Site I)escriptton • The site is currently undeveloped, except for a caretaker's residence
located in the northeast corner of the property and four maintenance sheds located in the
northwest corner of the site Two existing man-made ponds used as sewage lagoons are located
in the middle portion of the site The subject property is relatively flat in topography, with some
hills and cliffs, and clusters of basalt rock outcroppings Dense trees and shrubs are scattered
throughout the site The Spokane County Cntical Areas maps indicate the possibility of
geological hazards (erodible soils) and two Type N wetlands on the property The wetland areas
are located in the area of the two manmade ponds and in an area north of the easternmost pond
adjacent to 8`h Avenue
Surrounding Conditions• The site lies along the south side of 8"' Avenue, which
terminates to the east at Tschirley Road Tschirley Road extends north several blocks to Sprague
Avenue, which is designated as a Pnncipal Artenal by the County Artenal Road Plan Saltese
Creek is located some distance north of the site, and flows into Shelley Lake to the west In
1995, the site and about 13 adjacent acres lying between Saltese Creek and 8"' Avenue and
owned by the applicant were rezoned from the Urban Residential-3 5(iJR-3 5) zone to the Urban
Residential-12 (UR-12) zone See rezone decision m Building and Planning File No ZE-20-95
A nursing home and retirement facility was developed previous to the rezone on the 13 acres
1}ring north of 8' Avenue In 1996, the applicant applied for a preliminary plat, rezone from the
. UR-3 5 zone to the UR-7 zone, and planned urut development, in order to develop 28 duplex lots
on 19 6 acres 1}nng immediately east of the site See Building and Planning File No PE-1803-
96/ZE-46-96/PUDE-5-96 The applicant also owns an adjacent 138 acres in addition to the
° adjacent 13 acres to the north and the 19 6 acres adjacent to the east The land south, east and
west of the site is currently vacant and undeveloped Except on the north, the land adjacent to
the site is all zoned Urban Residential-3 5(UR-3 5) Single-family residences are found north of
the applicant's land lying north and east of the site
Project IDescription: The rezone decision in File No ZE-20-95 required the applicant to
develop the ongina131 acres involved in general accordance with the onginal concept presented
to the Heanng Examiner Committee in 1995 See Finding of Fact, Conclusions and Order dated
7-20-95 The purpose of the rezone was to recognize the existing nursing home/elderly
apartments facility on the portion of such site located north of 8' Avenue as a permitted use in
the UR-12 zone, and to allow the construction of carports The site development plan in File No
ZE-20-95 did not illustrate development of the current stte for 50 retirement/elderly apartments,
as currently proposed The current change of conditions applications seeks approval of a new
site plan for the current site
The site plan of record for the current site illustrates a single multifamily structure, with the
caretaker's residence and man-made ponds remaining on site and an indication that the sheds
would be relocated The design also includes six-foot-wide pedestnan pathways, and areas of
maintained as well as natural landscaping The proposal would have a net density of
approximately 2 7 units per acre, with a building coverage of only three percent (3 The
environmental checklist indicates that the apartment building would be two-story, approximately
30 feet in height The Division of Building and Planrung administratively approved a waiver of
the wall requirement of the UR-7 zone applicable to the property lines of the site adjacent to
UR-3 5 zoning, and also granted partial relief regarding certain landscaping requirements
applicable along such property lines See letter dated 9-4-96 from Taylor Engineenng to Louis
Webster, and letter dated 9-20-96 from Louis Webster to Taylor Engineenng The applicant

proposes to vacate 8`h Avenue and replace it with a p1-ivate road, through which an access
easement would be granted for the proposal If 8" Avenue is not vacated, the applicant would be
required to make road improvements to such road The proposal would be served by public
sewer and water County Engineenng has requested the applicant to contnbute a pro rata share
for installation of a traffic signal at the intersection of Appleway Avenue and Sprague Avenue

Procedural matter: The Heanng Examiner incorporated the record from Buildincr and
Planning File Nos PE-1803-96/ZE-46-96/PUDE-5-96, including the project file for such matter
and the testimony and documents submitted at the January 29, 1997 public heanng in such
matter, which was held immediately after the heanng in the present matter Thus consolidation of
records was based on the common applicants and issues between the two projects The Heanng

C. LANI) USE ANA-LYSIS:
The review process for a change of conditions application is somewhat unclear The
Heanng Examiner Ordinance requires the Examiner to set forth the manner in which a decision
on a change of conditions application is consistent with the Comprehensive Plan, and authonzes
the Examiner to consider the Comprehensive Plan and applicable development regulations in
rendenng a decision See Resolution 96-0171, Attachment "A", Section 11 Therefore, the
application should generally conform to the Comprehensive Plan, and must comply with the
development standards of the UR-12 zone and other applicable provisions of the Zorung Code,
the provisions of SEPA and the Spokane County Environmental Ordinance, and other applicable
land use regulations Consideration should also be given to the conditions of approval attached
to the rezone decision in File No ZE-20-95
With these land use controls in mind, the Heanng Examiner may impose conditions on the
change of conditions application to protect the public health, safety and general welfare, or to
mitigate environmental impacts It must be kept in mind that a change of conditions is not a
rezone, because it does not change the actual zone of the property However, the permitted uses=
location of buildings, landscaping, and other features of the site development plan are
nevertheless subject to review by the Examiner

The following findings of fact and conclusions are made
1 The nronosal izenerallv conforms with the Spokane Countv Generallzed Comprehensive Plan
The proposal is designated in the Urban category of the Comprehensive Plan The Urban
category is intended to provide the opportunity for a"citylike" environment, which includes
vanous land uses, residential development and a high level of public facilities and urban
services It is primanly a residential category of single-family, two-family, multi-family, and
condominium bulldings along with neighborhood commercial, light industnal, and public and
recreational facilities The Urban category recommends a residential net density range of one (1)
to 17 Luuts per acre, with allowances for "bonus densities" within developed areas where utilities,
artenals, schools, and community facilities have already been established The more intensive
uses in the Urban category, such as light industnal and neighborhood commercial, would be
located near or along the heavily traveled streets The least intensive single-family residential
uses should be isolated from the noise and heavy traffic, and multifamily structures will usually
be a transitional use located beriveen single-family residential and the more intensive areas See
Comprehensive Plan, Section 1, "Purpose" and "Detailed Definition"

congestion are to be managed with greater attention to the general public's well-being inside the

The site is currently zoned Urban Residential-12 (UR-12), wluch zone is intended to add to
the vanety of housing types and densities, and be an implementation tool for the Urban category
of the Comprehensive Plan UR-12 areas typically include multiple-family dwellmgs frequently
used to provide a transition between low-density residential zones and intensive business zones
Zoning Code 14 620 100 UR-12 areas are generally charactenzed by paved roads, public sewer
and water, accessibility to schools and libranes, and a full line of public servlces including
manned fire protection and public transit accessibility The purpose of the UR-12 zone is to set
standards for the orderly development of residential property in a manner that provides a
desirable living environment that is compatible with surrounding land uses and assures the
protection of property values
While the project is not located along an artenal, it has reasonably converuent access along
Tschirley Road to Sprague Avenue and Appleway Avenue, which are designated as Pnncipal
Artenal by the Spokane County Artenal Road Plan While the site is not located along a public
transit route at the current time, it is located within the Public Transit Benefit Area designated by
the Spokane County Zoning Code See Zoning Code 14 300 100, definitions Elderly housing
does not generate near the traffic that general multifamily uses do, since the residents are not
usually employed or live with children Further, the applicant indicates that the residents of the
project will be served by pnvate vans and shuttles The land adjacent to the site on the north,
south and east is owned by the applicant The land north of the site is improved with an existing
retirement facility, and the applicant has proposed the development of duplexes and UR-7 zorung
for the land east of the site The land east of the site is vacant

The Urban category recognizes that multifamily housing may serve to renew a residential
area, and indicates that when a neicrhborhood expenences pressure for change, such change may
be allowed upon appropnate review The Urban category indicates that multifamily housing
should improve or maintain the amenities of adjacent single-family areas, vvith particular
attention given to the design and densihes of multifamily development Considenng the
isolation of the srte from any developed single-family areas, and the distance between the
proposed multifamily complex and the land adjacent to the site on the west, there is little
potential for land use conflict with adjacent land uses The applicant owns 170 acres north and
east of the site The proposed height of the multifamily structure on the site is less than the 35-
foot maximum allowed in the UR-3 5 zone
Since the current site is a separate legal parcel from the 13 acres 1}nng north of the site, the
residential densrty of the site can be considered separate from the residential density of the
acreage to the north, which is improved with an existing retirement facility The 50 assisted
living uruts proposed in the proJect have been charactenzed as "retirement/elderly apartments",
which are a kind of multi-family dwelling See Zoning Code 14 300 100 Under this analysis,
the residential net density on the 18 3 acres of the current site would be only 2 7 units per acre
This density is easily witlun the recommended residential density range of the Urban category,
and is less than the maximum density allowed in the UR-3 5 zone
The proJect will be served by a high level of public services, including public sewer,
modern utilities and paved roads Such "fill-in development" is encouraged in the Urban
category See Comprehensive Plan, Glossary, definition of "fill-in development" The applicant
is required to make road improvements to 8"' Avenue, if such road is not vacated at the
applicant's request, and is required to contnbute funds toward the installation of a traffic signal at

the intersection of Sprague Avenue and Appleway Avenue The applicant is also required to
participate in a future road improvement distnct formed to improve Tschirley Road, including
the installation of additional asphalt, sidewalk, curb and draina~e control
The record indicates that shallow or rocky soils exist on the site, which may not be
adequate for the use of drywells and alternative stormwater disposal methods The applicant
intends to perform geotechnical tests to determine the suitability of drywells, and intends to route
stormwater via curbing and grading to detention ponds and natural drainage ways See
Envlronmental Checklist County Engineenng has generally accepted this conceptual drainage
plan The applicant will be required to prepare a final drainage analysis and plan consistent with
County stormwater regulations, pnor to the issuance of a building permit This includes
consideration of impacts to groundwater and properties downstream from any proposed retention
ponds and drywells The proposal does not intend to develop the steep slopes on the site
There is a difference of opinion between the applicant's engineer and the Washington State
Department of Ecology regarding the status of the ponds as wetlands under the County's Cntical
Areas Ordinance The applicant is requued to prepare a wetlands report to resolve thls issue, and
protect and provide sufficient buffers for any wetlands identified on the site The site
development plan shows the ponds Ueing preserved in their current state
.
Very little opposition to the project was submitted by neighbonng property owners Pat
Dowrung, who lives north of the site at the corner of Fourth Avenue and Flora Avenue,
expressed concern at the public heaf ing regarding traffic impacts from the project down 4`n
Avenue and Flora Road to Sprague Avenue However, neither County Engineenng nor the
traffic study prepared by the applicant's engineer identified impacts to such roads as a concern
There is no empincal evidence that traffic would use such route to access Sprague Avenue, and
neither the applicant nor the County have plans to extend Steen Road between the applicant's
adi acent project to the east and Flora Road
A letter of opposition regarding both projects was also submitted by Pam and Mike Bendix,
who reside well east of the site, on 8"' Avenue east of Long Road The letter contended that the
projects were inconsistent with surrounding land uses, that increased traffic from the projects
would endanger elementary and junior high students along Tschirley Road, that visibility along
Tschirley Road was impaired, that there was insufficient infrastructure to support the proJects,
and that the projects would negatively impact the environment However, none of these
assertions was supported by competent evidence that would support a finding that deficiencies
exist that render the project inconsistent with the Comprehensive Plan The proposal would not
impact school capacity, since it is directed at senior housing There is no evidence that the
capacity of Tschirley Road for traffic will be exceeded due to the two proJects, that such road is
dangerous for travel from a traffic engineenng standpoint at the present time, or that students
wallcing to Greenacres Elementary School and Greenacres Juruor High will be placed in danger
from increased traffic along Tschuley Road Tschirley Road is not heavily traveled at the current
time, and retirement housing generates far less traffic than general housing, County Parks and
the Central Valley School District did not comment of the proposal County Utilities expressed
no concern regarding the availability of sewer capacity for the project

The Division of Building and Planning found the proposal to be consistent with the Urban
category of the Comprehensive Plan See Staff Report The Heanng Examiner also adopts the
analysis of the project's consistency with the Urban category of the Comprehensive Plan,
contained in the attachment to the rezone application It is noted that the applicant owns 170
acres south and west of the site The proposal is consistent with the applicant's retirement
facility located north of the site, the site is separated topographically from other land uses, and
the few land uses located nearby will not be significantly impacted The owner of 40 acres lying
near the site to the east expressed support for the project See letter dated 1-20-97 from Ibchard
Dahm
2 The proposal, as conditioned. will not be detnmental to the public health, safetv and
!aeneral welfare. and comulies with the Svokane Countv Zonina Code and other applicable
develonment regulations
As indicated above, the proposal generally conforms with the policies of the
Comprehensive Plan The proposal, as conditioned, is also consistent with the development
standards of the UR- ] 2 zone and the Zoning Code The Heanng Examiner has added conditions
of approval to assure enforcement of the provisions of the County's Cntical Areas Ordinance,
regarding wetlands and geologically hazardous areas

Very little opposition was expressed toward the project, and the proposal appears
reasonably compatible with neighbonng land uses The proposed net density of the proposal is
significantly below the maximum net density allowed in°the UR-12 zone The proposal will be
served by adequate infrastructure, as discussed above The proposal will help meet the need for
senior housing in the area

No comments were received from public agencies requesting modification or withdrawal of
the Deternunation of Nonsignificance issued for the project The record does not indicate any
significant, probable adverse environmental impacts from the proposal The procedural
requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane County Code have been
met
III. DECISYON
Based on the Findings of Fact and Conclusions above, the proposed zone reclassification zs
hereby approved, subject to the conditions of the vanous agencies specified below The
conditions of approval recommended by public agencies which have been significantly altered oi
added to by the Heanng Examiner are rtallcized
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Heanng Examiner

INTRODUCTION
This matter has come before the Heanng Exanuner Commlttee on July 20, 1995
The members of the Comrruttee present are Frank Yuse, Chair, Verona Southern
and Toni Nersesian
PROPOSAL
The sponsor, The Evangellcal Lutheran Good Samantan Society, requests approval
' of a Zone Reclassification, ZE-20-95, from Urban Residential-3 5(UR-3 5) to
Urban Residential-12 (UR-12) for an existing nursing home/retirement facillty and
those uses allowed in the Urban Residential-12 (UR-12) zone, and a Vanance,
VE-10-95, from the penmeter landscaping/fencing requuements specified by
Section 14 620 365(2) of the Spokane County Zoning Code
FINDINGS OF FACT ANI) CONCLUSIONS
1 The property is generally located west of and adjacent to Tschuley Road, both north
and south of 8th Avenue in Section 19, Township 25 North, Range 45 EWM,
Spokane County, Washington
2 The Committee adopts the Planrung Department Report as a part of tlus record
3 The existing land uses in the area mclude an existing retuement apartment building,
nursing home, parking, mauitenance building, garages and single farruly residence
with garage, single family residences, agncultural and undeveloped
4 The proposed use is compatible with existing uses in the area
5 The Comprehensive Plan designates this site as Urban (U) and wittun the Aquifer
Sensiuve Area (ASA) and the Pnonty Sewer Service Area (PSSA) Overlay zones The
Urban (U) category is intended to provide the opportunity for development of a"city-
lilce" environment wtuch includes vanous land uses, a vanety of housing types and
densities, and pubLc facilities and services Urban areas will be the most intensely
developed of all the categones, primanly residential along with neighborhood
commercial, light industnal, and public and recreational facilities The proposed zone
reclassification from Urban Residential-3 5(UR-3 5) to Urban Residential-12 (UR-12)
is consistent with and implements the Goals, Objectives and Decision Guidelines of the
Urban category of the Comprehensive Plan
6 The proposed zoning does implement and conform to the Comprehensive Plan
7 The Artenal Road Plan designates Tschirley Road and Eighth Avenue each as Local
Access Streets with a future nght-of-way width of 60 feet Implementation of the

along either road as a Future Acquisition Area
8 The existing zorung of the property descnbed in the application is Urban Residential-3 5
(UR-3 5) previously established as Agncultural (A) zorung in 1957 and redesignated to
Urban Residential-3 5(UR-3 5) on January l, 1991 pursuant to the Program to
Implement the Spokane County Zorung Code The proposal does conform to the
requirements of the proposed Urban Residential-12 (UR-12) zone
9 The provisions of RCW 43 21 C(The State Environmental Policy Act) have been
complied with and a Deternunation of Nonsigruficance (DNS) was issued The
Committee, after independent review, hereby adopts the DNS
10 The legal requuements for public notice have been fulfilled
11 The owners of adjacent lands expressed disapproval of the proposed zone
reclassification The opponents testified that approval of the Urban Residential-12
(UR-12) zone would establish a precedent for further similar density zoning in an
area of low-density residential zoning, the zone reclassificauon is an inadequate
method to bnng non-conforming use into compliance with zoning, and that the zone
reclassification is a questionable method to enable granting of building pernuts
12 The applicant has demonstrated that conditions have substantially changed since the
onginal zonmg of this area and accordingly, the proposed zone reclassificauon is
justified Specifically, changed condiuons include adoption of the Comprehensive
plan and more intensive residential use in the area
13 The proposed use will not be detnmental to the public health, safety, morals or
welfare especially in hght of the conditions recommended by the reviewing
agencies
14 The Committee additionally finds/concludes
a Approval of the zone reclassification to Urban Residential-12 (UR-12) does
not establish a precedent for future land use actions in the area

presented to the Heanng Body Vanations, when approved by the Planrung
Director/designee, may be pernutted, includulg, but not linuted to building location,
landscape plans and general allowable uses of the pernutted zone All vanatlons must
conform to regulations set forth in the Spokane County Zoning Code, and the onginal
intent of the development plans shall be mauntained
5 The Division of Building and Planrung shall prepare and record with the Spokane
County Auditor a Title Notice notulcr that the property in quesUon is subject to a vanety
of special conditions imposed as a result of approval of land use action This Tit1e
Notice shall serve as pubLc notice of the conditions of approval affecting the property
in question The Title Notice should be recorded within the same trme frame as allowed
for an appeal and shall only be released, in full or in part, by the Division of Building
and Planning The Title Notice shall generally provide as follows

1 I.and Use The subject property is located within the Urban category of the
Comprehensrve Plan, the Pnority Sewer Service Area (PSSA) and the Aquifer
Sensitive Area Overlay (ASA) zone The Urban category of the Comprehensive
Plan is intended to provide the opportunity for development of a"city-like"
environment which mcludes various land uses and intensive residential
development Urban areas will have available public water systems, sanitary
sewer systems, storm sewer systems and other public facilities This cateszory
permits "fill-in" with estab(ished development areas where utilities, arterials,
schools and community facilities are existing
Residential net densities in this category will range from 1 to 17 units per acre
The propsed density of approximately 2 7 dwelling units per acre is withtn the

suggested density range Since urban areas will be the most intensely developed
of all the categories, it is primarily a residentiat category of single-family, two-
family (duplexes), and multiple family buiidings along with neighborhood
commercial, light mdustrial and public and recreational facilities The more
intensive land uses such as light industrial and netghborhood commercial will be
located heavily traveled streets, while the least intensive singie-family
residenttal uses will be isolated from noise and heavy Vaffic Multiple famity
structures will usually be a transitional use located between single family
residences and the more intensive areas While this proposal does not provide a
transiiion to more intensive uses, it can be considered an expansion of the
existing retirement facclity located to the north The proposed change of
conditions generally implements the Goals, ObJectives and decision Guidelines
of the Urban category
2 Arterial Road Ptan The subJect site is located south of and adjacent to 8"
Avenue and southwest of the terminus of Tschirley Road 8th Avenue and
Tschirley Roads are designated by the Spokane County Artenal Road Plan as
tocal access screets with a planned nght-of-way width of 60 feet
3 County Parks Pian The Spokane County Parks Plan Terrace View Park as
County park facility located nearest to the proposal ThLs park is located
approxunately two miles south west of the site
C Site Characteristics The stte is undeveloped and is currently occupied by an exishng
care takers residence and four mamtenance sheds/garages The terrain of the subject site
is relatively flat with hills, several seasonal wetlands and areas basalt rock outcroppings
Dense trees and shrubs are scattered throughout the srte
D Neighborhood Characteristics The proposat is primarily surrounded by vacant,
undeveloped lands with an existeng reiUement facility located north of and adjacent to
the proposal
E Zoning Analysis The existing Urban Residential-12 (UR-12) zone was established on
July 20, 1995 upon the approval of zone reclas"sification request (file no ZE-20-95C)
The zone reclassification recognized the existing retirement facility as an use outright
allowed withm the Urban Residential-l2 (UR-12) zone whereas the retuement facility
was considered a non-conforming use within the previous Urban Residential-3 5(UR-
3 5) zone The appticant has reyuested a change of conditions to the Findings of Fact,
Decision and Order issued by the Heanng Examiner Commlttee, specificalty the Division
of Building and Plannmg condition of approva( #4 This condition requires the applicant
to develop the site m general accordance with the origmal concept presented to the
Hearing Examiner Committee which dtd not include the proposed retirement apartment
complex While this proposal does not provide a transition to more mtensive land uses
recommended for this zonmg category, ii can be considered an expansion of an existing
retirement assisted living facility The proposed change of condihons unplements a
majority of the Goals, ObJectives and deciston Guidelines of the Urban category of the

previously classified as Agricultural (A) (ZE-286-57)

lands east and south of the proposal To the north is an existing nursing home/retirement
facility which is owned by the applicant and is associated with this proposal To the west
is vacant undeveloped land also owned by the applicant, who is currently seeking a zone
reclassification of this land from Urban Residential-3 5(UR-3 5) to Urban Residential-7

approved the applicant's request due to existing vegetation, topographical changes with
surroundmg property and the lack of development in the vicinity of the proposal

Approval, the Generalized Comprehensive Plan and other County policies and guidelines The
Division of Building and Plannmg has determined that "No probable signtfcant adverse impacts"

nonsignificance ("DNS")
The "DNS" was ctrculated to 14 other agencies of Jurisdiction and other agencies/departments
affected by the future development for review and comment The "DNS" comment period ended
January 27, 1997 and was advertised 15 catendar days before said date in the newspaper, by letter
to adJacent property owners within 400 feet of the subject site, and by notice on a sign posted on
the subject site The Hearing Exammer may consider additional environmental related testimony
at the public hearmg
IV IDIVISIOIY OF BUILDING AND PLANNING SUMMARY AND RECOMNIENDATION
The proposed change of conditions generally implements the Goals, ObJectives and Decision
Guidelines of the Urban category of the Comprehensive Plan and is consistent with the
development standards of the existing Urban Residential-12 (UR-12) zone The Division of
Building and Planning recommends approval, as conditioned

landscape plans and general allowable uses of the permitted zone All variations must conform to
regulations set forth in the Spokane County Zoning Code, and the original intent of the
development plans shall be maintamed
3 A specific landscape plan, planting schedule and provisions for mamtenance acceptable to the
Director of the Division of Building and Planning/designee shall be submitted with a performance

I have reviewed the responses from Jim Borgan wfth respect to my October 22, 1`996,, review of
the Good Samaritan Traffic Study and report A(though I still have some differences of opinion
with some of the responses, I believe this study has adequately analyzed this proJect
With respect to the p-roject impacts, the capacity analysis print-outs that I pravided with my
October 22 comments show the LOS for the intersection of Tschirley and Sprague is `F' for the
PM peak hour This intersection is,failmg because with the (arge EastNVest volumes on
Sprague, there are not sufficient gaps to allow left turns from Tschirley
Additianally, as drscussed in response 6, a four percent annual growth was to be applied as
background grvwth I did not find this was done If the four percent growth had been applied,
the levels of sennce would have dropped even further into `F'
With the traffic prajec#ions showing the additionai volumes expected to use the
TschirleylSprague and App(eway/Sprague intersections, a signal and geometric changes are
being considered for this area Since this project would derive a benefit frvm the signal, the
Good Samaritan proJect should participate in fundrng the signal

Thank you for the opportunity to respond to the comments in your October 22, 1996
memorandum to Scott Engelhard. Although we did not receive the memorandum until mid-
December, we thank you also for your promptness in clanfying the intent of your comments
The following responses are organized in the order noted in the memorandum Each response
is preceded with a short paraphrase of the onginal comment
1"The report as not sealed by lacensed professronal enganeer". Enclosed with this letter is a
copy of the report signed and sealed by a professional engineer.
2"77ze ITE land use category The project is considered a PUD only because the duplex
units are clustered on the site, thus falling into Spokane County's Zoning Code definition
of a PUD
ITE defines a PUD as a residential project with multiple types of dwelling units, including
supporting retail and recreational amenities ITE recommends using more specific tnp
generation categones when the specific types of residential units are known, as in ttus case
3"Only one site access (is shown) Presently, the Tshirley Rd /Eighth Ave comdor
provides the only access to the existing facdity A second access was discussed with Pat
Harper and Fire Distnct 1. Given the existing topography, there are no feasible
alternatives for providing additional accesses

4. "The capacity analyses use a peak hour factor of 0 95 (The default value in the Haghway
Capaccty Software, HCS, when a PHF of 0. 93 was (observed) " As demonstrated by the
attachment to your October 22 memorandum, the difference has a minimal impact on
delays Furthermore, it has been observed in numerous other traffic studies that, as LOSs
detenorate (i e, approach LOS "F"), the PHF approaches 100, which would mean the
project could not be as detnmental
5. 1 was unable to dupltcate the capaccty analysis prrntouts Version 2 1(a) of HCS was
used n the report Subsequently, Version 2.1(c) has been released which evidently shows
lower LOSs for the same conditions Nonetheless, the attachments to the October 22
memorandum indicate that, at a 95 percent confidence level, the longest queue with the
project would be three vehicles for northbound movements, hardly what one would
consider LOS "F" for the minor movement at an unsignalized intersection
Furthermore, Version 2.1(c) estimates the 95 percent queue length without the project to
be 2.1 vehicles for northbound movements While conducting the actual traffic counts, no
queues exceeding two vehicles were observed, nor were any excessive delays observed
Finally, as was discussed, northbound Tschirley at Appleway is wide enough to allow left
turns and nght turns to be made simultaneously Consequently, the actual capacity of the
intersection is somewhat better than that which was analyzed
6. No background projects (were) added As we discussed dunng scoping of the study,
Spokane County recommended a four percent per annum growth rate be used for the study.

TECHNICAL SUMMARY
August, 1996
I. STATEMENT of PURPOSE / PROJECT SCOPING
The proposed project is the construction of 56 duplex units
(in 28 duplexes) and 50 "assisted living apartments" in the
Spokane Valley Good Samaritan Retirement Village. The purpose of
this report is to summarize the results of the traffic study for
the proposed project as required by Spokane County.
II. ANALYTICAL PROCEDURES and METHODS
The basic analytical approach followed standardized princi-
ples and procedures described in the Institute of Transportation
Engineers' (ITE) TRANSPORTATION and LAND DEVELOPMENT (T&LD), as
supplemented by the Transportation Research Board's (TRB) NA TIO-
NAL COOPERAT I VE HI GHWAY RESEARCH PROGRAM REPORT 18 7(NCHRP 187),
and ITE's TRAFFIC ENGINEERING HANDBOOK. Other standard
references used in this study included, but were not limited to,
the following:
(1) ITE' s TRIP GENERATION;
(2) TRB' s HIGHWAY CAPACI TY MANUAL / Speci a l Report
209 (HCM);
(3) The Federal Highway Administration's (FHWA) MANUAL
on UNIFORM TRAFFIC CONTROL DEVICES for STREETS and
HIGHWAYS ( MUTCD) ;
(4) The American Association of State Highway and
Transportation Officials (AASHTO) A POLICY on
GEOMETRIC DESIGN of HIGHWAYS and STREETS;
III. PROJEPT DESCRIPTION
Exhibit l,,on the following page, is a location map showing
the proposed project's site. As shown in Exhibit l, the site is
located south and west of 8th Avenue between Flora and Tschirley.
Exhibit 2, on page 3, is a preliminary site plan. As shown in
Exhibit 2, the proposed project is the construction of 56 duplex
units and 50 "assisted living apartments" in the Spokane Valley
Good Samaritan Retirement Village.

A. ROADWAY SYSTEM
Exhibit 3, on page 5, shows the lane configura-
tions of the intersection and the traffic controls. As
shown in Exhibit 3, Sprague Avenue/Appleway has a five
lane section at Tschirley; Tschirley, a"Local Access
Street", is about 30 feet wide and is a two lane road.
B. EXISTING TRAFFIC VOLUMES
Since turning movement counts were not available,
a"peak period turning movement survey" was taken at
the intersection of Sprague Avenue/Appleway and
Tschirley. Based on Spokane County's traffic counts,
it was determined the peak hour of traffic in the
site's vicinity is in the afternoon / evening. Con-
sequently, it was selected as the "design hour", and
'the "peak period turning movement surveys" were taken
between 3:30 P.M. and 6:30 P.M. The results are also
summarized in Exhibit 3, on the following page
(Attachment "TM" provides a listing of the entire data
set).
C. EXISTING "LEVELS-of-SERVICE•'
The standard procedures for determining opera~iyg
conditions estimate "levels-of-service (LOS's)" 1 .
The "ideal" capacity of a typical ro1d~aay is about
1,800 vehicles per hour (vph) per lane 2~. The worst
congestion on roadways usually occurs at intersections
where competing traffic flows (e.g., left turns -vs-
opposing movements, etc.) "share" the roadway's
capacity. .
Capacity analyses were performed using "Highway
Capacity Software", computerized implementations of
"The concept of '1 evel s-of-service' is defined as a qual i-
tative measure describing operational conditions within a
traffic stream and their perception by motorists and / or
passengers. A level -of -service (LOS) definition generally
describes these conditions in terms of such factors as speed
and travel time, freedom to maneuver, traffic interruptions,
comfort and convenience, and safety. Six 1 evels-of-service
are defined. They are given letter designations, from 'A' to
'F', with LOS 'A' representing the best operating conditions
and LOS 'F' the worst." HIGHWAY CAPACITY MANUAL: SPECIAL

V. CONDITIONS with the PROPOSED PROJECT
Tschirley provides the primary access for the proposed
project to the regional system; consequently, the focus of the
study was Tschirley's intersection at Sprague/Appleway.
A. TRIP GENERATION
The standard reference for estimating trips
generated by land use category is the Institute of
Transportation Engineers' (ITE) TRIP GENERA TION.
Exhibit 5 is a summary of the resul ts including a
listing of the actual output of the software). As
shown in Exhibit 5, the proposed project is estimated

to generate 268 vehicle trips per day (vpd) on an
average weekday ("average weekday traffic volumes"
AWDT`s). Of those, only 13 vehicle trips per hour
(vph) occur during the morning rush hour (i.e., less
than five percent), and 25 vph occur during the
afternoon/evening rush hour (i.e., a little over nine
percent).
B. TRIP DISTRIBUTION / TRIP ASSIGNMENT
Trip distribution (i.e., the basic orientation of
the trips coming to or going from the proposed project)
was based on the existing turning movements and
parameters contained in NCHRP 187. Exhibit 6, on the
following page, summarizes the resulting trip ,
distribution. As shown in Exhibit 6, the predominant
orientation of traffic generated by the proposed
project is from/to the west.
C. FUTURE "LEVELS-of-SERVICE" with the PROJECT
Using the same procedures as were used for
"background" traffic, estimates of "levels-of-service"
with the proposed project were made; Exhibit 7, on page
9, summarizes the results (Attachment "CA" contains the
actual output of the software). As shown in Exhibit
7, the levels-of-service remain acceptable for urban
conditions.
VI. FINDINGS and RECOMMENDATIONS
Based on the operational analyses, it was concluded no
mitigation measures are needed.
