Tlus matter has come before the Heanng Exanuner Committee on July 20, 1995
The members of the Committee present are Frank Yuse, Chair, Verona Southern
and Toni Nersesian
PROPOSAL
The sponsor, The Evangehcal Lutheran Good Samantan Society, requests approval
of a Zone Reclassification, ZE-20-95, from Urban Residential-3 5(UR-3 5) to
Urban Residential-12 (UR-12) for an existing nursing home/retirement facillry and
those uses allowed in the Urbaa Residential-12 (UR-12) zone, and a Vanance,
VE-10-95, from the penmeter landscaping/fencing requuements specified by
Section 14 620 365(2) of the Spokane Counry Zoning Code
FINDINGS OF FACT ANI) C0NCLIJSIONS
1 The property is generally located west of and adjacent to Tschirley Road, both north
and south of 8th Avenue in Section 19, Townslup 25 North, Range 45 EWM,
Spokane County, Wastungton
2 The Committee adopts the Planiung Department Report as a part of this record
3 The existing land uses in the area include an existing retirement apartment build.ing,
nursing home, parlang, mamtenance building, garages and single family residence
with garage, single fanuly residences, agncultural and undeveloped
4 The proposed use is compatible with existuig uses in the area
5 The Comprehensive Plan designates this site as Urban (L) and within the Aqulfer
Sensitive Area (ASA) and the Prionty Sewer Service Area (PSSA) Overlay zones The
Urban (U) category is intended to provide the opportunity for development of a"city-
like" envuonment wluch includes vanous land uses, a vanety of housing types and
densities, and pubhc facilihes and services Urban areas will be the most intensely
developed of all the categones, prunanly residential along with neighborhood
commercial, light u►dustnal, and pubhc and recreational faclhties The proposed zone
reclassification from Urban Residential-3 5(UR-3 5) to Urban Residential-12 (UR-12)
is consistent with and implements the Goals, Objectives and Decision Guidelines of the
Urban category of the Comprehensive Plan
6 The proposed zorung does implement and conform to the Comprehensive Plan
7 The Artenal Road Plan designates Tschirley Road and Eighth Avenue each as Local
Access Streets with a future right-of-way width of 60 feet Implementation of the
.
Artenal Road Plan does not presently requue dedication of additionai nght-of-way
along either road as a Future Acqwsition Area
8 The existing zorung of the property descnbed in the application is Urban Residential-3 5
(UR-3 5) previously estabhshed as Agncultural (A) zoning in 1957 and redesignated to
Urban Residential-3 5(UR-3 5) on January l, 1991 pursuant to the Program to
Implement the Spokane County Zorung Code The proposal does conform to the
requirements of the proposed Urban Residential-12 (UR-12) zone
9 The provisions of RCW 43 21C (The State Environmental Policy Act) have been
complied wrth and a Deternunation of Nonsignif'icance (DNS) was issued The
Committee, after independent review, hereby adopts the DNS
10 The legal requuements for public notice have been fulfilled
11 The owners of adjacent lands expressed disapproval of the proposed zone
reclassification The opponents testified that approval of the Urban Residential-12
(UR-12) zone would establish a precedent for further sinular density zoning in an
area of low-density residential zorung, the zone reclassification is an inadequate
method to bnng non-confornung use into compliance with zorung, and that the zone
reclassification is a questionable method to enable granting of building pernuts
12 The applicant has demonstrated that conditions have substantially changed since the
onginal zoning of this area and accordingly, the proposed zone reclassification is
justified Specifically, changed cond.itions include adoption of the Comprehensive
plan and more intensive residential use in the area
13 The proposed use will not be detnmental to the pubhc health, safety, morals or
welfare especially in hght of the conditrons recommended by the reviewing
agencies
14 The Committee additionally finds/concludes
a Approval of the zone reclassification to Urban Residential-12 (UR-12) does
not establish a precedent for future land use actions in the area
b The subject property does have unique physical features and special
circumstances which support the proposed vanance from penmeter landscape
and fencing requirements

the "Applicant," wluch term shall include the owner or owners of the property,

1 The proposal shall comply with the Urban Residential-12 (UR-12) zone and the
Aquifer Sensitive Area (ASA) Overlay zone, as amended
2 Approval requued by the Planrung Duector/designee of a specific hghtuig and sigrung
plan for the descnbed property prior to the release of any builduig pernuts
3 Duect hghting from any extenor area lightulg fixture shall not exceed over the property
boundary
4 The applicant shall develop subject property generally in accordance witrun the concept
presented to the Heanng Body Variations, when approved by the Planning
Director/designee, may be pernutted, including, but not hiruted to builduig location,
landscape plans and general allowable uses of the pernutted zone All vanations must
conform to regulations set forth in the Spokane County Zoning Code, and the original
intent of the development plans shall be maintained
5 The Division of Building and Planning shall prepare and record with the Spokane
County Auditor a Title Notice noting that the property in question is subject to a vanety
of special conditions unposed as a result of approval of land use action Tlus Title
Notice shall serve as pubhc notice of the conditions of approval affectuig the property
in question The Title Notice should be recorded within the same tune frame as allowed
for an appeal and shall only be released, ui full or in part, by the Division of Buflding
and Planrung The Title Notice shall generally provide as follows

land use action by a Spokane County Hearing Body or Admnnistrative
Official on [ imposing a variety of special developanent
conditions. File No. [ ] is available for inspection and copying in
the Spokane County PDanning Department.
6 The Division of Btulding and Planrung shall file with the Spokane County Auditor,
withun the same time frame as allowed for an appeal from the final dlsposition,
includuig lapsing of appeal penod, a Title Notice, which shall generally provide as
follows
"Prior to the issuance of any buildsng permit for any building or any use on the
property descnbed herein, the applicant shall be responsible for complying with the
provisions of the Zoning Code for Spokane County, Section 14 706 (Aquifer Sensitive
Area Overlay Zone) The property wluch is the subject of this notice is more
particularly described as follows "
7 A specific landscape plan, planting schedule and provisions for maintenance acceptable
to the Planning Director/designee shall be subrrutted with a performance bond for the

fire apparatus access roads, fire hydrant/flow, approved water systems, budding
accessibihty, construction type, occupancy classification, exiting, extenor wall
protection, and energy code regulations (Note The Division of Buildings reserves the

1 A Covenant shall be signed stating The Owner(s) or Successor(s) in interest agree
to authonze the County to place theu- name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36 94, which petition includes the
Owner(s)' property, and further not to object by sigrung of a protest petition against
the formation of a ULID by resolution method pursuant to RCW Chapter 36 94
which includes the Owner(s)' property PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the
property as a result of unprovements called for in conjunction with the formation of
a ULID by either petition or resolution method under RCW Chapter 36 94
2 A wet (live) sewer connection to the area-wide Public Sewer System is to be
constructed Sewer connection pernut is requued
3 Applicant is required to sign a Sewer Connection Agreement pnor to issuance of permit
to connect
4 Applicant shall subtrut expressly to Spokane County Utilitles Department "under
separate cover", only those plan sheets showing sewer plans and specifications for
Public Sewer connections for review and approval by the Utilities Department pnor to
issuance of pernut to connect
5 Arrangements for payments of additional sewer charges must be made for pnor to
issuance of sewer connection pernut
6 The Board of County Commissioners is in the process of evaluating whether Pubhc
Sewer should be extended outside the 15-year construction boundary and the terms of
connection/extension of public sewer if allowed
7 Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended

II. SITE INFORMATION

B . Coanprehensive Plan
1. Land Use Plan: The property is located within the Urban (U) category
of the Comprehensive Plan, the Aquifer Sensitive Area (ASA) and the
Pnonty Sewer Service Area (PSSA) The Urban (U) category is intended
to provide the oppomuuty for development of a"city-lilce" envuonment
which includes vanous land uses, a variety of housing types and densities,
and pubhc facdities and services Urban areas will be the most intensely
developed of all the categones, pnmanly residential along with
neighborhood commercial, light industrial, and pubhc and recreational
faclhties Public facilities will include a nursing home/retirement faciliry
The proposal is located in an area that is part.ially developed and established
with a vanety of residentaal densities and few pubhc facilities The
proposed zone reclassification from Urban Residential-3 5(UR-3 5) to
Urban Residential-12 (UR-12) is consistent with and implements the Goals,
Objectives and Decision Guidelines of the Urban category of the
Comprehensive Plan
2. Arterial Road Plan The site is west of and adjacent to Tschirley Road,
and north and south of Eighth Avenue The Spokane County Artenal Road
Plan identrfies Tsclurley Road and Eighth Avenue each as Local Access
Streets with a future right-of-way width of 60 feet Implementation of the
Artenal Road Plan does not presently require dedicahon of add.itionai nght-
of-way along either road as a Future Acquisitlon Area
C. Site Characteristics The northwest portion of the site is relatively level and
bordered on the north and west by basalt mounds which end in cliffs These
chffs form the north boundary of the property The south one-third of the site
consists of a fairly steep hillside of shrubs and trees with an easterly-flowing
dralnage The east and northeast portions of the site aie of fairly even, sloping
ground The north two-tturds of the site slopes gradually to the east The center
of the site contalns two former sewage lagoons classified by the Spokane County
Wetlands Inventory Maps as Permanent Lakes
D. Neighborhood Characteristics Along the north boundary of the property
below the cliffs is Saltese Creek, north of which is a flat residential area
Immedsately to the east of the site is Saltese Creek, with some residential
development to its north and a steep wooded hillside on its south To the west the
ground gradually rises to basalt mounds, then cliffs Below these cliffs is a
southerly-flowing drainage and relatively flat hay fields Directly south is a steep,
wooded hillside

Residential-3 5(UR-3 5), with Urban Residential-7 (UR-7) to the north, and
Suburban Residential-1 (SR-1) to the south and southwest The most recent zone
reclassification in the area consists of approximately 25 acres immediately to the
north of the proposal wluch changed from Agncultural (A) to Residential Mobile
Home (RMH) (92-73) in 1973

Land use in the general area of this proposal is very rruxed, with single-fanuly
residential generally to the north and northeast, agriculture to the east and west,
and vacant, wooded hillside to the south The existing nursing home/retirement
facihty is a pernutted use in the Urban Residential-12 (UR-12) zone and is
generally compatible with existing land uses to the north of the site
G. Circulation The site currently has duect access to Eighth Avenue The site
plan shows no change in the access use/requirements to Eighth Avenue

1 . Site Plan Data
Proposed Site Plan: The site plan of record illustrates one future
carport for vans, one future maintenance building, and potential addition to
the gatehouse along with the existing nursing home, ret.irement apartments,
garage, maintenance buildings, and parking lots/spaces Except for
building height of the retuement apartments, fencing and landscaping, the
site plan does illustrate general compliance with nununum development
standards of the proposed Urban Residential-12 (UR-12) zone
Proposed Buffering/I.andscaping Techniques The proposed site
plan illustrates 20 feet of Type III landscaping along only part of the
Tscturley Road frontage and along approximately 190 feet of the
easternmost reach of Eighth Avenue Chapter 14 806 (Landscaping and
Screening Standards) of the Zoning Code requires a 20-foot wide strip of
Type III landscaping along all local access streets witlun all developments in

landscaping, or site-obscurang fence shall be provided and maintacned on the
boundary of any UR-12 zone which abuts or lies across a publtc alley from an
RR-10, SRR-S, SRR-2, SR-1, SR-112, UR-3 S or RS zone, except cn the
required front yard, tivhere the fence shall comply with Sectzon 14 810 020

The landscaping standard, as defined in Chapter 14 806 040(1)(e), states that
when the proposed use is public or institutional in all zones and that use is
adjacent to an Urban Residential-3 5(UR-3 5) or Urban Residential-7 (UR-7)
zone, then the rrununum landscaping required is Type I, 10 feet in width where
the proposed use is adjacent to either of the above two zones
The applicant has requested a Variance from the fence and landscaping standards
as requued in the Urban Residential-12 (UR-12) zone Specifically, the applicant
is requesting allowing the existing rock cliff at the east end of the north property
hne to serve as the "site-obscuring device" without additional fencing or
landscaping

1 a The site does have special cucumstances due to its location atop an often
vertical-rock border formation wluch forms much of its north property luie--
it is visually more prorrunent than structures/development on the nearby
level ground Tlus topograplucal feature does not necessanly create any
more difficulty in meeting the fencing and landscaping requuements per the
Urban Residential-12 (UR-12) zone and may increase the need for a " site-
obscunng device" from neighboring residential uses due to the proriunent
high ground which the site occupies
1 b If the variance is granted, adequate security on the site may not be provided
for those elderly persons and visitors to this facility A six (6)-foot-high
fence is intended to assure public health and safety on the site as well as to
provide a visual barrier benefiting much less intensive neighbonng
residential uses

III. ENVIROlVMEIVTAL REVIEW '
An Envuonmental Checklist was subnutted by the sponsor and was reviewed by the
Division of Btulding and Planrung The review considered the specifics of the
proposal, other available information, County ordinances, other regulations and laws,
possible standard Conditions of Approval, the Generalized Comprehensive Plan, and
other County policies and guidelines The Division of Building and Planrung has
deternuned that "No probable sigruficant adverse impacts" would result from the
proposal being developed and has issued a Deternunation of Nonsignificance ("DNS")
The "DNS" was cuculated to 13 other agencies of junsdiction and other agencies/
departments affected by the future development for review and comment The "DNS"
comment period ends July 18, 1995 and was advertised 15 calendar days before said
date in the newspaper, by letter to adjacent property owners within 400 feet of the
proposal, and by notice on a sign posted on the proposal site The Heanng Exanuner
may consider additional envuonmental related testunony at the public heanng
I V. DIVISION OF BUIb,DING AND PLANNING SUIVINARY
The proposed zone reclassification is consistent with the Goals, Objectives and
Decision Guidellnes of the Urban category of the Spokane County Comprehensive Plan
and generally implements the development standards of the Urban Residential-12 zone
The Vanance is not consistent with the cnteria cited by Chapter 14 404 080 of the
