed over to Neighborhood Business (13-1) in January,
1991, with implementation of the Spokane County Zoning Code.
Staff Analysis:
The subject property is located within the Major Commercial category of the Comprehensive Plan. The
Major Commercial category is intended to provide the opportunity for development of commercial uses,
specifically community and regional shopping centers and commercial uses, directly related to major
throughways. Major Commercial areas feature high-intensity uses and will be composed of three different
types of commercial development: shopping centers, highway and arterial commercial strips and freeway
commercial.
Most commercial development will be on relatively flat land and buildings of a low profile. Paved parking,
streets and man-made structures will dominate the site with few natural features to be found. Landscaping,
screening, lighting, signage and other architectural treatment will provide for aesthetically pleasing
development. Major Commercial areas require a full line of public services and utilities. These include
service by or commitment to sanitary and storm sewers, public water systems and underground utilities
such as telephone, gas and electricity. The subject property is located on a principal arterial and is served

by a full line of public services including public water and underground utilities. Future development on the
site will require the installation of double ptumbing.
The proposed rezone from Neighborhood Business (13-1) to Regional Business (B-3) is generally supported
by the Goals, Objectives and Decision Guidelines of the Major Commercial category of the Comprehensive
Plan.
The intent of Section 14.402 of the Spokane County Zoning Code is to allow for amendments to the Zoning
map and states that "circumstances may arise that make it necessary to revise these documents from time
to time". Changed circumstances in the general area include the commercial strip development of many of
the existing Community Business (B-2) and Regional Business (13-3) properties along Appleway Avenue.
The purpose of the proposed Regional Business (B-3) zone is to provide for the location of a wide range of
retail and service activities and to implement the Major Commercial category of the Comprehensive Plan.
The intent is to implement Comprehensive Plan policies which encourage commercial development along
Principal Arterials or highways and establish regional serving commercial areas. General characteristics of
these areas include paved roads and sidewalks, public sewer and water, and a full line of public services
including manned fire protection and public transit accessibility.
The proposed rezone is generally consistent with the purpose and intent of the proposed B-3 zone due to
location adjacent a principal arterial, provision of public services and consistency with adjacent land uses.
No site plan was submitted with the rezone proposal and the applicant has requested those uses allowed in
the Regional Business (B-3) zone. Future site development or change of use will require compliance with
the development standards of the Regional Business (B-3) zone, including 5 feet of Type IIl landscaping and
paved off-street parking areas per Sections 14.806.040 and 14.802.040 of the Zoning Code.
Affected agencies have submitted requested conditions of approval which are standard for rezone
applications. These conditions include the installation of double plumbing for future connection to public
sewer and the construction of curbing and sidewalk along Appleway Avenue.
Staff Recommendation:
The Division of Building & Planning recommends approval, as conditioned.

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed•
1 Access permits for approaches to the County Road System shall be
obtained from the County Engineer
2 The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on-site
sewage system plan and surface water disposal plan for the entire
project or portion thereof lf the development is phased
3 A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices Paving or surfacing as approved by the County
Englneer will be required for any portion of the project which is to
be occupied or traveled by vehicles
4 To construct the roadway improvements stated herein, the applicant
may, with the approval of the County Engineer, Join in and be willing
to participate ln any petition or resolution which purpose is the
formation of a Road Improvement District (RID) for said improvement
pursuant to RCW 36 88, as amended Spokane County will not participate
in the cost of these improvements This provision is applicable to

accomplish the road improvements stated herein by 3oining and
participating in a County Road Project (CRP) to the extent of the
required improvement Spokane County will not participate in the cost

6 The County Engineer has designated a 5 Lane Principal Arterial
Roadway Section for the improvement of Apple Way which is adjacent to
the proposed development This will require the addition of
approximately 13-15 feet of asphalt along the frontage of the
development Curbing and sidewalk must also be constructed
7 All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge construction
and other applicable county standards and/or adopted resolutions
pertaining to Road Standards and Stormwater Management in effect at
the date of construction, unless otherwise approved by the County

S The applicant shall construct a paved and delineated approach(s) to
meet the existing pavement on Apple Way
9 No construction work is to be performed within the existing or
proposed right of way until a permit has been issued by the County
Engineer All work within the public road right of way is subDect to
inspection and approval by the County Engineer
10 Al1 required construction within the existing or proposed public right
of way is to be completed prior to the release of a building permit or
a bond in an amount estimated by the County Engineer to cover the cost
of construction or improvements shall be filed with the County
Engineer
11 Applicant shall sign "Spokane County Notice to the Public Number 6"
which specifies the following

of Mutual Benefits now or to be hereafter derived, do for themselves,
their heirs, grantees, assigns and successor(s) in interest hereby
request and authorize Spokane County to include the above described
property in a Road Improvement District (RID) and to support the
formation of a Road Improvement District for improvement of the
road(s) described below by requesting and authorizing Spokane County
to place their name(s) on a petition for the formation of a Road
Improvement District pursuant to RCW 36 88 050, or by requesting and
authorizing Spokane County to cast their ballot in favor of a RID
being formed under the resolution method pursuant to RCW 36 88 030,
and/or by not filing a protest against the formation of a RID being
formed under the alternative resolution method provided for in RCW
36 88 065 and Chapter 35 43 RCW

or construction contemplated within the proposed RID are feasible and
(2) that the benef its to be derived from the f ormation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed, provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW
36 88 090, to ob3ect to any assessment(s) on the property as a result
of the lmprovements called for in con3unction with the formation of a
RID by either the petition or resolution method under Chapter 36 88
RCW and to appeal to the Superior Court the decision of the Board of
County Commissioners confirming the final assessment roll, provided
further, it is recognized that actual assessments may vary f rom
assessment estimate so long as they do not exceed a figure equal to
the increased true and fair value improvement(s) add(s) to the

Consolidated Imgation District Water supply will be a public system
c) The project is inside the Spokane County Comprehensive Wastewater Management Area, inside the
General Sewer Service Area, and inside the Priority Sewer Service Area recommended in the '201'
Study The method of sewage disposal is subject to approval of the Director of Utilities, Spokane
County, pursuant to County Resolution 80 0418 adopted March 24, 1980 The topography and soils in
the area are generally suitable for use of individual on-site sewage disposal systems The lots are not
of the proper dimenslons to permit the use of both individual wells and sewage systems

Prior to release of a building peranit or use of property as proposed:
1 Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
2 The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on-site
sewage system plan and surface water disposal plan for the entire
project or portion thereof if the development is phased
3 A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be
occupied or traveled by vehicles.
4. To construct the roadway improvements stated herein, the applicant may,
with the approval of the County Engineer, Join in and be willing to
participate in any petition or resolution which purpose is the
formation of a Road Improvement District (RID) for said improvement
pursuant to RCW 36 88, as amended Spokane County will not participate
in the cost of these improvements. This provision is applicable to
Appleway.

5. As an alternative method of constructing the road improvements stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by 3oining and
participating in a County Road Project (CRP) to the extent of the
required improvement Spokane County will not participate in the cost
of these improvements This provision is applicable to Appleway
6. The construction of the roadway improvements stated herein shall be
accomplished as approved by the Spokane County Engineer
7 The County Engineer has designated a 5 Lane Principal Arterial Roadway
Section for the improvement of Appleway which is adDacent to the
proposed development. This will require the addition of approximately
13-15 feet of asphalt along the frontage of the development Curbing
and sidewalk must also be constructed
8. Al1 required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge construction and
other applicable county standards and/or adopted resolutions pertaining
to Road Standards and Stormwater Management in effect at the date of
construction, unless otherwise approved by the County Engineer
9 The applicant shall construct a paved and delineated approachs to meet
the existing pavement on Appleway
10 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 as amended and are applicable to this proposal
11. No construction work is to be performed within the existing or proposed
right of way until a permit has been issued by the County Engineer All
work within the public road right of way is subject to inspection and
approval by the County Engineer
12 Applicant shall sign "Spokane County Notice to the Public Number 6"
which specifies the following
The owner(s) or successor(s) in interest agree that in consideration of
Mutual Benefits now or to be hereafter derived, do for themselves,
their heirs, grantees, assigns and successor(s) in interest hereby
request and authorize Spokane County to include the above described
property in a Road Improvement District (RID) and to support the
formation of a Road Improvement District for improvement of the road(s)
described below by requesting and authorizing Spokane County to place
their name(s) on a petition for the formation of a Road Improvement
District pursuant to RCW 36 88 050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID being formed
under the resolution method pursuant to RCW 36 88.030, and/or by not
filing a protest against the formation of a RID being formed under the
alternative resolution method provided for in RCW 36 88 065 and Chapter
35.43 RCW

If a RID is proposed for improvement of the road(s) described below,
said owner (s) and successor (s) further agree (1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed, provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36 88 090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and'to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below This provision is applicable
to Appleway
13 The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards
