ZE-020-95 ~4 / S ~ SPOKANE COUNTY HEA1tING EXAIVIINER COIVIMITTEE FINDINGS OF FACT, CONCLiJSIO1vS A1VI) OItDEIt INTRODUCTgO1V Tlus matter has come before the Heanng Exanuner Committee on July 20, 1995 The members of the Committee present are Frank Yuse, Chair, Verona Southern and Toni Nersesian PROPOSAL The sponsor, The Evangehcal Lutheran Good Samantan Society, requests approval of a Zone Reclassification, ZE-20-95, from Urban Residential-3 5(UR-3 5) to Urban Residential-12 (UR-12) for an existing nursing home/retirement facillry and those uses allowed in the Urbaa Residential-12 (UR-12) zone, and a Vanance, VE-10-95, from the penmeter landscaping/fencing requuements specified by Section 14 620 365(2) of the Spokane Counry Zoning Code FINDINGS OF FACT ANI) C0NCLIJSIONS 1 The property is generally located west of and adjacent to Tschirley Road, both north and south of 8th Avenue in Section 19, Townslup 25 North, Range 45 EWM, Spokane County, Wastungton 2 The Committee adopts the Planiung Department Report as a part of this record 3 The existing land uses in the area include an existing retirement apartment build.ing, nursing home, parlang, mamtenance building, garages and single family residence with garage, single fanuly residences, agncultural and undeveloped 4 The proposed use is compatible with existuig uses in the area 5 The Comprehensive Plan designates this site as Urban (L) and within the Aqulfer Sensitive Area (ASA) and the Prionty Sewer Service Area (PSSA) Overlay zones The Urban (U) category is intended to provide the opportunity for development of a"city- like" envuonment wluch includes vanous land uses, a vanety of housing types and densities, and pubhc facilihes and services Urban areas will be the most intensely developed of all the categones, prunanly residential along with neighborhood commercial, light u►dustnal, and pubhc and recreational faclhties The proposed zone reclassification from Urban Residential-3 5(UR-3 5) to Urban Residential-12 (UR-12) is consistent with and implements the Goals, Objectives and Decision Guidelines of the Urban category of the Comprehensive Plan 6 The proposed zorung does implement and conform to the Comprehensive Plan 7 The Artenal Road Plan designates Tschirley Road and Eighth Avenue each as Local Access Streets with a future right-of-way width of 60 feet Implementation of the . Artenal Road Plan does not presently requue dedication of additionai nght-of-way along either road as a Future Acqwsition Area 8 The existing zorung of the property descnbed in the application is Urban Residential-3 5 (UR-3 5) previously estabhshed as Agncultural (A) zoning in 1957 and redesignated to Urban Residential-3 5(UR-3 5) on January l, 1991 pursuant to the Program to Implement the Spokane County Zorung Code The proposal does conform to the requirements of the proposed Urban Residential-12 (UR-12) zone 9 The provisions of RCW 43 21C (The State Environmental Policy Act) have been complied wrth and a Deternunation of Nonsignif'icance (DNS) was issued The Committee, after independent review, hereby adopts the DNS 10 The legal requuements for public notice have been fulfilled 11 The owners of adjacent lands expressed disapproval of the proposed zone reclassification The opponents testified that approval of the Urban Residential-12 (UR-12) zone would establish a precedent for further sinular density zoning in an area of low-density residential zorung, the zone reclassification is an inadequate method to bnng non-confornung use into compliance with zorung, and that the zone reclassification is a questionable method to enable granting of building pernuts 12 The applicant has demonstrated that conditions have substantially changed since the onginal zoning of this area and accordingly, the proposed zone reclassification is justified Specifically, changed cond.itions include adoption of the Comprehensive plan and more intensive residential use in the area 13 The proposed use will not be detnmental to the pubhc health, safety, morals or welfare especially in hght of the conditrons recommended by the reviewing agencies 14 The Committee additionally finds/concludes a Approval of the zone reclassification to Urban Residential-12 (UR-12) does not establish a precedent for future land use actions in the area b The subject property does have unique physical features and special circumstances which support the proposed vanance from penmeter landscape and fencing requirements CONfl)ITI0NS OR CO1V'I'INGE1v1CIES APPLIEI) TO THIS APPROVAL 1 All Conditions unposed by the Heanng Exanuner Committee shall be bind.ing on the "Applicant," wluch term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest 2 The Zone Reclassification and following Conditions of Approval apply to the real property descnbed below That portion of Government Lot 2, Section 19, T 25 N, R 45 E, W M lying South of the Plat of Apple Valley Estates 2nd Addition and that portion deeded to James and HEC Order for ZE-20-95 Page 2 • . ~ Lenore Wurth dated November 5, 1986, together with the North 609 99 feet of the S W 1/4 of Section 19, T 25 N, R 45 E, W M EXCEPT the East 1335 57 feet thereof, Spokane County, Wastungton SPOKANE COLJNTY DIVISION OF BUII.I)I1VG Ali1I) PLANNING 1 The proposal shall comply with the Urban Residential-12 (UR-12) zone and the Aquifer Sensitive Area (ASA) Overlay zone, as amended 2 Approval requued by the Planrung Duector/designee of a specific hghtuig and sigrung plan for the descnbed property prior to the release of any builduig pernuts 3 Duect hghting from any extenor area lightulg fixture shall not exceed over the property boundary 4 The applicant shall develop subject property generally in accordance witrun the concept presented to the Heanng Body Variations, when approved by the Planning Director/designee, may be pernutted, including, but not hiruted to builduig location, landscape plans and general allowable uses of the pernutted zone All vanations must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained 5 The Division of Building and Planning shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a vanety of special conditions unposed as a result of approval of land use action Tlus Title Notice shall serve as pubhc notice of the conditions of approval affectuig the property in question The Title Notice should be recorded within the same tune frame as allowed for an appeal and shall only be released, ui full or in part, by the Division of Buflding and Planrung The Title Notice shall generally provide as follows T'he parcel of property legally described as [ ] is the suibject of a land use action by a Spokane County Hearing Body or Admnnistrative Official on [ imposing a variety of special developanent conditions. Site Characteristics The northwest portion of the site is relatively level and bordered on the north and west by basalt mounds which end in cliffs These chffs form the north boundary of the property The south one-third of the site consists of a fairly steep hillside of shrubs and trees with an easterly-flowing dralnage The east and northeast portions of the site aie of fairly even, sloping ground The north two-tturds of the site slopes gradually to the east The center of the site contalns two former sewage lagoons classified by the Spokane County Wetlands Inventory Maps as Permanent Lakes D.
