review of the zone reclassification application and the entue record, hereby makes the following
findings of fact, conclusions of law and decision
1. FINDINGS OF FAC'I'
1 The application requests a rezone of approximately 1 37 acres of land from the Urban
Residential-3 5(UR-3 5) zone to the Light Industnal (I-2) zone, to develop a storage facility for
recreanonal velucles
2 The site is generally located west of and adjacent to Barker Road, between and adjacent to
Sharp Avenue and Sinto Avenue, in the NE '/4 of Section 18, Township 25 North, Range 45
EWM, Spokane County, Waslungton
3 The site is currently referenced as County Assessor's tax parcel nos 55181 2509 and 2510
The subject property is legally descnbed as Lots 1 and 2, Block 1, Bates Addition to Valley
View Addition to Spokane, according to plat recorded in Volume E of Plats, Page 18, records of
Spokane County, Waslungton
4 The applicant for the proposal and the owner of the site are Bob and Teresa 11hlholland,

8 The Heanng Examiner reopened the record on July 3, 2002, to consider a revised site plan
subnutted by the applicant, luruting access to the site from Sharp Road and Sinto Road, and to
consider modified County Engmeeruig condihons of approval addressing such revised access
The record was closed on July 22, 2002

12 The site is 1 37 acres in size, rectangular ln shape and flat in topography The site is
occupied by a smgle-fanuly residence located in the northeast comer of the site, a detached
garage located along Sinto Avenue, and two, small detached sheds located along Barker Road
The residence is served by an on-site sewage disposal system and public water T'he remainder
of the site is covered with landscaping, native grasses, and scattered trees and shrubs
13 Effective January 1, 1991, the zonuig of the site was reclassified from the Agncultural
Suburban zone of the now expired County Zorung Ordiriance to the UR-3 5 zone, pursuant to the
Program to Implement the Spokane County Zorung Code The site is also located in the Aquifer
Sensinve Area (ASA) Overlay zone and the Public Transit Benefit Area designated by the
Zorung Code
14 On November 14, 2001, the applicant submitted a rezone application, envlronmental
checklist, site plan and application fees The County Division of Plannmg found the subject
applicahon to be "counter-complete" on November 16, 2001
15 On March 27, 2002, the applicant submitted a revised site plan On June 28, 2002, the
applicant submitted a final revised site plan, hereinafter referred to as the "site plan of record"
The revised site plans did not substantially modify the onginal site plan or rezone application,
such that a new rezone application would be reqwred

' 16 The site plan of record illustrates use of the existing home on the site as a caretaker's
residence, retention of the detached garage and removal of the two sheds The site plan ind.icates
surfacing of the site with crushed gravel, a 30-foot wide entrance along Barker Road for the
storage facility, a 20-foot wide entrance along Sinto Avenue for the caretaker's residence, and no
access to Sharp Avenue The site plan of record also illustrates an 8-foot high chain luik fence
around the penmeter of the subject property
17 No additional water or sewer services are proposed to serve the proposal The applicant
proposes to install requued Type III penmeter landscaping adjacent to Barker Road, Sharp
Avenue and Sinto Avenue, and along the west boundary of the property The envuonmental
checklist indicates that approximately 30% of the site would be covered by recreahonal velucles,
and that there would be 40 recreational velucle storage spaces
18 Effective January 15, 2002, the County unplemented a new Comprehensive Plan ("GMA
Comprehensive Plan"), County Urban Growth Area (UGA) boundanes, and Phase I
Development Regulations, all in implementahon of the State Growth Management Act The
County also repealed the intenm development regulations previously adopted by the County
under the State Growth Management Act See County Resoluhon Nos 2-0037 and 2-0470
19 The site and the surrounding area are designated in the County UGA Pnor to January 15,
2002, the site was designated inside the County's intenm urban growth area (NGA) boundanes
20 The Phase I Development Regulations allow a rezone application witlun the UGA that is
"counter-complete" before the adophon of such regulations on January 15, 2002, and that is
"inconsistent" with the "crossover zomng" of the property under the Phase I Development
Regulations, to be processed under the comprehensive plan and land use regulahons in effect
when the application became "counter-complete" If the rezone application is approved, the new
zomng is effechve for a penod of one (1) year, and development of the property may proceed
under the condrtions of the rezone provided a building permrt is subnutted withm the 1-year
penod After one (1) year, the zomng of the property will revert back to the crossover zone
21 The Phase I Development Regulations designate the site in the Low Density Residenhal
category of the GMA Comprehensive Plan, and retained the UR-3 5 zomng ("cross-over zone")
of the site The proposed rezone of the site to the UR-22 zone is "inconsistent with" the
crossover zomng of the site under the Phase I Development Regulations
22 The Examiner must consider the current rezone applicahon under the comprehensive plan
and development regulations ul effect on November 14, 2001, the date when the applicahon
became "counter-complete" Tlus includes the old Comprehensive Plan ("Comprebensrve
Plan"), County Zorung Code, County Road Standards, intenm development regulations for land
located inside the County's IUGA boundanes, and other development regulations in effect on
November 14, 2001
23 The site and neighbonng land are designated in the Urban category of the Comprehensive
Plan, except for the land lying east of Barker Road between Cataldo Avenue and Interstate 90,
wluch land is designate in the Industnal category The site is also located witlun the Aquifer
Sensitive Area, Pnonty Sewer Service Area and Urban Impact Area designated by the
Comprehensive Plan

24 The Artenal Road Plan in the Comprehensive Plan designates Boone Avenue, east of
Barker Road, and Barker Road, as Pruicipal Artenals All other roads in the vicuuty are
considered Local Access roads Mission Avenue to the north is designated as a Mmor Artenal
The Artenal Road Plan in the GMA Comprehensive Plan designates Barker Road as an Urban
Pnncipal Artenal and Mission Avenue as an Urban Collector Artenal
25 Barker Road, Sharp Avenue and Sinto Avenue in the viciruty are currently 2-lane roads
without curb or sidewalk Interstate 90 is located approxunately 1,000 feet south of the subject
property The Barker Road/I-90 freeway interchange is located approximately 440 feet south of
the site at its closest point "
26 The Phase I Development Regulations designate the land lying west of Barker Road in the
area in the Low Density Residential category of the GMA Comprehensive Plan, and the land
lying east of Barker Road, north of Boone Avenue, in the Medium Density Residential category
Such regulations designate the land lying east of Barker Road, south of Boone Road, in the Light
Industnal category, except for a parcel designated Regional Commercial at the southeast comer
of Barker Road and Boone Avenue
27 The Phase I Development Regulations retained the UR-3 5 zoning of the land lying west of
Barker Road in the vicuuty Such land is developed with single-family homes and some
duplexes, with two exceptions as noted below New subdivisions have been developed east of
Barker Road, north of Mission Avenue, in the vicinity
28 The Phase I Development Regulations reclassified the zoning of the parcel located north of
the site, at the southwest corner of Mission Avenue and Barker Road, from the Neighborhood
Business (B-1) zone to the UR-3 5 zone In 2001, the zoning of such parcel was rezoned to the
B-1 zone, to make an existing non-conforming commercial use on such parcel a confomung use,
and to allow unspecified commercial development of the parcel See Heanng Exanuner decision
in File No ZE-29-00 The zonulg of the parcels lying immed.iately south and southwest of the
site, across Sharp, was reclassified from the I-2 zone to the UR-7 zone Such parcels are
improved with a converuence store with fuel islands, and an adjoining small stnp mall

29 The Phase I Development Regulations reclassified the zorung of the land lying east of
Barker Road in the viciruty, north of Boone Avenue, except for certaun land already zoned Urban
Residential-7 (UR-7), from the UR-3 5 zone to the UR-7 zone Such land is developed with
single-family homes and some duplexes, except for a learning center located directly east of the
site across Barker Road Lot sizes on the east side of Barker Road are generally larger than on
the west side
30 The Phase I Development Regulations retained the I-2 and B-3 zorung of the land lying
southeast of the site and east of Barker Road, between Boone Avenue and I-90 Such land is
developed with a mixture of light industrial and conunercial uses Scattered parcels of
undeveloped land and a transit center are also found in the vicuuty
31 The "implementing zone" for the site under the Phase I Development Regulations is the
UR-3 5 or UR-7 zones Such regulations prohibit the submittal of any new rezone application
for the site after January 15, 2002 for any zone but the UR-3 5 and UR-7 zones

32 Pursuant to County Resolution No 97-0874, the applicant must demonstrate the
availability of public sewer for the project, or that the site is located inside the 6-year sewer
capital improvement plan contained in the 1996 Update to the County Comprehensive
Wastewater Management Plan (CWMP)
33 The srte is located outside the 6-year sewer capital improvement plan specified in the 1996
Update to the CWMP The conditions of approval recommended by County Uhlrties requue the
apphcant to enter into a sewer connection agreement with the County and to connect to public
sewer
34 A public sewer line is located approxunately 700 feet north of the site, north of 11hssion
Avenue The apphcant has reached a preliminary understanduig with certain owners of property
to connect the improvements on the subject properiy to the public sewer line to the north,
through a pnvate sewer extension See letter dated September 18, 2001 from Playfalr Business
Park to Robert Milholland This indicates that the extension of public sewer is feasible for the
subject property, and can be made available by extending a pnvate sewer line to the site
35 The only opposinon to the proposal was expressed by Sandra Thomas, the owner of the
smgle-fanuly home located directly west of the north half of the site Such owner objected to the
proposal on the basis that it would increase traffic along Sinto Avenue, would be an eyesore, and
the value of her property would be lowered
36 The I-2 zone is intended to implement the Industnal category of the Comprehensive Plan,
not the Urban category in which the site is designated However, the Urban category
contemplates light industnal uses located along the more heavily traveled streets, and only
indicates that heavy industnal uses would be incompatible ui such category The Urban category
discourages the development of single-fanuly homes along heavily traveled streets
37 The proposed rezone abuts and will take pruncipal access off Barker Road, which road is
designated as a Prulcipal Artenal and is a heavily traveled street The Barker Road/I-90
Interchange is located less than a quarter nule to the south The site is located duectly across
Sharp Avenue from intensive commerciaUindustnal uses The Industnal category is located
approximately 400 feet southeast of the subject property
38 Recreational velucle and self-service storage uses typically do not generate much traffic
and have business hours that are generally compahble with a residential neighborhood Such
uses are intended serve residential neighborhoods
39 To nutigate the concerns of Sandra Thomas, the apphcant offered to place a nuie (9)-foot
tall fence along the west boundary of the site adjacent to the Thomas property, and place smaller
recreational velucles on the north half of the site The applicant also revised the site plan to
eliminate recreational velucle access to Sinto Avenue
40 Zoning Code 14 632 355, establishing storage standards in the I-2 zone, requires " all raw
matenals, firushed products, maclunery and equipment, including company-owned and operated
trucks and motor velucles " to be stored withm an entirely enclosed building or sight-obscuring
non-pierced fence not less than six (6) feet in height, and to a height that screens such items from

view at the ground level This requirement may be waived along certain boundanes of the site if
adjacent properties are zoned in an industnal zone or have exishng industnal uses, and the
owners of sa.id adjacent properties do not object
41 Zorung Code 14 810 020 (6) limits nonresidential fences in the I-2 zone to a maximum
height of eight (8) feet
42 The Staff Report found that the fencing requuement in Zoning Code 14 632 355 applies to
the recreational vehicles stored on the subject property Such fencmg requirement can be waived
along the south property line if the uses on the land located across from the site to the south are
considered industnal and the owner of the land consents
43 To provide a proper buffer and screerung along the west property lme of the site adjacent to
the Thomas property, the fencing along such boundary should be at the maximum height allowed
in the zone, i e eight (8) feet Within the front yard setback apphcable to the site along Smto
Avenue, i e 40 feet from the north lot line of the site, the fence would be limited to a height of
three (3) feet The setback standards of the I-2 zone prohibit the establishment of uses, including
residential vehicle storage, withui the muumum setbacks required in the I-2 zone
44 Zoning Code 14 806 040 requues the applicant to mstall five (5) feet of Type III (see-
through) landscaping adjacent to Sharp Avenue, Sinto Avenue and Barker Road, and to insta1120
feet of Type I(screen) adjacent to the west property line of the site The environmental checklist
states that the applicant plans to install tall arborvitae shrubs along the west property boundary
The Exanuner has added a requuement that recreational vehicles be stored at least 20 feet from
the west property line of the subject property, to provide a proper buffer to the residences located
to the west
45 Zoning Code 14 632 385 requues all uses in the I-2 zone to comply wlth air quality
regulations, design all extenor lighting to be directed away from adjoirung properties, meet state
noise standards, and comply with all federal, state and local laws and ordina.nces protective of
soil, ground and surface water, air and human health
46 County Engineenng conditions of approval, as revised on July 11, 2002, require the
applicant to dedicate nght of way to the County along adJ acent streets, and unprove Barker Road
to a 5-lane artenal road sechon by adding pavement, curb and sidewalk The applicant is
required to participate in the improvement of Sinto and Sharp Avenues through a future road
unprovement distnct or County road project, if such occurs County Engmeenng conditions also
requ.ire pavuig or surfacing for any portion of the site occupied or traveled by velucles
47 Sigiuficant changes have occurred in the area since the site was zoned UR-3 5 m 1991,
which support approval of the rezone Tlus includes increased traffic along Barker Road and I-
90 in the viciruty, moderruzation of the HICO converuence store and stnp mall located directly
south and southwest of the site, extension of pubhc sewer to the area, increased residential
growth in the area increasing the demand for RV storage, the availabihty of public sewer, and
designation of the site inside the County's IUGA boundanes

48 The project has been conditioned for compliance with the development standards of the I-2
zone and other applicable provisions of the County Zoning Code, and the recommendations of
the commenting public agencies
49 The rezone is subject to the one (1)-year restnchon on building pemuts unposed by the
Phase I Development Regulahons
50 As conditioned by the Exaininer, the proposal will be reasonably compatible with
neighborulg single-family homes and other land uses in the vicuuty
Based on the above findings of fact, the Heanng Examiner enters the followmg
II. COIVCLUSIONS OF LAW
1 The proposed rezone, as conditioned, generally conforms to the Comprehensive Plan
2 The proposed rezone bears a substantial relationship, and will not be detnmental, to the
public health, safety or welfare
3 A change in economic, technological, or land use conditions has occurred to warrant the
proposed rezone, and a substantial change of circumstances has occurred in the azea since the site
was last zoned
4 The procedural requuements of the State Environmental Policy Act and the County's Local
Environmental Ordinance have been met The proposal, as conditioned, will not have a
sigruficant, probable adverse unpact on the environment
5 The proposal, as conditioned, complies with the I-2 zone, the County Zonulg Code and
other apphcable development regulations
6 The proposed rezone meets the cntena established by VVashington case law for approving a
rezone, and the cntena established in paragraphs 14 402 020 (1)(2) of the County Zorung Code
for amending the County official zorung map
7 Approval of the land use application is appropnate under Section 11 of the County Hearulg
Examiner Ordinance, adopted by County Resolution No 96-0171
III. DECISION
Based on the above Findings of Fact and Conclusions of Law, the application for a rezone
from the Urban Residenhal-3 5(UR-3 5) zone to the Light Industnal (I-2) zone, for development
of a recreational velucle storage facility, is hereby approved, subject to the condzrions of
approval of the public agencies stated below
Any conditions of such agencies that have been added or sigruficantly revised by the
Hearing Examiner are itahcized

1 All conditions imposed by the Heanng Examuier shall be binding on the "Applicant,"
which term shall include the owners and developers of the property, and theu heus, assigns and
successors
2 The zone change applies to Lots 1 and 2, Block 1, Bates Addihon to Valley View Addirion
to Spokane, according to plat recorded in Volume E of Plats, Page 18, records of Spokane
County Auditor, Waslungton
3 The proposal shall comply with the Light Industnal(I-2) Zone and all other applicable
Spokane County Zonmg Code regulations, as amended
4 The applicant sha11 develop the subject property in substantial conformance with the site
plan of record submitted by the applicant on June 28, 2002 All aspects of the proposal shall be
bind.ing on the development, including the proposed use Vanations to be approved by the
Director of the Division of Planrung/designee as an admirustrative change of conditions shall
only be allowed to meet regulation standards and condihons of approval
5 Approval is required by the Director of the Division of Plannulg/designee of a specific
illumuiation plan for the descnbed property pnor to the release of any building pernuts All
illununahon on site shall comply with Section 14 810 180 of the Spokane County Zonmg Code
6 Approval is required by the Duector of the Division of Planrung/designee of a specific
sigiung plan for the descnbed property pnor to the release of any building permits Signage shall
conform to Section 14 804 160 of the Spokane County Zonmg Code, as amended
7 A specific landscape plan, planhng schedule and provisions for maultenance in
conformance with Chapter 14 806 of the Spokane County Zonuzg Code shall be subrrutted with a
suitable guarantee for the project pnor to release of building permits Landscaping shall be
installed and maintained so that sight distance at access points and intersections is not obscured
or unpaired consistent with the requirements of Chapter 14 810 of the Spokane County Zonmg

8 An eaght (8) foot high saght-obscurcng non pierced fence shall be anstalled along the west
boundary of the northerly half of the site A muumum six (6)-foot lugh sight-obscuring fence
shall be constructed along the other property lines of the subject site Such fencing shall comply
with the designated "clear view tnangle" as specified in Section 14 810 of the Spokane County
Zoiung Code
9 Storage cs prohcbated within 20 feet of the west property line, and within the minimum
setbacks requared in the I-2 zone

° 10 The Spokane County Division of Planrung shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road nght-of-way and
utihties The reserved future acquisition area Title Notice shall be released, in full or in part, by
the Division of Planrung The notice should be recorded witlun the same time frame as a.n appeal
and shall provide the following
a At least eleven (11) feet of reserved future acquisition area for road nght-of-way and
utilrties, in addition to the existing and/or newly dedicated nght-of-way along Barker Road
NOTE The County Engineer has requued nuie (9) feet of new dedicahon along Barker
Road
b Future building and other setbacks requued by the Spokane County Zorung Code
shall be measured from the reserved future acquisition area c No required landscaping, parking, '208' areas, drainfield or allowed signs should be
located within the future acquisition area for road nght-of-way and uhhties If any of the
above improvements are made within this area, they shall be relocated at the apphcant's
expense when roadway unprovements are made
d The future acquisition area, until acquued, shall be pnvate property and may be used
as allowed in the zone, except that any unprovements (such as landscaping, parking,
surface drainage, drainfield, signs or others) shall be considered intenm uses
e The property owner shall be responsible for relocahng such "intenm" unprovements
at the rime Spokane County makes roadway unprovements after acquinrig said future

11 The Division of Plammmg shall prepare and record with the Spokane County Auditor a Title
Notice, noting that the property ln question is subJect to a vanety of special condihons imposed

within the same tune frame as allowed for an appeal and shall only be released, in full or in part,

15 The applicant shall sign "Spokane County Nonce to the Public Number 6", which specifies

"The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits
now or to be hereafter denved, do for themselves, their heus, grantees, assigns and successor(s)
in interest hereby request and authonze Spokane County to include the above descnbed property
in a Road Improvement Distnct (RID) and to support the formation of a Road Improvement
Distnct for improvement of the road(s) descnbed below by requesfiuig and authonzuig Spokane
County to place their name(s) on a petition for the formarion of a Road Improvement Distnct
pursuant to RCW 36 88 050, or by requeshng and authonzing Spokane County to cast theu
ballot in favor of a RID being fonned under the resolution method pursuant to RCW 36 88 030,
and/or by not filuig a protest against the formation of a RID being formed under the alternative
resoluhon method provided for in RCW 36 88 065 and Chapter 35 43 RCW
If an RID is proposed for improvement of the road(s) descnbed below, said owner(s) and

the property included therein, together with the amount of any County participation, exceeds the

sufficiently developed, provided, they, their heu-s, grantees, assigns and successor(s) shall retaui
the nght, as authonzed under RCW 36 88 090, to object to any assessment(s) on the property as
a result of the improvements called for in conjunction with the formahon of a RID by either the
pehtion or resolution method under Chapter 36 88 RCW, and to appeal to the Supenor Court the
decision of the Board of County Commissioners confirnung the final assessment roll, provided
further, it is recogmzed that actual assessments may vary from assessment estimates as long as
they do not exceed a figure equal to the increased true and fau value the improvement(s) add(s)
to the property
It is further acknowledged and agreed that at such time as a RID is created or any County
Road Improvement project is authonzed by Spokane County, the improvements reqlured shall
be at the sole expense of the owner(s) of property witlun the RID or served by the improvements
without any monetary participation by Spokane County
The RID waiver contained in tlus agreement shall expire after ten (10) years from the date

16 Access to Sinto and Sharp Avenues (except for the exishng approach for the caretaker's

either the petition or resolution me4hod under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Comanissioners confirming the final

It is further acknowledged and agreed that at such tirne as a RID is created or any
County Road Improvement project is authorized by Spokane County, the irnprovements

served by the improvements without any rnonetary participation by SpoBcane County.
The RID wraiver contaBned in this agreement shall expire after ten (10) years frorn the

for approximately 200 feet Sharp and Sinto Avenues are designated Local Access Roads by the
Spokane County Artenai Road Plan Barker Road is a two way-two lane Principal Artenal that is
absent of curb and sidewalk The existing singte family dwelling is served by an on-site sewage

Urban Residential-3 5 zoning exists west and north of the site However, the area east of the project
site is a mix of land uses ranging from a community leaming center, church, single family dwrellings

convenience store, fast food restaurant, motel, truck stop convenience facility (closed), paint store
and a ceramics retail facility (closed) Barker Road intersects with Interstate-90 about 700 feet south
of the proposal and Mission Avenue approximately 600 feet north of the proposal
Project Descriptiono The applicant proposes a Zone Reclassifcation from Urban Residential-
3 5(UR-3 5) to Light Industrial (I-2) to develop a recreation vehicle storage facility No additional
structures will be constructed to accommodate the recreational vehicles The single family
dwelling and detached garage will remain and be occupied by the caretaker of the facility Two
existing 20' by 20' structures will be removed Ingress and egress to the site is proposed from
Barker, Sharp and Sinto streets The site would be surfaced with crushed gravel No additional
water or sewer services are proposed to serve the proposal The applicant proposes to install
Type III landscaping along Barker Road, Sharp and Sinto Avenues and along the west boundary
of the property Additionally, the applicant proposes to construct a 8-foot high chain link fence on
all four sides of his property

on October 4, 2001 The applicant submitted the subJect Zone Reclassification application on
November 14, 2001 The application was determined to be complete on November 16 2001
Notice of Application was timely issued on November 21, 2001 A technical review meeting for
the proposed Zone Reclassification was held on December 6, 2001 Notice of the public hearing
and the posting of the subject site occurred on April 15, 2002 The newspaper notice of the public
hearing was not published, and as a result, the public hearing was rescheduled to June 5, 2002
Notice of the rescheduled public hearing was sent to neighboring landowners on April 23, 2002
and the notice was published in the newspaper on iV1ay 21, 2002 The applicant altered the

electricity, telephone, gas, cable services, schools, parks and libraries Manned fire stations,

width, along the west property line adJacent 4o the existing Urban Residential-3 5(UR-3 5) Zone
A 5-foot width of Type III landscaping is required on the northeast and west boundaries of the site
In addition to the landscaping requirements, Section 14 632 355 requires that 4he storage of

The applicant contends that the proposed recreational vehicle storage facility vuill not generate
additional sewage compared to that generated by the existing single family home it serves The
subject site has access to an existing private sewer line located adjacent to and east of Barker
Road and can be utilized should the site be converted to more intensive light industrial uses in the
future Storm sewers are not available a4 the site, however the recommended conditions of
approval required the preparation of a stormwater management plan consistent with Spokane
County Stormwater Nianagement Guidelines
Objective 1 5 e recommends 4hat when a neighborhood expenences pressure for a change of
character, such change shall be permitted upon appropriate review The proposed use is located
within close proximity to a larger transportation networlc to include Interstate-90 and Mission
Avenue Nlission Avenue is designated a Mmor Artenal by the Spokane County Arterial Road
Plan The proposal is essentially a commercial service (as opposed to industnal) Commercial
areas within 4he vicini4y of the proposal are located south, southeast and north of the subject
property The property immediately north of the proposal is not being used for commercial
purposes However, there is a commercial use further north at theintersection of Barker Road
and (Vlission Avenue The site is also located adJacent to and east of a singie family residential
neighborhood and there may be negative impacts from the proposed use on the surrounding
residential uses The required landscaping and fencing will help to minimize the impacts of the
use on the surrounding residential uses
Decision Guideline 15 8 specifies that the appropnate review must take into consideration
structure height in relation to height of structures surrounding the site and impact to the
established architectural character of the neighborhood No consistent architectural character
exists in the vianity as residential, business and community building styles vary Therefore, the
proposal as conditioned will not adversely impact the character of adJacent development The
differences that do exist will be mitigated by the installation and proper maintenance of required
landscaping and fencing
The proposal is located in the Aquifer Sensitive Area (ASA) Overiay Zone Section 10 of the
Comprehensive Plan addresses water quality protection This chapter is intended to coordinate
land uses over aquifers in the County The conditions of approval require compliance with the
Spokane County Zoning ASA Overlay Zone requirements specified in Section 14 706 of the
Spokane County Zoning Code Additionally, the conditions of approval require compliance with
Spokane County stormwater management and erosion control requirements which include
stormwater filtration requirements

future developments Stdewalks should at a minimum be provided along all artenal roads which
lead 4o schools, parks and shopping districts and should be separated from roadways by a
parking strip to provide for storage of plowed snow, street tree planting and pedestrian safe4y
Barker Road is designated as a Pnncipal Arterial by the Spokane County Artenal Road Plan The
Division of Engineering is recommending as conditions of approval additionai nght-of way
dedication and Future Acquisition Area for the widening of Barker Road, and nght-of-w►ay
dedication to es4ablish the appropnate radius at intersections of Barker Road and Sinto and Sharp
Avenues Sidewalks and curbs do not exist along Barker Road
The project site is located within the Interim Urban Growth Area (IUGA) established pursuan4 to
RCW 36 70A, the Growth Management Act, and the zone reclassification appiication is consistent
with the requirements of the Interim Regulations and County Growth IVlanagement Resolution 97-

designated iVledium Density Residential (MDR) The LDR category may be developed with
residences up to 6 dwellings per acre The MDR category encourages the development of single
family and multi family dwellings up to 15 units per acre f applicable, the following is a brief
analysis of the proposal's consistency with the Comprehensive Plan currently in effect

' The purpose of the residen4ial land usd categories is specified on page 1.L-1 of the new
Comprehensive Plan This portion of the plan establishes three separate categories for
residential uses ranging from low to high density Low density residential includes a density range
of 1 to and including 6 dwelling units per acre, medium density residentiai includes a range of
greater than 6 to and including 15 dwelling units per acre and high density residential shall be
greater than dwelling units per acre Design standards ensure
neighborhood character and compatibility with adJacent uses Commerciai uses, with the
exception of office use in high density residential areas, would only be permitted through changing
the land use category wi4h a comprehensive plan amendment or through a neighborhood planning
process This wording suggest that industrial use of residential categories is not acceptable and
would only be permitted by changing the land use category by a comprehensive plan amendment
or through a neighborhood planning process
The Light Industry category, as specified on page UL-3, is intended for industrial areas that have
a special emphasis and attention given to aesthetics, landscaping and intemal and community
compatibility Light Industry areas are compnsed of predominantly industrial uses but may
incorporate office and commercial uses that support and compliment the industrial area
The Light Industry category may senie as a transitional category between heavy industrial areas
and other less intensive land use categones The category may also serve as a visual buffer for
heavy industrial areas adjacent to aesthetic corridors The immediate vicinity of the proposal
includes a mix of land uses with no one type of use predominating in the area The Light
Industrial Zone immediately south of the subject site is developed with commercial businesses
rather than industrial uses An industrial trend istherefore not estabiished in the immediate
vicinity of the proposal A light industnal zone designation of the subject property appears
inconsistent with the purposes of the industrial zone category of the new Comprehensive Plan
Zonang: The purpose of the proposed Light Industnal (I-2) zone is to is to meet the needs for
industrial land identified in the Industrial category of the Comprehensive Plan and provide for uses
that are all of a non-offensive nature The intent is to ailow for these uses by making them
compatible with surrounding uses General characteristics of these areas include paved roads
and sidewalks, public sewer and water, and a full line of public services including manned fire
protection and public transit accessibility Public sewer and water, police and manned fire
protection and public transit services are available to the subject property
Existing zoning in the general vicinity of the site consists of Urban Residential-3 5(UR-3 5), Urban
Residential-7 (UR-7), Neighborhood Business (B-1), Light Industnal (I-2) and Regional Business
(B-3) The properties north, east and west of and adjacent to the site are zoned Urban
Residential-3 5 and property south of the site is zoned Light Industnal (I-2) The proposal is
essentially a commercial use and is a permitted use in the I-2 Zone Public water service is
provided by Consolidated Irngation District A public sewer system is available upon the
establishment of a formal agreement between P & T Partners and the property owner to connect
to the private sewer Ime servmg the HiCo Village that is located immediately south of the
proposal Electncity and natural gas service, telephone and cable services are available to serve
the site Additional public facilities and services that are available to serve the site include paved
roads, schools, police and f re protection
The adoption of Resolution 2-0037 and implementation of the new Comprehensive Plan did not
change the zornng designation on neighboring property north and west of the proposal However,
the property on the south changed from Light Industrial (I-2) to Urban Residential-7 (UR-7) and
the property on the east change from Urban Residential-3 5(UR-3 5) to UR-7 pursuant to Section
1 of the Phase I Regulations
The following is an analysis of the proposal's consistency with the requirements of the 1-2 Zone in

completion of agreements with the proponent

PURPOSE OF CHECKLIST • The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires all governmencal agencies
to consider the environmental impacts of a proposal before making decisions. An environmental
impact statement (EIS) must be prepared for all proposals wiLh probable sijnificant adverse impacts on
the quality of the environmenc. The purpose of this checklist is to provide information to help you
and the agency identify impact from your proposal (and to reduce or avoid impacts from the proposal,
if it can be done) and to help the agency decide whether an EIS is required.
INSTR UCTIONS FOR APPLICANTS .
This environmental checklist asks yoU to describe some basic information about your proposal.
Governmental agencies use this 'checklist to determine whether the environsnental unpacts or your
proposal are si~nificant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.

It has been brought to my attention that the deadline for providing notice of hearing by
publication in the above two matters, currently scheduled for hearing before me on May
11 2002, cannot be provided timely under County Resolution No. 1-0700.
Compliance with notice of hearing requirements is essential to the Hearing Examiner's
jurisdiction under the County Hearing Examiner Ordinance. Any action taken by the
Examiner at the public hearing could be voided if notice requirements have not been met.
Accordingly, the above hearings will have to be rescheduled to the earliest available date
where notice requirements can be met.
Since the Division of Planning is responsible for providing notice by publication where
required for land use applications, I would ask that the Division of Planning absorb the
cost of providing new notice for the above applications.
I also wanted to comment on the interplay between the notice of hearings requirements of
the County Zoning Code and County Resolution No. 1-0700 for Type II project
applications. With regard to mailed notice of hearing, the requirements of the County
Zoning Code control over those found in paragraph 13.700.106 (2)(a) of Resolution No.
1-0700. However, the posting and publication notice of hearing requirements of
paragraphs 13.700.106 (2)(b) and (2)(c) of Resolution No. 1-0700 must be followed for
all Type II applications, and also control over any inconsistent posting or publication
requirements of the Zoning Code for such applications.

Dear Ms. Thomas:
Please find enclosed a copy of the revised conditions of approval recommended by
County Engineering for the above rezone proposal. These conditions a11ow the applicant
to defer making improvements to Sinto and Sharp Avenues until a road improvement
district is formed or a county road project is initiated to make such improvements, the
timing of which methods of improvement is indefinite. The conditions also prohibit
access to such roads for the project, except for use by the caretaker's residence at the
existing access to Sinto.
If you have questions regarding these conditions, please contact Greg Baldwin of County
Engineering at 477-7254.
